      The secrecy order prevents the grant of the patent. Presumably the new application would also get slapped with a secrecy order. They can't use the older invention as prior art if it wasn't published.

      @@route2070 I haven't the foggiest. We used to have a program where everyone in the core was supposed to flag cases they thought might be problematic. Our bosses would determine if it should be sent off for special review. We got rid of it maybe 5 years ago because we wasted tons of manhours and only a few per year would actually get secreted. I'm not sure the current process, but I know a lot of them are patents that the military file. If it looks like its about to be a well known thing (if the cat can't be put back in the bag) they lift the order, we grant the patent and they can monetize it for the remainder of the term.

    It's a really obnoxious part of the law. I was hurt working for the Navy, was fired because of it, and now they won't tell me or my doctors what exactly I worked with.
    So my advice: if you're smart, or heck if you're not, stay away from the defense industry. Because if things go wrong, they'll Kafka you to hell.

    Actually, I know this one nuclear engineer... Whenever he and his team file a patent, they make sure that it's similar enough to sue for patent infringement but different enought that it won't actually work. Apparently this has stopped chinese knockoffs at least once.

      According to patent law this won't work
      For a patent to be valid it needs to fulfill it's stated use
      What you can do is describe a subpar product or describe the core part without mentioning a supporting part

    If I had reasonable suspicion that my invention would get hit with a secrecy order. I would file for the patent, scrutinizing it so there was no errors. Then tell everyone about the invention while the patents going through. Ensure as much people know about it as possible. It's still protected under patent law.

    I feel like accountability would be improved if the name/purpose of the invention was still required to be public. Maybe censor the inventor so they're not at risk of being kidnapped, but knowing that someone patented the design of a certain weapon doesn't tell you how to make it. It also doesn't mean it's gonna be in the US arsenal. Your invention doesn't have to be functional to be patented, you just have to be first. For all we know "classified weapon" could explode on use.

      It is a requirement of a patent to enable the invention to be put into effect, so yes it does tell you how to make it.

      Not the way patents work. They exclude using things. If you made a patent for something that actually worked, you might not get use of it because you needed the first patent, but the first patent holder would be excluded from making your design that actually worked.

    All classified information automatically declassifies after 25 years, with the exception of nuclear information and data granted a special exception. The exceptions are generally for things like a report that would reveal the identity of a spy that is still living, which could risk their safety. Even in those cases, the information can often be released after being redacted.

      Why do I get lots of information on nuclear stuff? Some stuff I think Is really unusual information to be public like that weird non repeating crystal that was formed when the first nuke was detonated .. and the effects of drinking heavy water on the circadian rhythm. Maybe it's cause I've met a few people from the atomic energy commission they are weird like men in Black weird.

      @@IAMschizoaffective The Department of Energy controls the classification of nuclear information. The stuff that's classified is almost entirely about nuclear materials refinement and constructing nuclear weapons, because the goal is to prevent the proliferation of nuclear weaponry. A lot of it is not classified, just export-controlled. For example, we might readily share some information about refinement to friendly nations so they can use it for nuclear power.
      Of course, the US is also not the only source of some of this information. Plenty of countries have figured out what they need to know independently. Some of them may publish it openly. And then, information gets leaked from both the US and other countries. But if you ask someone with a clearance whether or not it's accurate, they'll simply say that they can neither confirm nor deny its accuracy (or say "I don't know", which is probably true).

      Then the person gets a secret infringement order and has to pay a secret fine to a secret court. Of course alot of times they'll give the person automatic debt forgiveness since the billing address is also secret.

    Patents don't exclusively refer to manufacturing processes. They can also refer to finished products. The start of this video indicates otherwise (in error).

    What would happen if you applied for a patent on your invention, without knowing it is already patented, because the patent was secret? They can't grant you the patent, because it is already patented, but they can't tell you they're rejecting it either, because they would need to reveal the existence of the secret patent.

    So generally speaking, one of the main reasons to patent an idea is so you can show the idea to potential investors and have a reasonable expectation that you can protect yourself from the theft of your intellectual property. That's the main reason for my patents, anyway. I'd be pretty angry if I went through the trouble and expense to get a patent on something only to be told by the government that I've got the patent but I can't show my idea to anyone. I understand that the intent is to protect weapons secrets so other governments can't benefit from the research done on things like the Manhattan Project (there were patents involved), but i don't think it's okay to trust the government to tell me that my solar panels can't be produced because I can't show potential investors how they work.

    There's an easy work-around for inventors: Simply publish the details of your invention before applying for the patent. Inventors are allowed to publicly discuss an idea for a year prior to getting the patent, and in doing so there would be no point to try and classify the patent after the fact.

      @@thumperhunts6250 US Patent law (not sure about other countries). The idea being that it might take scientists a year after publishing or presenting new research to make a patentable idea out of it.

    If you cut a half hexagonal shape into a steel I rod and put it on top so that you make hexagons you almost double its carry capacity!

    My First Patent
    "Thingy"
    This is my cool gun I made it out of metal and plastic and plutonium it is not a regular gun with foam fins on it. First you make a regular gun then you take the bullets out and pour in your untonium and your powder. Next you wrap it in tinfoil and bake it at 350 degrees for 25 minutes. The you put a toothpick in and ifmetal comes off on it you know it's not done yet so bake it for another 5minutes as needed. They make your roux. Combine water eggs and coffee o make the perfect roux and then mike that together in a blender.
    then u give it to your nextdoor neighbour to put in his chest freezer for two weeks becaus it's just betterthan a regular one. Then it wil be cooked so at that point t's timefor the egg wash. After mixing together 4 eegs you cn start to brush it on the metal. Bake it again at 40 for 40 minutes, and you shouldt that pointbe able to attach the fins which will make it shoot better.
    The fins are mad of carbon fiber andfabricated in my studio here in new mexico, and canno be made in a on-sterile environment due to their cool shape.
