- The plaintiff hired the defendant to create custom T-shirts. When the plaintiff received the merchandise, he claims the printing was off and the sizes were wrong, so the plaintiff is suing for a refund. The defendant says the plaintiff wanted the shirts rushed, and the defendant did the best he could under the circumstances. Besides, the defendant told the plaintiff he doesn't give refunds.

I had pens made for my company they were misprinted and the company said keep them and reprinted them as I ordered no extra charge. It’s good business, I was so glad even late for my event, I was still proud of the printing company for making my order correct.
Most companies will do that for future business and it works, it's just good business.

Yeah almost every one of them will do that, but i don't know of any that give refunds, I didn't even think Office Depot does that on custom prints.
The only thing I do not believe that the plaintiff is saying is that the shirts were pre-sold. If they were already paid for by the club members, he could get them redone and give them to the members later. I would think most people would be disappointed not to receive what they paid for at the event, but would be okay with getting what they paid for after. Because it's still a keepsake from that event.

He was supposed to approve Monday but couldnt. Then gets upset when the shop has issues delaying. He broke the contract first by not coming in that Monday. He doesnt go to approve them yet gets upset.
That plaintiff was looking for a quick payday imo. I believe he did his homework on the "no-refund" not being posted and thought he had a sure win. He should've asked for a redo on the order especially when dealing with opm (other people's money).

I do art and photog contracts all the time. If someone wants something within a weeks time to be processed and delivered I don't even bother doing it. Too much rush and hassle

I own a printshop, we always keep communication through text and email. It’s just safe to do so. Some Customer’s expectations are ridiculous.
And sometimes they make mistakes that had nothing to do with us
Especially when dealing with CMYK vs RGB. Colors could look darker or dilluted when printing. You absolutely have to do a printing sample and approve it. Him skipping that step is when I knew shit was hitting the fan

Poor communication coming from the incompetent Plaintiff & the Defendant went to great lengths to accommodate him with the time restrictions that were put in place. And then the Plaintiff lost all credibility when the judge had to call him out for lying about alleged lost pre-sales that of course he had no proof of.
The Plaintiff created his own situation and failed miserably at managing it and he wants the Defendant to pay??! 🐌🐌🙈🙈🙈

Everyone stating the Plaintiff deserves a refund are out of their minds. If that was the case; everyone that made last minute orders or didn’t make the profits they anticipated would demand refunds. Color variations are known issues from the graphic to the transfer and even the colors of the shirt, fabric type/texture. The Plaintiff should have inspected the samples. He approved, sight unseen...that was his bad. He could have knocked the sale price down to recover his cost. I have a feeling his business was refused by other companies because of these shenanigans.
Love t-shirt cases! The wife owns a promotional product company which is mainly busy with screen printing and embrodery. It needs to be in vector format don't have a clue why they are talking about pdfs. Plus where is the art and order approvals...?? These people are amateurs cause they would have serious issues with so many people!! Customers tend to alter the orders multiple times along the way each time will make us inform you they new adjustments and to double check we are all agreeing on what is actually being made! There should never have been a misprint gone out the door, bad screen printing is not paying careful attention to the detail and caring about the end results!
I've used PDF but only when it's converted from SVG file which allows it to retain the color layers. But that was back in the day.

I had a similar experience as a Graphic Designer, but I supplied the files they needed. The issue was that they didn't disclose that they used a third-party to do their silk screens. The shirts arrived, and you could tell they did 2-3 layers cause there were ones where you could tell they weren't aligned. The third-party denied it, but the business noticed it too, and had to pay out of pocket for the mistake.
Plaintiff fault.
I have never had t shirts made with a company that says no refunds. Which most say just that, but there are some with clauses such as if they mess up the item you can receive refund, if the items are not completed by the deadline, refund. Such a rip-off for a company to create shirts that do not look good and can't be worn, to then say you get no money back, you have to allow us to remake them. Even though they botched the first order.
He didn’t provide the right files that would’ve gave his shirts a higher quality. That’s on him. Didn’t even check the shirts when he got them. He should’ve just handed the shirts out for free so people can at least wear them indoors or to work on their motorcycles.
@SRT_DRE they should have never agreed to make the shirts if the image wasn't in PDF. Instead, they gave him a product that isn't wearable and took his $900 something bucks. Most people will accept the No Refunds because it is posted on their counter. Because it wasn't in their receipt or contract they should have had to return the money since the event is over and the shirts are useless.

2. He changed his order. Gave the wrong files and placed the order last minute.
3. If he didn’t provide the shirts, then it’s should be pretty obvious there’s no refund. Why should the company who bought the shirts and worked on them be out of money because of the customers mistakes?
4. It’s a motorcycle club. There WILL be more events.
We didn’t even get to see the shirts. They probably looked alright. He could’ve gave them out to the club for free. No court room would’ve gave him a full refund. He should’ve asked for a partial refund so he could get shirts made elsewhere.
Forget the files the quality of the work was not good so lets say they make more and it's still terrible, how many chances should they get because of the no refund policy?
He botched his own order when he (with all his so-called graphic design experience) couldn't send a proper pdf file) instead of a crappy jpeg file. Besides, he was the one that wanted a last-minute job, and that's what he got. Him and his "pre-sale" orders 😂. Liar.
No refunds?? This was a wrong Verdict JM!!! They didn't wear them. He paid over $900.00 for them. It was for an event for the fire department that was a one time event.
Labor cost. They even used their own materials and machines to make the shirts.
Their contract was NO REFUNDS. She can't change someones contract.

He's on a short timeline and he has to burn time to go back to his Biker Committee for approval? Then he can't make it to look at samples on the agreed upon day. I've done this type of work for 30 years, guy should have turned down the job. Unfortunately, the other companies knew something this poor guy didn't. Never take a job where they say "I should have called you sooner....." I wouldn't have taken this job if I had no jobs at the time.
Not that big of a deal to convert jpeg to pdf???? Ya, if you want the image to be no bigger than a post card, and you like pixilated images.
My parents have had this kind of business for 24 years. THE FILES MATTER! If you want a certain design/logo, have your files ready and make it a priority to get them to whoever’s doing the work! But also, the business needs to pay attention to their work. One bad shirt can screw up a business if you let it leave your facility.

I see these types of customers all the time, they belive they are graphic designers because they have a pc, and want ro make a quick buck,but they actually take chances and dont know the difference between jpeg from picture frame, just say no or charge a go away price. The defendant was excellent she just needs to cover herself a little more.

Exactly! I've been ordering screen printed shirts for 7 years! I've had 2 companies completely. Screw them up. Bad really bad and I did not want to do business with them again. It wasn't a rushed order. They had more than 3 months to make 35 shirts and they still somehow screwed it up. So bad! I did not want to do business with them again. I just wanted my money back and to move on! And I got a refund from both places now. I order from the same place every time. Don't have any issues. Great work always double check everything before they print wonderful company

It’s a motorcycle club, there will be another event. Unless he got kicked out the club because of the shirts. The shop provided the materials and made them. Labor cost. No way he was getting a refund. He should’ve just handed the shirts out at the event and found a new shop to work with.

She says, the plaintiff is a graphic designer. I heavily doubt it given the fact that he didn't know what a PDF or a jpg is and the technical difference. But the defendant's business tactics are also a bit sketchy at best.
The Defendant said the Plaintiff said he was a graphics designer so, that's why they didn't design/charge for graphics. Which is true if you already have a design then you need to provide the file with the appropriate dimensions for transfer. Even when I've provided logo files, I've had to consent & been charged for the company adjusting them for transfer aka graphic design.

The Plaintiff should have been refunded just because of the fact that the company was not professional enough to have the refund policy stated on the paperwork or on the website. That error in judgment should have costed them. If you run a business you gotta have all your ducks in a row, simple as that!

No. If you plan on selling shirts at an event, you should expect different sizes of ppl to be at that event.
Of course you would buy a lot of M, L, XL. Those are common sizes. Many ppl fit into these sizes How many ppl would be 3XL? Not many. So you buy a few. It's an expectation, not presold shirts.
If you have a business, you would know your local clientele. Let's say the area you live in, a lot of the ppl there love spicy food due to culture. If you are selling plain lays chips and spicy Takis, which one would you order more of?
And it's obvious the plaintiff was expected to sell those shirts. if they were already presold, some of the shirts could've been decent enough for customers to take.

So I think the point of came in a little greedy, but I don't believe that the defendants had that sign saying no. Refunds in their office. It's not on the website to set on the contract. It's not any emails. It's not on the estimate, it's literally nowhere except in the office. So what happens if somebody orders online? Never goes into the office and has everything shipped. Never sees the no refund policy. They still don't get a refund. I just don't believe that also I Have screen printed probably 6 or 7 times over the last 7 years for my husband's business. And I have had 2 instances where the shirts were The shirts were a mess I did get A. Refund from both places. So I don't know why she says it's common knowledge. That screen printers don't refund? That's just not true, if you have 3 months to make 35. T-shirts. And you can't make sure that they're done the right way, then I don't want to use you again. My orders were never rushed. I always ordered them months and months in advance. They clearly just don't have any knowledge or skill in what they're doing

If the botched the order he sould get a refund. He paid for them to make something and they messed up. I wouldn't want to keep doing business with someone who doesn't communicate or make it right.

WHAT? BAD JUDGEMENT! The judge always goes on about 'time is of the essence' the plaintiff told them the deadline and they botched the order in more ways than one, the defendants breached the contract so I really don't understand why he wasn't given a full refund, it's not like he simply changed his mind, he didn't get what he ordered and it wasn't done within the deadline. So why should they now be given a second chance, now that the event is over, and who says they will do a better job anyway. The judge even tells the plaintiff that the T-shirts were obviously NOT pre-ordered so therefore knows that having them printed AFTER the event, is of no use to anyone...
They have no proof that sign has been up longer than the minute it took to take their picture. I agree he should have been refunded the $900
