    What to do when the judge seems biassed against you?
    Before deciding the judge's bias, consider these three questions about their impartiality.
    1.Is the judge really biassed or am I simply dissatisfied with the judgement?
    2. Has my lawyer stated all the facts that I had mentioned or some pertinent details have been left out resulting in the present order / judgement of the judge ?
    3. Do I have anything to back up my apprehensions (conflict in facts, evidence in the final order / judgement ) or is it simply based on assumptions?
    In case, the answer to the questions above are in negative you can approach the appellate court citing valid conflicts in the judgement here are few ways to go about it :-
    A. point out the conflicting fact in the reply / petition / evidence affidavit / cross-examination to that of in the final order / judgement
    B. In case something that is of utmost importance to your case is not mentioned or it is incorrectly mentioned, point that out.
    Be very cautious before stating “the judge is partial” “the judge is sold” etc. Refrain to criticise the judge openly the same could result in :-
    ● Additional damage!
    ● Imposition of cost
    ● Contempt proceedings
    ● Instant dismissal of Appeal
    ● Adverse order / judgement
    Criticise the judgement in a subtle ways here are few examples :-
    Criticise inconsistencies pertaining to facts of the case
    • “The Ld. Judge has proceeded erroneously against the Appellant herein, as the factum X, Y, Z have not been considered. Lack of consideration of the same will cause irreparable damage to the appellant because of A, B, C reasons''
    Criticise inconsistencies pertaining to statute / case law
    • “The Ld. Judge has failed to appreciate X, Y, Z despite the directions of the Apex Court in the ABC case. Furthermore, Section A of ABC act, which states clear addhearce towards PQR, have not been considered resulting in procedural irregularities against the Appellant herein”
    Criticise inconsistencies pertaining to evidence submitted in the case
    • “ The impugned judgement / order failed to capture veracity of evidence PW-1, wherein X, Y, Z was admitted by the Respondent herein.”
    I understand how frustrating it can be, but patience and a thoughtful approach are crucial. Hasty decisions often lead to adverse consequences.

    ...I have tried Indian police, mcd and other govt departments, they r just on another level of corruption, law abiding citizen have no rights in this country of crooks, only the courts r left for me to try, I cant say anything about them 😭😭

      Judiciary is worst by a mile compared to any other govt dept. People think that policemen don't want to file FIR because they are lazy the real reason is corruption and laziness of court. The process itself is a torture even the police has to bribe the peshkars to move their case. Most the time torture is so much that applicant want to do out of court settlement. Policemen want that to happen earlier.

      Some judges have to be above the law or else they will not be able to do their jobs. If every time someone loses the case and appeals in the higher court that the judge is biased then no judge will be able to provide any ruling for fear of the higher court.

    So, basically, judges have undisputed power. Except for the ruling government, no one else can challenge a judge. This is ridiculous.

      Literally even if a ruling govt(central and not state) then also they loose alot of their votes due to nagative perception that they are damaging democracy.
      In india lots of people believes and have faith (blind) more in court. Even though india is democratic nation and we dont elect judges .

    There is proper grievance redressal system if judge is failing in discharge of duties. One should never allow such judges to continue such bad conduct else there won't be any change in the system. File complaint with facts and evidence on record against such erring officers without any delay.

    In Japan, citizens vote every alternate election if the current SC judges should continue office or should be fired.
    In the USA, they have law right to recall District court where citizens remove judges, read Simpson case.
    We the Citizens are above all in a democracy and honesty should be rewarded.

      Citizens can remove judges even in India. Only the ruling government has such power. We vote for the ruling government. A similar thing happens even in foreign countries. The elected members can question and/or remove a judge.

      Plenty of judges have been arrested for corruption charges in India. You cannot just remove anyone without an investigation. Recently ED arrested special court judge Sudhir Parmar for corruption, recently a senior Allahabad high court Judge and his wife were arrested for taking a bribe, there are so many examples.
      Do you even read newspaper? Like seriously??!!!
      Judges are always under the ED and CBI scanner.
      Get yourself educated. Follow current affairs.

    We have recently seen Ramdev case where judges remarks were at same level as street goon, yet Ramdev had to face humiliation and keep pleading for mercy, may God always keep out of this legal nonsense

    Very true you can't point finger on anyone without concrete evidence. If you say judiciary is corrupt then which department is not in India? Where do such corrupt people in different departments come from? They come from this society only. As a society we need reforms, so that the next generation values human life over money. We work with a sole motive of the welfare of the society instead for our own upliftment. Hopefully we can cultivate human values like Japan is famous for.

    Yes, you don't just say things in the court, you show evidence. But, people should not be held in contempt of court just for criticising a judge outside the courtroom, even if that is incorrect.

    Only thing you should not think is Review Petition
    Because If you File Review Petition It has to be in the same court who has given dicission against you .....

    Same rules should be implemented on wife who file a false complaint against husbands, if the wife files a false complaint and she fails to prove her allocations she must be jailed for atleast 6 - 12 months such law needed to be implemented only then false cases against husbands will decrease.

    When every government employee is corrupted then why can’t calling a judge corrupt becomes a crime, just because Kanun Andha hota he, kanun pe ugli uthane wale ke upper ugli ki jati he, so they are biased. Not all but 90% who are not under video surveillance.

    Sometimes bias can be clearly seen in the order sheets itself. And complaint can be made in a private enclosed envelope to Registrar Vigilance of the corresponding High Court.
