  • A Denver man is suing a tow operator he says wrongfully took his car from Charlie's on Colfax three weeks ago.

    He stated that he thought somebody stole his car. He was right somebody did steal his car. This should have been a criminal matter not a civil matter. Because they own a tow truck shouldn't give them a right to steal your property or your money legally

      That is exactly the problem with law enforcement's rationale. If all that is needed to make a tow lawful is that a tow company came and did it, then that amounts to a declaration of open season on vehicle owners and drivers with no criminal consequences for the tow operators so long as it is that type of theft. It is a strong incentive, certainly in the tow operator's best interest, to steal as many vehicles as possible regardless of any supposed cause for doing so. At the least, even if the vehicle has to be returned, they still get the fee.

    Towing companies are shady as hell. To say they don't tow vehicles that shouldn't be towed is a bold faced lie.

    California corrected this predatory practice years ago. Now, a responsible person, manager, or property owner must sign the tow yards impound invoice, and the tow operator must contact PD with the plate of the car they are towing. Then they must wait an hour after the request for impound before hooking it up. Blanket towing patrol contracts with businesses, allowing the tow company to indiscriminately patrol parking lots and make their own decision what to tow, were also outlawed.
    This is the type of legislation EVERY state should adopt.

      @@lightworker303 Also, in California it is written into the law that if a vehicle is towed illegally, and proven in civil court, the judgment would be twice the cost of the towing, storage, and admin fees. It keeps reputable companies honest. Not so much for towing bandits, as we called them. Colorado should look at the time delay aspect. (The exception the 1 hour is if the offender is parked in a single family home's driveway.

      @@Towman728 Police don't patrol for handicap/fire lane parkers and have no jurisdiction to have cars towed from private property like that.
      99% of people that get towed, have doing something wrong. If this guy didn't then he is a small minority. There are tons of restrictions and guidelines the public utilities commissions sets on tow companies. They even enforce and fine you if you don't have proper signage and or amount of signs. I don't think anyone really has any idea how much the PUC actually does to regulate the industry here.

    One time my stolen trailer was recover by the police and the police called the towing company to tow it away from the crime scene. so the next day the towing company call me to tell me the "good news". But when i get there they ask me to pay them $450 for towing fee and storage fee of 1 day.... The trailer isn't even worth that much. what a bunch of crooks.

      They did the same thing to my brother's mini-truck. Police had it towed, so me and
      my dad went to get it out. It was there for maybe a week, and they wanted $500 to
      release it. My dad had the money in his pocket, and we looked at the truck and it was
      almost destroyed. It was stripped down, no radio, no parts, no way. My dad was
      incredulous at the whole scenario. The lot dude just wanted the bucks to get that heap
      out of his business. I looked at my dad and told him the $500 he had in his pocket was
      worth more than the truck. To the lot dude's disappointment, my dad agreed. We walked
      out w/o the truck. My dad got him that truck for three grand, and my brother just ran it
      into the ground, living in the damn thing. Scratch off lotto tickets laid about the inside,
      while in the back, in the tailgate section, empty women's purses were strewn about,
      making me wonder what this dude was doing. I'm sure someone else has seen what I
      witnessed as well. It really sucks when dealing with someone who can't see the light.
      When the only light they see is at the end of a pipe.

    Report the car stolen, the Police will check if it is the database as towed, if yes contact an attorney immediately. Their mistake is your windfall, harm and damages could be $10,000's. Its criminal and a civil case.

    This just happened to me for expired tags, because the tags were returned to the post office. Long story, but dealing with the HOA & and the Tow yard ended up too much drama

    Wyatt's towed my vehicle, which had a parking permit, while I was at our client's property. They said they read the permit, but the engine was cold. Really. I was out almost $400. DOGS. THEIVES. Luckily, my employer had to cover the costs, and then bill our client. I don't respond to thieves the way most people do. You still my truck, I can't go to work. I lose Everything. You are my enemy.

    Who is rightfully enforcing the tow companies? On every tow a police investigation should be done in order to verify the tow-in is legal and documentation. In this case cops claim it is a civil matter but the car was stolen and stealing is criminal. The owner countered claims the towing claims against him. The subject towing bill is a laugh. Expired plate should have never been a reason, towing is not law enforcers. Non consensual tows means the tower stole the vehicle, and no fee can be required and not being able to afford the cost is not related. Who the heck is A.G.?

      The owner of the Apartments goes by the place maybe once every other 3 months. And if they see a car or vehicle they don't like, as in if it's not 100% perfect and makes their feelings get hurt, they tow it off the lot until they come back again in 3 months.

      @@shimxininahi8024 apartment complexes do not need HOAs because you are signing a lease in in the agreement they will specify what the property management does.
      That's how leases work

      I remember I got towed and my car was in visitor parking and I called the next day to the apartment building and they said that if I'm going to park in visitor parking I need a visitor pass but I've always park there without a visitor pass they said oh it started a week ago mind you this is my friends Apartments and they didn't even know about it I toldthem that they should have signs up there stating that they need a visitor pass in visitor parking fck them!!

      @@Honkers716 The city fines apartment complexes for having unregistered, inoperable, immobile, flat tire vehicles on their property so they must comply.
      The city will even ticket you in your own driveway if your car is not in compliance I've found out.

    This happened to me in Denver a few months ago. My car was towed from in front of my house. Had the police called at the tow place as well and they wouldn't do anything. I had to pay 350 to get my car back. Enough is enough with this bullshit

    They get away with it and if our law makers don't do anything to protect us citizens then they are a part of the problem. Make these companies accountable. Make it a criminal offense. I was towed once from my apartment building, I had my parking sticker visible but the tow driver said that he was too short to see it, then he said "I have a family that I have to take care of"...so essentially he was stealing my vehicle for money.

    I rented a truck at Home Depot and they towed my car . I’m a customer with a 24 hour contract. All sign says is unauthorized vehicles. I plan to file a small claim . He’s right talking to toe company a brick wall

    They did the same to me. I was going to work, and my car was gone. I called the police,
    and they told me it was impounded. I found out my apartment manager had ties to a
    local impound lot, so I put 2 and 2 together. I was pissed off, because one, my tags were
    legal, and two, I missed work. I was born in December, but someone took the one off of
    my tags to give them extra time on their own car, or truck. But both the manager, and
    tow trucker both missed the expired December at the bottom of the tag. I call the impound
    lot and told them they stole my car, impossible they say, so i tell them to check my tag more,
    telling them my tags were good for another ten months. She comes back a few minutes later,
    and tells me I'm right. Bring my car back that you stole, and she says she can't. Your tow truck
    took it, and he can bring it back. She kept saying she couldn't. So I had to call someone I knew
    to pick me up, and drive the 30 miles to the impound lot to get my car out. I should have, and
    could have sued the manager who had the ties to the impound lot. I'm sure she was getting a
    cut from the money she was providing the impound lot. But all I got was a month's rent free.
    Oh, and by the way, this crooked manager tried to make it up by sending me a move out fee later
    after I moved out of the complex. I just laughed and threw the letter away. What a dishonest
    way to run a business. The complex sucked. They didn't even have jumper cables to help start a
    battery. The maintenance man was banging on my door asking me if I had jumper cables. I ask
    him didn't the manager provide that for him? He said no, so I told him he needed a new manager
    to work for. She was so unorganized to say the least.

      I would call it grand theft auto. Call a lawyer, or if you can't sue
      them, get a month's free rent. The complex, and towing company
      scratch each other's back, or should I say profit off your wallet.
      It is very costly to get one's car out of impoundment. They wanted
      over $150 from me, until they found out what they did, then they
      kissed my a##. I never got one apology from either one of them.
      The manager avoided me like the covid crisis. She was rude when
      I moved, never looking me in the eyes, and just giving one word
      responses. Once she found my address, she sends a move out fee.
      There was no fee in my rental agreement, and I still want to confront
      her about that, but she will only toss me off the premises, or call law
      enforcement, so I consider it not worth it, especially the likes of her.
      Good luck with your situation! My girl would have cried her eyes out
      if they did that to her. Some places warn you if they will tow your car.
      They did that to me where I moved to my next apartment. At least my
      car never disappeared on me, plus the complex was gated. Still, the
      complex can give those drivers the code to get in, so be careful, and know what is going on.

    I would go after Charlie's as well they are responsible for allowing elite towing to take this man's vehicle so they are complacent in the theft of an automobile and it all charges should go on to them and when they start losing customers because of it it's on them

    The tow company booted my car this morning without any notice, even though I have a parking permit and parked in my designated spot. I've tried contacting them by phone and email, but haven't received a response. They are demanding more than $300 to release the boot. This situation seems suspicious, possibly a scam protected by legal documents.

    This happened to me at JFK airport Ny.I went to drop off my kids and just got out of my car and went to say goodbye inside for five minutes and my car was gone .😢

    And if you don't Jane that cash on hand to get your car out that day then they add on $75-150 everyday it's left there so if you have to wait a week to get another paycheck that's the $350 + another $525-1,050 on top of that initial $350 depending on the tow yards fee, and at that point you can never get your vehicle back and then they take ownership and sell it.
    I've had something like this happen to me in Texas and down there your average wage is around $8 an hour so your fucked.

    When I park anywhere first thing I look is TOW signs!
    I've been driving for 35 yrs I've never been towed not once.
    I dont park in a place where I know Iam purposly parked wrongfully. Let me break it down for Rule breakers that do it then cry when they have to Pay Up.
    I dont park by a fire hydrant
    I dont double park , I park correctly not hogg one side making hard for the next car to squeeze in
    I don't park in Handicap and " run in quickly"
    I sure don't park in a apt complex in SOMEONE else spot who they paid for that spot and say " well ppl do it all the time so why can't I" yeah thoes ppl
    I dont park in a apt complex in a NON visitor section when I am a visitor
    I don't park in spaces that belong to another business ( has tow signs) and use thoes spots when I go to a completely diff business.
    Oh, News and City dont forget to show all thoes Rule breakers running after their cars when they are getting towed..Cause chances are u don't see non rules breakers running after their cars no they are sound asleep no worries cause they comply...
    But yes, there can be a mistake but out of 20 ppl all 20.are crying doubt. They get busted they didn't want to follow rules and they get busted and don't want to pay up just like they didn't want to flow rules..
    Predator tow companies the complaint is always about , what about lying ppl who lie cry as if they are truthful especially when constantly breaking rules at apt complex they choose to live at!!

    There has to be more to the story. Normally, the restaurant/bar calls the tow company vice the tow company just coming around towing cars. My hunch is that it was a busy night with no parking. Someone called the tow company claiming they work at the bar and said that "X" car is parked illegally. Car gets towed and there you have it, free parking space.

      @@douglei4413 I don't think Tow Companies really care what was on the caller id. Just listening to the video, you can tell the Tow Company really doesn't care what kind of evidence you have. i.e. "Sue Us!"

      Shouldn't matter tow companies Shouldn't be aloud to touch a car if the owner didn't give them permission .I don't care where it's parked.
