      I’ve had a couple of close calls where I was so sleep deprived I would ask friends to call me every 10-15 minutes due to the fear of falling asleep in rush hour traffic. The laws vary too much depending on location and are up to the discretion of officers, so unfortunately it feels like you have no choice, but to suck it up and hope for the best sometimes.

    Not being able to sleep in a stationary car should be illegal. Drunk or not, getting an hour shut-eye while on the road can literally save lives.
    *Edit - Sleeping in your car should not be illegal. It should be legal. No matter what condition you are in, sober or not. Put keys away and sleep in the back or something.

    In Britain, most of the time it's legal to sleep in your car. In fact, Rule 91 of the Highway Code implicitly recommends it when you're feeling tired: “If you feel sleepy, stop in a safe place. Do not stop in an emergency area or on a hard shoulder of a motorway.”

    I had a couple of nights in LA when I went out clubbing and had too much to drink. I slept it off in my ride. Back then (the 90s), the rule was if your keys were not in the ignition then no DUI. One time, the cop even checked up on me before his shift ended and thanked me for doing the right thing and not being a danger to myself and others.

      Yeah a buddy of mine got a DUI for sleeping in his car, at a bar that had signes and set parking spots giving permission to sleep overnight in those spots after Uber did that dumb thing where they wouldn't pick you up if you were drunk. The bars owner backed everyone up who had been charged and even had surveillance footage showing everyone SLEEPING. 'does this look like drunk DRIVING to you?'

      Yes- times and laws have changed. I wouldn't be able to sleep off the drinks on the car like I used to in CA. I support laws preventing people from being a danger to others, but there needs to be some common sense. If someone drinks too much and chooses to sleep it off in the car, that's called DOING THE RIGHT THING!!! And a .02 BAC law is preposterous. That's having one beer or wine with your dinner. Really?!

    In Germany it's even encouraged to do that. There's a specific law that allows you to sleep in your car anywhere for the purposes of "restoring the ability to drive if you're unfit". So you can't camp, but yes, sleeping off the booze or pulling over because you're too tired is totally legal.

      It’s similar in the UK. Under Rules 91 and 95 of the Highway Code you are allowed to stop in a safe place if you are tired, however you must not be over the legal drink drive limit.

      The problem is, most the time it's implication. So for example, just because you slept in your car that doesn't prove you didn't just drive there and sleep(dui stuff). It depends on your states law. I've seen it a few times where it states positive control of your vehicle. Which sometimes that could be as simple as falling asleep with the keys within arms reach. I think if I remember, it's like that in Hawaii. So it's always smart to get those keys as inaccessible as possible. But just falling asleep in your car? Naw, I never got anybody for that. That's just stupid, you don't have to be homeless or anything for that, we would have people show up super early just so they could find parking and sleep in their car till they started work.

      Just about ever car sold in the last 60 years has a trunk release somewhere the driver can reach it (usually on the floor or under the dash on the driver's door side), so if you're sleeping IN the car, you will be able to easily open the trunk and retrieve your keys.
      Only real risk is if you toss your keys into the trunk BEFORE you open the doors. And even then, with most modern remote key fobs, you can just open the trunk from the outside if the keys are inside.

      you're not intending to drive, you can get slapped with a DUI. In the high majority of states, it's against the law to be in physical control of a car while you're under the influence, and sleeping in the back with keys in the trunk is still physical control. You don't have to be driving to be considered in control of the vehicle...

      I saw a video of Girl recently that has been drinking with her university friends, and decided to take a nap in her car instead of driving because she was drunk and decided not to put her life in danger. and she got charged with DUI which is a misdemeanor in her state :/. So she got arrested for sleeping in her car.

      I personally know a man in West Virginia who was convicted of a Driving Under the Influence of alcohol (D.U.I.) while there was no sighting of him driving, or evidence suggesting as much.
      As the lawyer in this video explained NOT to do, my acquaintance slept with the keys in the ignition with the ignition off, and the transmission in park.
      My acquaintance drove a short distance from a bar (pub) on only one street to a gas (petrol) station that included a market for bread, milk, tobacco, coffee, and so forth.
      My acquaintance was not accused of being in a collision.
      My acquaintance parked perfectly in a level parking space away from the pumps, near the entrance of the market and cashier.
      My acquaintance purchased cigarettes, and realized he might be above the " two alcohol drinks per hour " limit.
      And instead of driving away, he sat in the front seat of his car, locked the doors and attempted to sleep with the ignition key in the ignition switch in the off position.
      A cop, who arrived on the scene to buy coffee, woke him up with a knock on the door window.
      My acquaintance did NOT have a container of alcohol beverage in the car.
      Nobody claimed to have seen my acquaintance drive to the gas station / market. He told me his D.U.I. conviction was based on the prosecutor's / cop argument that sufficient "intent to drive" was proven based on the key being in the ignition switch in the off position.

    Went through this once. Slept in the passenger seat and hid my keys under the gas cap. Got a window knock from a cop round 3am asking why I was sleeping alone in the passenger seat. Told him I was too drunk to drive and he asked where my keys were, told him gas cap and he could check if he wanted. Cop said "alright I'm on patrol round here and if I see you driving before 8am I will be arresting you. Have a good sleep." 😅

    That's so weird.. in Germany, sleeping in your car is illegal but if you're drunk, it's ok, as you're avoiding to become a drunk driver this way.

      To be fair, if someone *was* driving with their butt in the clouds, stopping for a moment and getting caught with a stationary car doesn't mean you didn't drive. Getting caught right as you get into the car while drunk before you could drive doesn't mean you weren't meaning to. And since intention is impossible to know up front, you gotta encode it somehow into the facts themselves. Also, doing all of that shows you had enough clarity of mind to know driving like that was not a good idea. Had you been absolutely socks on your neck drunk, you might not care, so being careful like that is gonna help your case too.
      Like I agree there are some extremely ridiculous laws in the US like loitering and car sleeping, but putting your keys in your trunk and sleeping in the back seat to bake into the facts that you were planning on not driving is actually very sensible.

Im a grown adult I can operate the heat/AC/radio with a BAC of 0.08. I shouldn’t have to go out of my way to dispel any doubt the officer may have. They can observe the situation instead of jumping the gun and giving well intending people DUI.

I used to sleep in the backseat of my truck in a huge downtown parking lot after my closing shift at a night if i had too much to drink. The cops never bothered me once. I just assumed they knew it was a bar district and a better alternative than driving

    There's a bar a gaming friend likes to go to that has designated parking spots for people who want to sleep in their car overnight if there drunk. (started when uber had that dumb thing where theyd not take you if you were drunk). Cops started targeting it to catch 'easy DUI's.' It's dumb and stupid that they will use these loopholes to make DUI arrests. That should be on ACTIVE drivers, not just 'assuming they MIGHT drive when drunk'.

      Shouldn't the bar's parking lot be considered a DUI safe zone for this specific reason? It's only open to the public in the regard of them being customers; not a customer, gotta go or get a tow.

    it baffles me that there are state laws in the US forbidding people from sleeping in their car, it makes no sense, let's start with the fact that, no matter where you are, if you are sleepy is better to just go to the side and sleep, not to keep driving, and for some people without a house it is the only safe place to sleep.

    I've been woke up twice by cops while sleeping in a bar parking lot with express permission from the bar owner. Both times they tried to intimidate me and said the owner called about a suspicious person as well as tried to find out where my keys were. Both times they ended up leaving me there.

    This is accurate. One time I was too drunk to drive and was out of town. I locked my keys in the gas lid and slept in the passenger seat. A cop woke me up in the middle of the night asking what I was doing. When I explained the situation to him he called his supervisor and ended up leaving me be. I saw him circle back several times throughout the night though.

      I was in a court ordered course for drinking drunk and the exact situation happened to an officer, he let the guy be and later the drunk guy went and found the keys.... He crashed and died.

However, they will come back later to check on you just to see if someone is trying to steal your car or trying to rob you. The come back later thing might just be for your safety rather than a show of force.

      I live in Tennessee had never been in trouble, concealed weapons permit holder(not carrying)A doctor at the VA gave me some medication(non-narcotic) that I had a rare reaction to I had double vision and was nauseous. I was thinking about going to the ER. I was parked in hotel parking lot with my seat laid back waiting on my brother to come get me, but I had the AC on (keys in the ignition)🤷‍♂️ two police officers came to each side of my car asked me what I was doing. I explained the whole situation, as my brother pulled up. They said they didn’t believe me that the parking lot I was in was known for drug deals. They arrested me for a DUI, saying I admitted to not being able to operate a vehicle with the keys in the ignition. I told them I may need medical help instead, they left me in the back of a cruiser handcuffed for over three hours alone while they searched my car. No sobriety test no blood test. It’s the only time I’ve ever been in trouble for anything, it hurt my life in so many ways. So yes, it pays to know the law.

    I knew someone that got too drunk and had no one to give them and ride and instead of risking it and driving, he actually called the police and ask the cop to give him a ride home because he was intoxicated and should not drive. Surprisingly the cops picked him up and took him home and the cops were glad that he did what he did instead of drunk driving. I’d say that is a good option, you can always figure out a way to get your car the next day.

    Fun fact, i use to do this in highschool up to my late 20's. I kept a spare blanket and sweater in the back so i wouldnt have the keys in the ignition. Id also have w portable phone charger in there at all times, as well as covers for the windows and such. It was always easy to park somewhere, huddle in the back with my blanket, my sweater as a pillow, and my phone charging.
    Its better to take a nap than get a dui, or worse.

    Funny story about the “sleeping in your car” law. I live in NJ, and I once had an encounter with the boys in blue because of it.
    I was a college student and had spent most of the night studying. I woke up to my mom forcing me to drive my sister to the nail salon (keep in mind, it was right down the street, she could’ve walked). I begrudgingly got out of bed and drove my sister, and being the lazy gal I am, decided to just nap in front of the salon with the engine off and my hoodie on. I doze off and awake around a half hour later to knocking on my window. As soon as I open my eyes, I’m met with an officer on both sides of my car. I instantly shoot up, unlock the door, and open it.
    Now, I’m still waking up. So, the FIRST thing I say to this officer is “I am America”. It took approximately 10 seconds for my mind to compute the words that just left my moth, so I immediately apologize (if the cop didn’t think I was on something, he certainly thought so after that 😂). They proceed to take my license and I consent to a search (I was lucky af that my brothers hadn’t been smoking at that time). Everything runs clean and the second officer is chatting with me, waiting for the first officer to clear his side of the car.
    Turns out the front of the salon was a HUGE drug hub. Somebody had spotted me sleeping in my car and tried to wake me, but at that point in my life and coupled with my mental/physical exhaustion from being a college student, I slept like the dead. So, the person probably thought I was overdosing.
    It’s one of my favorite stories, since I come from a cop family. So everybody gets a good laugh, since it was my first run in with the cops. FYI, apparently it IS illegal to sleep in your car in some counties in NJ, so check county laws before dozing off!

    It's odd to me how even in Drivers Ed they tell you if you haven't slept in 24 hours and feeling tired to safely pull over and find a place to sleep, how is it not safe to sleep in your locked car, with your parking brake on, laying down in the backseat with keys in the trunk.
    I also find it ridiculous that pulling over onto the shoulder lane of a busy street is dangerous, yes it's dangerous if you're out of the car. No because no car should be driving on the shoulder of a busy street. Yes if you're parked in the middle of the road. No if you're trying to keep yourself and others from avoiding an accident.
    Not to mention trying to find a rest-stop or motel thats open and available 24 hours is difficult and encourages more driving.
    Either triple up the rest stops increasing the hours for a good 8 hours or leave us alone in our damn cars.

      As a german i always said the same about the shoulder being safe cuz there are zero reasons for anything to happen.
      Yet there's a million dashcams from the us where trucks apparently just drive on the shoulder, cars lose control and skid across 5 lanes and into the officer/ their car

    Another important one you should add is that if the car is running at all, even if you’re in the back seat, its still a dui. This becomes a serious problem when its deadly temperatures outside, but many jurisdictions do not care.

      @@fkrkfDude taxis may not be an option. Say you’re in a smaller town or something. Hell, I remember clearly so many bars in towns and even just small cities I’ve been in and there is not a single taxi, or anything to call.
      With that out of the way, how could one make it to a hotel without driving, or a ride which could very well not even be possible?

    I heard a story once of a military guy stationed in Montana in the middle of winter getting drunk and sleeping in his car with the car running for heat. So of course he gets arrested for a dui. And his unit is PISSED and gets him out of it. Cause like what was he supposed to do, freeze to death? It’s ridiculous that you can be charged for driving under the influence without ever driving at all

      One time my Dad was coming back from a trip (no drinks at all) and got tired so he pulled into a rest area to take a quick nap before proceeding and the cops ran him off telling him he wasn't allowed to sleep there.

    I remember in driver’s ed the cops told us that if you were drunk and slept in your car, even if you threw your keys onto the front seat, then you’d get a DUI and we all thought that was bullshit.

    I’m from Texas and one time a few years ago I was drinking and cleaning the interior of my car on my driveway. I had the keys in the ignition with the car on for the music and power seats (didn’t want my battery to die). Needless to say, my neighbors called the cops stating that I had the intent to drive while intoxicated. Cop showed up and believed my story especially cause I had all the cleaning supplies out and stuff. He was super cool about it and told me to not do that again because technically speaking, that IS probably cause for an arrest. Be careful out there my fellow Texans.

      Absolutely they were. They weren’t too fond of me for whatever reason. Never spoke to them, but they always had eyes on me. Funny thing is that I was there when the neighborhood was first built, they came way after. I ended up moving out 2 years after they moved in anyway.

      I've heard of ones where they were at a party and were blocking someone in so put the keys in the ignition and put in in neutral and steered while their buddy pushed it out of the way of the driveway and they got busted. Hate the way they stretch the laws. If your engine isn't running and your car is not moving it shouldn't be a DUI.

    Local bar had a system. if you come to drink you parked in a section, hand over the keys to the 'valet' (the bar keep's assitant) and could not have a drink within an hour of leaving. Second the bar had one of the older breathalizers and if you blew remotely near the legal limit you had to stay put or sleep in the backseat of the car with the keys in the bar's safe.
    Many took advantage of sleeping the booze off in a safe location as the bar owner had planned from the beginning.

      @@Leonardo-cs9ij Bar had staff all day and night. Once they were sure you were sober they gave back the keys. So it was a good system with only one incident in ten years I went there because two hours before closing was last call. one hour before closing was the gates to the overnighters got closed and guarded it even had a portapotty so anyone needing to take a leak didn't need to go back into the bar.

    I knew a dude in the Marines that got a DUI when he was sleeping in the back seat of his car. But he had his car turned on for the heat and the cops gave him a DUI. Before other veterans come at me he called no one, was by himself for some reason and we got no word on it until that Monday morning. I also didn't know the guy that well to get the full story.

    This was in my local news 3 days ago: A woman was busted 3 years ago for a DWI. She was drunk but her car was stuck in mud, and the tires were spinning. She fought her DWI conviction and won. The Kansas Supreme Court agreed that the car must be moving for it to be a real DWI. 😅😅
