I haven't heard this. In what I've ready about him is that he was very smart and graduated from Harvard with a Masters of Buisness Administration and while in college, his mother was supportive of him promoting concerts in their hometown. So I'm not sure about him ever being an attorney because he was going to Harvard and was a promoter at the same time and then continued on as a music promoter before becoming a boxing promoter/manager. But Bob Arum is an attorney.
Errol paid Derrick the same rate based on their agreement and paid him a 100k bonus. Derrick wants a raise that's fine. Ask Errol to renegotiate but I'm with Fannon if this wasn't brought up prior to the Bud fight and he decided after finding how much Errol made that he wants more then renegotiate for the fights moving forward. Spence aint wrong on this one
Kind of like frank Martin. He verbally agreed to a fight then come time to sign contract when finds out how much money IS REALLY IN THA POT, He started talking more money. How do you agree to one rate and come time to sign the contract you have a problem with it

That's not exactly true. It's just harder to prove. A verbal agreement is still an agreement. A verbal agreement could possibly be recorded or someone could of overheard the conversation. Also, they are in agreement that they had spoken about payment so that's not the issue. If the judge asks Errol did he have a conversation with Derrick about being paid 10% he will say, "Yes". And if the Judge asks Derrick if he had a conversation with Errol about being paid 10%, he will also say, "Yes". The judge will just have to determine the definition of 10% and like Fannon said, if it's always been 10% of the purse and not the various streams of revenue from the gate, merchandise, PPV, etc., then it's going to be difficult to prove that Errol owes him anymore money. But yes, we are taught that if it's not in written, it didn't happen, but after one tough year in Law School, that was something that I learned in school in like week 4, that a verbal agreement is still binding. And a contract can even be written on a napkin to be considered a written agreement.

If you didnt have an agreement in writing Derrick is wrong. Spence vs Crawford was EJ's biggest fight and DJ knew that. So you mean to tell me that you went into a fight knowing EJ was gonna get paid his biggest ever check and you dont renegotiate the terms? But you rely on a verbal agreement over a decade ago to a very young EJ?
You were spot on with this one. Derrick is not entitled to the total purse because he’s not promoting the fight or partnering with other promoters to sell the fight. Anytime he’s asked about Spence fighting other fighters his response is I don’t concern myself with that because that’s not what I do in lack of better words. If that were the case then Spence would also owe him from the ppv fights prior.
The guarantee purse does not include backend, because PPV and gate money are not calculated until after the event. Am I wrong about that?
Nowadays you can sue anyone for anything and it's sad....but it happens all the time.
And it doesn't cost much to sue someone but it costs a ton to defend yourself....

I agree. This is the problem with oral agreements. In boxing or anything else. I was getting ready to do a deal with someone where I’d split all revenues 50-50 but “ I “ would OWN all rights to the property. Why? Aren’t they getting half of everything anyway? Yes. But they or their management team have no say so in what I do with the property. Only I can dictate the direction of the property. They have no veto power or the ability to also use the property the way they’d like to equally. Yo have to spell things out. If you don’t it gets messy. One last thing on the subject. You need to make sure what you are doing fits either into established law, or that it is unassailable by law if it’s a brand new avenue you are going down. That can be tricky because one never knows how a judge or jury might see it differently from the advice you got from your attorney. In this case though, I think you’re right. The precedent was set over 12 years. Hard to change the game that far after the event. I think Spence considering maybe taking care of him as either a one time thing or establishing a new agreement is big of him. It shows appreciation of their history.

This will be determined by precedent. Meaning once Errol money for each fight is recorded and the money he bad Derrick James is recorded the court will more than likely use the precedent to determine if the verbal agreement is true regarding Errol or true regarding Derrick James. They got 9 fights to funnel through to see what his percentage of will be. However, Since Errol and Bud had the 6ht largest gait in boxing history and around 700,000 ppv sales It's a very good chance that Derrick will get a little more money only if Errol was generous on the other bouts when he did not make as much. Ryan's big mouth didn't do that...the gravity of that fight money has done that. Since this happens after the Bud fight versus the other PBC fights he had it dispels a big part of the argument that Bud is not a draw...Turk ain't trying to lose no money....

I had a partnership dissolved and verbal agreement was a big part of what it centered around. An arbitrator discussed what would prove this particular case (where there is he say vs he say) is the history of money changed in our business partnership not just what is normal or acceptable lawful behavior. In our case verbal agreement is going to be determined not by other relationship, but by the history of money exchanged in our relationship. I was just giving a personal perspective from a similar experience that was it....I learned that oral contracts are legally binding, but can be difficult to prove in a court of law. I won the case because of precedent not what others did...If he said in a text extra money he gone have to pay even if it's $1 but the court will decide looking for prior history...
Yeah, if Mr. James has been ok with his pay for 12 years, I think it will be hard for him to claim more now. Estimates of PPV revenue on big fights hit the media within days after the fight. Over the course of 12 years, he should have recognized that his cut isn’t lining up.

Perhaps Derrick has found out new information, which tally’s up to: he has not been paid correctly the last 29 fights, meaning he is not in the wrong, if Errol has been doing the wrong thing up to this point, doesn’t mean it should continue- now DJ has been enlightened, the right thing needs to be done- he should not continue to do the wrong thing.
