  • The appointment of judges to the Supreme Court and the high courts has become a major flashpoint between the government and the judiciary. There has been subtle and sometimes not-so-subtle sniping over the issue of the powers of the Supreme court. Days after Vice-President Jagdeep Dhankhar questioned the "basic structure" doctrine - as laid down by the Supreme Court in 1973 - the Chief Justice of India DY Chandrachud said on Saturday it was "like the north star," providing invaluable guidance for the interpretation of the Constitution here - and elsewhere. Then today Law Minister Kiren Rijiju seemed to support the views of a retired high court judge, who said the Supreme Court "hijacked" the Constitution by deciding to appoint judges itself. The law minister commented while sharing a clip of an interview that it is the "voice of a judge" and that the majority of people have similar "sane views".

    Independence of Judiciary should not be compromised at any cost, Judiciary and CJI should never bow down to the government and save Constitution at any cost. Judicial appointments should never be done by government, rather Collegium should be made more transparent and Collegium has worked well for ensuring Judicial Independence.

    No doubt, absolutely. The political parties should be away in the appointment of judges, If that too governed by plitical parties of their choice,then there will be no justice left for common man in this country. So no question of govt intervention, please!

    Only free and independent Judiciary can safeguard freedom of the people against the tyranny of the absolute power of the corrupt government. They say power corrupts and absolute power corrupts absolutely.
    I hope the Judiciary must stand it's ground in this fight with the political executive to protect the freedom and liberty of the citizens 💪

    The constitution says The president shall appoint the Judges after consultation with CJI. But the Supreme court has turned this on its head making it "The Supreme court shall appoint the Judges after consultation with the President".

    I was taught (during my school days) that most contrasting feature between democracy & autocracy is the distribution of (legislative, executive, and judicial) power. So I guess, first we must address to questions like "What if government appoint judges (instead of Supreme Court)?"

    Even for class 3 Government employers during promotion they check up central vigillance reports and employer confidential reports.For appointing judges government should take all formalities.

    In every major democracy after which our constitution is based, it is the elected representatives that appoint judges. This ensures that the judiciary reflects the will of the majority. Only in India do the judges appoint themselves and consider themselves unaccountable to the majority. This would be comical if it were not so ridiculous. The elected govt can and must change this idiotic situation.

    It is the president who shall appoint judges. That means it is an executory decision, neither a legislative nor judiciary.
    Thus It deduces that Supreme court’s power stops with recommendation. Recommendation means that the approver has the authority to drop anyone from the proposed list, though he doesn’t have any authority to include any one not in the list.
    This is the basic structure of our constitution, built upon the tenets of dharma and dharma alone

    Based on the past judgements, the appointment by President is fine. The guide lines should be available and should undergo once in 5 years. Today Gov of a state is appointed by President. The VCs for the universities are done by the Chancellors. The UPSC based will create seat reservation where unfit guys will occupy the powerful posts and the corruption routes will extend there too. Even Gandhi made the direction to Ambedkar to go with financial status based consideration, but Ambedkar hell bent on to caste and religion based system and even today we are getting screwed. Had it been like what Gandhi said, sure by this time, we would have gone multifold improvement. So the law needs revisions once in 5 years. The guidelines may be from politicians for the Collegium to consider / follow, but finally collegium should have the authority to recommend the list to president where presi is as usual select few and appoints them.

    Nobody talks about pending cases in courts. The procedures should be changed using technology and with more courts. Free legal aid should be increased. Many persons are in jail because of this delay. Government and judiciary should sit together and solve this problem. They are getting paid by people money and they're not god. Because of this dadas are acting as judges and solving disputes instead of courts.

    Who should appoint judges is absurd questions of talentless persons ?. India is Independent sovereign welfare democratic Government .the three organs of constitution are subject to recognition and control of constitution. British colonialism judiciary judiciary additional temporary alien rules of laws British colonialism judiciary now collegium system not above sovereignty of government. Which was incorporated temporarily in constitution to overcome hooliganism after Independence dealt with by Supreme Court. It does not mean to continue 75years should have been disincorporated revoked by President of India.
