    What Is DMCA and Copyright?
    DMCA and Copyright strikes are nothing new to the internet or content creation, and CZcams does have better ways to handle copyright and the striking process but Twitch isn’t the problem here, and complaining won’t help so let’s get into what even is copyright strikes and DMCA?
    Well, without digging too deep into the Digital Millennium Copyright Act, it is designed to stop people from broadcasting or using other people's copyright material without the appropriate rights.
    This means you need to play the music that you have the appropriate rights to. Either you’ve purchased a license like some of the platforms we will cover today, or you will use one of the hundreds of royalty-free services also talked about today. And no, CZcams premium, Spotify premium, etc are not a license to broadcast music.
    The style of this video is similar to Alpha Gaming and Gaming Careers in parts. A large influence on this series has come from content creators like Wild4games and Nutty.

      Hey Stream Scheme, maybe this is a bit "late", six months after the video was released, but I wondered about one thing, kinda important, and it surprised me that you didn't mention this in your video. Given that we ONLY play DMCA free music from either of the ones you mentioned (Epidemic Sound, Game Chop, Chillhop, NCS), with credit given, can we play the music on live feed AND on the VOD, or do we STILL have to split the channels? Thanks for any reply, I'll only accept answer from Stream Scheme as gold though.

      Question: what if there is zero monetization in the video/channel? Most channels are for money but if the channel has zero monetization does this still apply?

    Our channel only uses music we've received permission for or a few songs from the CZcams library, and we credit as requested. Having said that, as he said, copyrights can change hands and agreements can expire, or artists can simply change their minds. Unless you have a contract in place, it's all informal and subject to change. Every content creator should learn at least the basics of intellectual property laws. There's plenty of CZcams videos that will get you started.

    I've been a bit worried about my music use. Glad there's a vid about it.
    I use spotify. I have a playlist of "loyalty free" music I've picked out of my fav genre, with artists like NCS and and Hyper Potions. The whole rights stuff confuses me because you usually have to go straight to a label to get that permission and some labels are hard to contact. Like BEC Recordings and Tooth and Nail records. My brother didn't even know how I could contact BEC regarding his bands first album.

    The copyright reason is why I use my own music/music that I was given permission to use, whether it's bands that have publicly said it's okay, or it's music by friends of mine that they have given me permission to use

    I've only gotten muted once so far, and you know what caused it? Playing Disney Dream Light Valley 🤦‍♀️ I guess Micky wasn't too happy, haha.
    But this is very helpful! You break everything down so well! I was very confused when I first read the TOS, then went into Twitch extension and saw some Spotify ones. The one I see a lot is a Spotify widget that shows what song you're playing. I wish Twitch would remove the extension because it's very misleading.

    Every time I find some music that claims to be copyright free on youtube and use it, it imediately gets copyright struck. It's pretty infuriating, so I just dont use music anymore.

    I was surprised Pretzel Rocks wasn't on your list. o: I don't stream often, but I actually really liked that their bot would send messages in chat with credits for each song (on the free plan). It was less for me to worry about and the artists were being credited, which I try to prioritize since I appreciate the music. ^^

      I still get muted. Twitch uses a third party company to scan the VODs for music, and they don't follow any guidelines Twitch has with any agreed partner music programs like Pretzel Rock.
      A simple appeal unmutes the section in question. Never had a problem with any copyright strikes.

    sound track by twitch (beta) is one of the things that has many doing the live music not in vod idea. actually one of their selling points. if you get live muted by harris heller or instrasomething it does split the track and you still get the mute. And basically eljayem says its using music it shouldn't but telling you its ok to do so.

    So many big streamers still think it’s ok to play copyright music but not save it to the VOD… the amount of misinformation that flies around is scary! Thank you for making this video!       I know a lot of Twitch streamers with thousands of viewers that play popular music while streamings. I feel like they should really know that it's safe, why else would they risk to get their account terminated with hundreds of thousands of followers?

      @@patrikmedia Agreed. I do, too. I could name 2 or 3 BIG streamers off the top of my head who play 'popular music' (ie copyrighted) all the time but don't keep videos or don't include them on the VODs if they do. So having watched this, I'm more confused than ever. Oh well.

      DMCA was established by a bunch of dysgenic gargoyle-looking lobbyists. It may be law but it impedes creation of transformative content.
      Any work around to fool the systems should be abused.

    I would caution against NCS.
    I used them and certain songs were muted in my VODs... and because theyre muted you wont know which song is claimed if your songs are randomized

    I streamed with gamechop and chillhop before, and for Twitch those work great. But in uploading my vods to youtube, I've gotten several DMCA notices for those services, because according to YT their music resembles other music too much. Upon listening to what YT flagged and what they compared it with, I must say I agree. Not saying you shouldn't use or anything, just saying you should still be vigilant

    This is what worries me still. I have this Spotify and idk if I can use it when streaming. So, I need clear instructions on that.
    I want to respect every piece of music, I do. But this scares me and most of my streams are all muted and I don't like a silent video streams.

    I *just* started streaming as a musician who plays and sings covers...3 months ago when I was considering streaming at all, I asked a Partner Streamer if this was a fruitless idea because I'd just get banned immediately and he assured me over and over that covers are okay and I of course noticed that every musician streamer I watched does non-original music at least some of the time. Is there any leeway for musical covers or are we SOL too? Like I should quit streaming and only try to produce music FOR other streamers to use?

      There was a royalty free music group on like Newgrounds and I submitted something to it and found it being used in a Halo 3 machinima. Shit was awesome even had me in the credits. Make music that you want someone to hear... someone will hear it!

    Chillhop was pretty easy for me to set up on Twitch cause you can just link your account from their site but tbh I'm stuck on how to actually set up gamechops or ncs on twitch. Do i do this through obs? Do you have a video on this?

      I’m not a fan of sound track by twitch because the music I use in stream is such a integral part of the content, so if it is taken of the VoD it makes a worse experience.

    Another one I'd recommend is ElectroDanceMixes - not all of the mixes they do are copyright free, but they do 1 hour Copyright Free EDM mixes every couple of months. I just pop them into a playlist and I'm set

    I'd like to use my own music but I'm worried about getting hit. CZcams hit me 3 times for it and I had to explain to them each time that it's my music. I think I'll probably end writing some specific music for streaming vs using my released music. Better to be safe that sorry.

    Wasn't someone working on making a plugin that would open the same music you were listening to in its proper source website and the viewer would have it synced via the plugin but it would count as a unique view. allowing you to listen to music, not have it in your stream, yet allow your viewers to listen along with you at the same time? Or am i just crazy?

      I actually wrote the whole video and then I reached out to several of the Music options I used to ask if they wanted to sponsor it and give a free trial, or discount to viewers, because I know paid options are hard for beginners.

    The very opening line of this video: exactly. Why do Spotify and Twitch both have, in their TOS.... words in effect, blocking people from using any music... even something like StreamBeats? I was arguing with people on Reddit (yes, I know), who insist that StreamBeats isn't legally ok, because of Spotify's TOS. What's the real story? Where is legal proof that it's all ok? Am I the only one out here who is completely confused by all this s--t?

    My music channel got suspended for playing copyright FREE music , also had permission from some authors , still got permanent suspended . I didn't get any strike, no vods , I stopped streaming 10 months ago, then I got suspended 10 monts later lol

      Used it back in the day, not bad! I just found having a second paid sub I wasn't using was a bit eh.
      These days it's purely the ones from the video, minus StreamBeats.

    I dont get, for example KuruHS a favorite streamer of mine is listening to spotify all the time. its on his streams and youtube and people can even vote for songs and stuff! How do i do that do i have to pay thousands to creators just to use their music or is he using it so the systems dont pick it up? its just annoying i dont find a answer anywhere

    When he says the live detection is on they mean it 🤣, was doing a test stream to check on quality with music on but sources separated so it didn't go in the vod... nope it got muted even though I know you couldn't hear the music in the vod. Got Epidemic Sounds just to be safe, there really are a ton of awesome tracks on it that perfect for gaming

    I do not understand why it can't be as easy as setting up an extension to cite the title and artist on the stream (which twitch already has) and set it so that viewers can't record the music. we can all listen to music on services and radio, why can't we do it while we are on stream while playing our games.

    I DJ Live on twitch and don't ever publish my VODS. Twitch does mute parts of my videos but it works for me. I haven't gotten a strike yet and been doing it for over a yr.

    Chillpop says that we need to download the songs in advance and credit them by copying links to each song. Is there a way to more easily give credit for livestreams using their music, without pasting 50+ links individually?

    Ironically, some of the music that I got from NCS was copyrighted. In fact, the very first song that shows up when he sorts by Most Popular, Cartoon's On & On, is the track that gets muted.

    I was muted for SINGING a song. The only music I had playing was a mix from the CZcams audio library that was no attribution needed. Literally just SINGING will get your VOD muted.

    Yes ofc it was stupid but my stream got cut for copyright mid stream rather mid House of The Dragon episode. Viewers said a copyright notice popped up and I wasn't able to stream for 2 days(I think).

      usually not. a game is played by millions over the world so people know the music already. you should be safe!

      Depends on the game, ALWAYS check if they have a stream safe option. Many games use copyrighted music and you can get a strike for it playing even though it's in game because you are technically profiting off their art by playing it in your stream.

    Ok i noticed even if i play Free / copyright free music or NCM / No copyright music it still put my past video unpublished. It's to the point they don't care if its copyright free they want no music to be played om anyone's stream.

    Soundtrack by Twitch is pretty good too. Free, intergrates with OBS, and supplied by Twitch themselves.

    I haven't heard about Chillhop or Gamechops getting claimed, but Epidemic and NCS get claims all of the time so I wouldn't use either of them.

    i understand i cant use music during gameplay or in vods. but would i be able to play music from spotify featuring the artists name and title of song during brb intermissions? not to be recorded, not for vods, or to enhance gameplay.     I'm sketched out by any outside music since I got copyright claimed for in-game music.
    Fallouts got a lot of good music but even though its music coming from the game its muted it on many occassions.

    Thank you for the info. Just as a bit of constructive feedback, saying "I'll tell you later in the video" or "I'll show you in a bit" is usually a sure way to make people skip ahead or lose interest. People's attention span's are shorter and shorter and most want instant gratification. This having been said, again, thanks for the info and for the work that you put into making this video!

      Hey, it's actually the opposite.
      It's called "Looping" and it increases retention rate because you're promising they'll learn more later.
      The same reason we add hooks or highlights at the start to get people hooked into the video.
      Peoples attention span is short, so they need to know its worth their time.

      So this isn’t quite true, it IS copyrighted, it’s just that a lot of the labels don’t have the resources to strike you, but actually there are lots of examples of channels getting too big and actually being hit with strikes.

    Is it legal under fair use law to badly sing a song with no background music switching words to make it a parody?
    Like "making my way down town driving fast tryin not to get whip lash... oh they finna kill me.... and now im bleeding out.....
    Me and my friends constantly do pardoy type stuff and I'm wondering if this will get us shut down, haven't posted anything or streamed anything yet still working on setting up all the equipment and little fixes but I'd like to know before we do and just get banned 😅

    I got a Muted VOD playing an old Star wars Game, and I have no Idea why. I think it's because the game uses original Star Wars music. Does that mean I can't play that game on stream anymore?

    But Eljay, I frequently stream Batman Arkham Knight and Mass Effect 2, and always get certain parts of those games muted, most notable the portion after Ivy dies and during the Horizon attack cutscene. It's happened on other games as well, even some where I am unable to turn off the music. So if I should be worried a bit that I get muted as I run a risk of repeating offense. The argument that we don't even have licenses to stream the games in the first place does have a bit of weight and should be discussed between Twitch and record companies. It may and is a problem of copyright holders but Twitch is not entirely innocent and unable to work things out. If they're relying on music detection which has gray areas then they need to make sure there are no gray areas before they try to rely on it. They still push Twitch Soundtrack which is polluted with copyrighted music. I used Epidemic Sound and got a VOD muted once, as have I had the same happen with PretzelRocks and StreamBeats. Yes we should be safe and responsible but its not entirely in our power, and we can't be the only ones making changes, especially when the changes we make still allow the same problems to arise.

      Copyright law is outdated. It doesn't exist to preserve someone's creative works, if that were the case, again, why are we allowed to stream games in the first place? We don't own our phones, PCs, digital movies or games, we rely on licenses and connection to servers. The only damage being done is the loss of potential money, it's corporate greed. I really think Twitch has the power to reform that law with negotiation, which would be a great PR win and a great legacy, to leave that impact on this world, but the problem is I don't think they believe they have that power. I think they're scared, so they bend the knee and keep the problem going instead of actually doing things to benefit the streamers. Of course, Twitch is also a corporation trying desperately to make a profit for the last 8 years or so, so I don't expect them to really start an actual attempt to fix copyright issues, so the whole argument becomes irrelevant. There is no such thing as a safe stream or safe music because safety is an illusion. The moment you choose to go live, you run at least one form of risk. You can do what you can to minimize the risks but safety is never 100% guaranteed, whether you stream a game or use "safe" music.

      I also don't think 1 second should count as one listen. I think the problem is the live service nature. Cable companies remove channels they don't have licenses to anymore, games remove songs when the licenses expire, streaming services remove movies when they no longer have the licenses for them... but I can pop in the DVD of Aladdin and show it to 4 friends, and the companies can, if they wanted to, look at Arabian Nights as 5 shares. But they can't go back and take the song out. I bought Arkham Knight, but I didn't buy the soundtrack which holds certain songs that get detected by Twitch's identification system when they appear in the game, so I get flagged on something you put in and and haven't taken out, but somehow it's my responsibility? If we have to incorporate "stream safe" modes in our games and come up with alternatives like Epidemic Sound, that states that the problem needs to be dealt with rather than skirted around. We're wasting time and it's getting worse.

      The BBC News theme is copyrighted. I didn't buy the license to it but I'm free to hear it every day as I watch the news. At what point does this "muddiness" turn out to really just be bullshit? It's not mud.

      Almost all anime music is heavily copyrighted.
      Remember, EVERYTHING is copyrighted. It’s just whether the owners are issuing strikes and aware, almost all anime music gets striked.
