The one distinctive change which the Modi Government has brought about is the absolute clarity of all the appointed ministers in their respective fields. This is only possible if the head of the government is clear in their mind, unlike the earlier corrupt or self-interested or puppet prime ministers.

It is absolutely correct that judges are regularly criticized even severely in the US. I know it because I have been living in the US since 48 years. This Indian law minister is impressive and has articulated his issues brilliantly. Yet I cringed when he said that I will make sure to take the actions to see that judges are not criticized by the people. This is a new concept alien to the democratic societies, specifically the ones in the west upon which the foundations and the architecture of India's legal system is based on. On one hand the judges of Indian courts sermonize and pontificate constantly about right to freedom of speech and freedom and liberty (even for bail to a highly dangerous criminal), but when it comes to criticizing them for unconstitutional and offending comments they gang up and want to charge the person with contempt of judges and courts. Although Indians have adopted the same legal system as that of the western countries (UK and USA) yet they are confused about what constitutes a contempt of the court. An act of contempt towards the court is only applicable to the disobeying an order of the court to the person involved in a case, not to the whole society and other people who give criticism to a particular judge (or judges). Even a person who is seeking judgement in the court can criticize if it is not an order or directive to do something as per the order issued by the court. For example, if the court says you have the bail but do not try to cause damage to evidence or don't fly out of the country, but the person commits contempt when they violate that order. On the other hand, some other person criticizing the court has not caused contempt to anything. It is a bogus argument that no one can criticize a judge whatsoever. Anyone enjoying the seat of power in India starts thinking of themselves as supreme and unassailable, no matter what. This is exactly the case with Indian judges today.

Solving the existing collegium system will take a lot of time. Starting a parallel “e courts” system with a good “e court” website where respondent and defendant and their lawyers can upload all documents online. Even hearings can be done online. Only if necessary judge can sermon the respondent or despondent to his court in person. This way the number of cases can be cleared faster. As a First step e courts can take care of small cases then they can scale - up over time. E courts can come under the CJI of high courts.
