I contacted the Chief of Police for Irvine, and long story short gave him the video with my compliments for his officer, he kindly responded and will pass on my compliments for the way Schaefer handled this encounter.

The fact that the videographers were on public property meant that they violated no laws and the officers acted in furtherance thereof. Did you see the videographers at any time be forced to stop recording by the government? In fact, did you see the videographers at any time to be forced to stop recording at all? Private citizens have a right to report to the police so long as they do so truthfully. What the guard said was clearly audible on the recording. He reported what he saw. The police investigated and found no violation. The first amendment did indeed apply and guided the actions of the officer. Definitely a pass.

"CONGRESS shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." The protection was expanded to apply to the states through the 14th amendment in Gitlow v. New York, 268 U.S. 652 (1925).
