  • VA's presumption of exposure means that veterans who served in certain locations, at certain times, do not have to provide the typical elements to establish service connection. Veterans exposed to Agent Orange in service (inside and outside of Vietnam) may qualify for presumptive service connection, entitling them to VA benefits and a VA disability rating.     Why is Okinawa not added to this new list? There is plenty of reading material on the web stating it was used there. There has been two service men awarded benefits for Agent Orange while on Okinawa, but it isn't recognized for everyone else as of yet.

    Yes Veterans needs too know your backpay starts with the new Pact Act I filed a claim for leukemia in July 2021 this means I'll lose backpay for a year approximately $32000 I do have a law firm out of GA. Hoping there's a legal loop hole for Vets that file a year before the law was passed....

    VA was able to get deck logs from ships i was on operating as naval gunfire support ships off the coast. I had given them the ship names and dates they operated off the coast.

    I and my brothers were in Panama and AGENT ORANGE was used there. No one told us back then (1975-1977). I have been told that I have DIXON.

    I receive VA benefits for hearing loss and I'm taking meds for high blood pressure so I will look for a case worker in my area to apply for
    Hypertension. Vietnam 1970-74.

      I applied for hypertension agent orange Viet Nam. Was approved service related 0 present companstation. Take meds for it long as pass blood pressure test you get nothing.

    I filed a few years ago and was denied. I have high blood pressure, am diebetice and have cll. I was diagnosed with cll about 9 or 10 years ago and am being watched my the doctors. i was in 2nd inf div korea twice during the 60's and 70's. Because of my low income on social security I don't pay anything for treatment or meds so I didn't think there was any point in filing again. I'm 74 years old and may not be around too many more years anyway. This is interesting and also good to know. Thank you.

      You should be 100% due to the CLL. My father was at 100% and had cll. Died in 2019 @ 74.

      If you were not in the units that are recognized to have been exposed then its a moot point.

      The new PACT act that was effective Aug 2022 makes it somewhat easier to get PACT claims approved for the presumptive health issues.

    Yes I got neuropathy in my hands and on my arm legs and feet and it’s really bad and they know that it’s that I have it but I didn’t claim was it within the first year of separation because I got out and 16 eight I spent the whole time of Tet Offensive of 68 so hopefully I can get my disability for this because like I said it was slow acting I didn’t get it right away

      Forgot to ask were you in the Marines? It does not matter what branch of the service you were in: you are fully covered if your blood and urine is positive for MGUS; however now that mine was positive I feel like it is a death sentence.

      Same here, how can the va hide behind their excuse of the vet having a one year window to file a claim ,Imran it's a chronic progressive disease . We were only kids 18- 20 yr Olds at the time right now my feet especially toes driving me nuts, can't sleep properly. My neurologist has put me on a mind altering drug telling me it will help me feel better! Ha what crap, won't do a stronger pain killer. Oh well maybe I can get a small disability for hypertension, have that for years,they'll probably deny that a first couple attempts, making me jump through flaming hoops.ha. good luck?....

    What if the veteran has passed and was exposed to agent orange, could the spouses benefit increase if some of the symptoms weren’t linked to agent orange.

    VA just sent my dad 2 letters that said they did all their research and couldn't find any records on the locations of his ships during Vietnam and Johnston Atoll duty stations. While his Agent Orange Blue Water exposure is now included as Presumptive and he has medical related conditions on the Agent Orange list, what happens next now that the VA-MILITARY Records departments can't find proof of ships locations? This seems asinine that they lost ships logs!

      When I applied the VA said the same thing to me but I had kept the ships cruise books showing where it had been
      deployed and pictures of the ships crew. You really need to get a VA case worker.

      Same happened to me and I to the national archives in washington d c and explained the dates and they sent me proof of the ships location and deck logs. Glenn

      Have him go to the National Archives and asked for him ship deck log. I got me Deck Log and it work for me. I live the in Maryland so I was able to retrieve mine.

    I served in Nam as a bush Marine in 69. I had prostate cancer and had to have my prostate removed. Since I had triple bypass surgery because of heart issues and I was wondering about my children they are all having health issues that none of my siblings children are. What can l do ? They are all grown and are adults in their 40’s

    My Dad served three tours in Vietnam. He died of cancer at age 59 that was in his brain, bones and kidney. I am his adult child. What benefits are available for his dependents?

    My 72 yo husband was Nehmer rated due to hypothoidism in 2010, diagnosed w hypertension with ischemic heart disease profound memory loss, ptsd, ED, hearing loss scoliosis and other bone and joint problems. VA denied his agent orange claim in 2013 because his claim should be a year after separating from active service in the navy. All the agent orange related illnesses showed up years after he retired. He never took prescription meds prior to retiring and now on 4meds for his medical conditions. Can he can file for agent compensation again? Will VA decline it because it’s many years after he retired?

      Yes he can still apply for agent orange. Recognized illnesses and locations where Agent Orange was used have been updated and many added that we will not considered before. Get a free Veterans Service Organization representative to assist in filing. Make sure to file the Intent to File a Claim Form asap. The VA loves forms and they create many just for one situation. I think it's to put a cog in the wheel and frustrate us.

    The government said you had to file within the first year of separation but now are they saying it is their agent orange sometimes slow acting or fast acting good mine was slow acting

      you can file anytime. They use the 1 year from seperations as a guideline. if you have any of the Agent Orange Presumptives the VA automaticlly concedes that your dignosis for the Presummptive is from your service in Vietnam

    In 2012, I was told that the remaining agent orange were dumped at Fort Gordon, Georgia in 1975 to 1977. I was there summer of 1980.
    While there i notice small planes spraying pesticides over the area we were training at. Should I be concerned?
    I'm also 100% P&T.

      Denial only means try harder, get a lawyer or a VSO, someone who knows how to appeal the denial. Then it can go to a HLR route.

    I was in Vietnam for 2 tours. I am getting 100 percent disability through the VA. I get 80 for PTSD. I do have agent orange. I tried applying for an additional compensation,but they turned me down. I have different things that has been diagnosed agent orange. I need some help with this.       Go see a VETERAN SERVICE OFFICER in your area, VFW is a good place to start. They will have a person who does this for veterans.

    QUESTION: Where in the Laws of the United States, is it expressed, a veteran rated NSC @100% be reduced to 0% when GRANTED service-connected by the Board of Veterans Affairs, or a veteran rated by VA NSC @70% for 20-years, be reduced to 0% when GRANTED service-connected by the Board of Veterans Affairs?

      Well if the service-connected compensation is higher than the NSC compensation then receiving the service-connected compensation would be a greater benefit.

    I am a boots-on-the- ground Vietnam veteran already drawing on more than one Agent Orange disability The VA has been medicating me for hypertension for over 2 decades. How can the VA diagnose the severity of my condition if their readings will be based on when my condition is altered by their medications?

      controlled vs uncontrolled hypertension is what gets you compensated.

      I was boots-on-the-ground Vietnam too, and have a 0 % Hypertension rating because it's controlled. I'd rather have it controlled than get benefits because it's high. If it goes up, I can always request a rating increase.

      @@ronwilliams3324 I already draw 100% service connected plus extra on Special Monthly Compensation so my claim is just to get it documented as "service Connected" not income; just in case the VA may once again try to shaft somebody and that somebody be my wife after I'm gone. Life is full of risks so I told the VA openly that I would be skipping my blood pressure medicine on the mornings of my C&P exams. I went in 3 times and they got like 204/99 readings every time. Sure my hypertension was documented at my discharge physical but more documentation is always better. The VA can does make records disappear as sure as their cocktail of pills does cause veterans to kill themselves.

    My dad was a medic in vietnam and at first qualified only to have the va send a letter telling him his claim is invalid unless he can produce three witnesses that saw him in Vietnam. Like that's going to happen anytime soon most the people he knew then are already long dead! He recently passed away himself and it seems criminal the way he and his fellow servicemen have been treated by the government.

      I am not a lawyer; but I might Suggest a MGUS test if you suspect you may have a hidden blood cancer from Camp Lejuene.

    I'm a 100% PTSD. I was denied agent orange. But I was rated 10% . I was treated for hypertension on going should I refill for agent orange?

      Absolutely and insist on a MGUS test. If positive you may not like what it means; but re-filing will likely get you 100 percent service connection disability very quickly and a lot more benefits. Cheers

      I have 100% for PTSD and 100% for heart problems and another 40% each for two lower heart chambers.

      i am a VSO, if you are receiving 100%, there is really no reason to file any new claims. At 100% there in no more compensation to receive. If you have been drawing for less than 10 years and have heart problems and in poor health you may consider filing on hypertension. Simply fo ensure that your spouse is elegible for DIC should something happen to you before you reach the 10 buffer after that time your spouse is automaticlly elegible for DIC

      @@sammybarnett3613 there is another reason. I was 100% for PTSD then got 100% percent for heart problems . That automatically made me homebound and about $300 more a month.

      @@terrydouglas5008 yes the being rated homebound is a SMC addition to the compensation you receive already. You can be rated homebound even if you arent 100%SC, it just depends on what your are rated for and how it effects your daily living.

    Although this is excellent information, but how will the Vietnam Veterans receive this information? Since quite a few are homeless, in nursing homes, mental institutions or deceased. A co-worker of mine father just passed away, and he was CONSTANTLY DENIED "AGENT ORANGE" and other related conditions. You all put out good and pertinent information, however, the VA, at times gives a RATS 🐀 ASS ABOUT VETERANS and the Service that Veterans gave for their Country.

So sorry to hear of your loss with your father, but I am absolutely certain that he would want his beautiful/loving daughter to continue forward with Fury with your life.

    My father was a marine, he served 3 tours in Vietnam. He was shot 3 times stabbed blown up and lived through all that to come home and die a slow long terrible death from Agent Orange. If anybody knows how I could be tested for Agent Orange pls let me know. I've been showing symptoms all my life. I'd really appreciate any information.

      I was in VN,1968-1969,we had to stand down while helicopters flew over spraying the trees and vegetation before we went in,all we knew is everything started dieing instantly,and you could see and build a house after they sprayed,we went thru there on foot,sat on the ground and ate C-rations.I have a lot of medical problems,skin problems that I had 50 yrs. ago and has gotten worse.Now they want to write me off at 90% and say I can't file anything else! I need HELP

      @@Funky4me21 It definitely can be passed on, I just can't find a doctor that will test me. If it can't be passed on why don't they just say so and prove it instead of giving people the run around and every excuse in the book not to test me. I spoke to my father's doctor years ago and he said it can definitely be passed on but refused to test me cause he is a VA doctor and not a veteran, was his excuse anyway. I need help bad, my health is deteriorating fast and I'm only 48yrs old, ok have major medical issues and nobody will help me, I'm disabled so 9 can't afford insurance and I've been turned down for disability twice. I have galt bad, can't stand on my feet more than 30mins to a hour or my feet will swell up like balloons and the government doesn't give a crap. I'm not a illegal alien so I don't get any benefits.

    AND what about the children of Vets that were exposed ? It is truly disappointing how slowly the V.A. concedes the Truth in factors that make life miserable for its Vets & children of Vets. You don't have to be a rocket scientist to establish how Orange destroys & damages DNA, causing various diseases in life. My sister & I are children of a Vet exposed to Orange. Not only does my father have a degenerative spine, lost all his teeth, a cerebral condition, bone loss, my sister & I suffer from degen spine (i've had 6 lvls fused, but it hasn't stopped the breakdown), I have bipolar illness w/ psychotic breaks (a genetic test showed an active protein associated with mental health), sudden bone/muscle loss, constant pain, brittle/broken teeth, she has cancer & other female related conditions. Just Orange exposure alone should account for at least a 50% rating FOR children of exposed Vets. 😟
