It always amazes me how much brands end up hurting their reputation by trying to protect their brand.
It's also quite amazing that people that do this for a living for many years still make dumb mistakes like this one 😑
@@stefan514 I think its *because* theyve been doing it for many years tbh. They're stuck in old ways and don't have any idea how to navigate in the modern landscape but refuse to hand power over to people who are more in touch (which tend to be younger)

I sure hope other large companies aren't doing awful things like this!
"A big company scamming??"
What a surprise!
While this company is garbage af, not wanting their logo on shit that is not affiliated to them is completely understandable. That’s a textbook copyright case. CZcamsrs are so entitled just using everything they find on the internet for their own profit and when they get striked for it they mobilize millions of fans that have 0 clue about rights and laws
@@ssigeon it's not questionable. You can't just plaster a real companys official logo on your things and then make money from it.
There's a reason why movie producers don't fill their movies up with everyday brands, because it's not legal to do so. It could seriously hurt the brand of a company if marvel for example shows the big bad mass murdere guy to drinking starbucks.
Remember when it comes to copyright you actually have to change it before you can use it. You can't just copy paste.
Guinness just going for the record of “most copyright strikes given out”
Nintendo, UMG, WMG and SME: Are you challenging us?
Billy Mitchell: um, no thatd be me
I had to get rid of like 20 videos because of this 😭
The thing with Guinness in 2020 was that they started hosting some speedrun world record videos on their channel, with permission. As soon as my video went up- it was horribly edited and had tons of other issues but that's a different story- then their auto copyright claiming system started claiming hundreds if not thousands of Super Mario Bros. speedruns because they were similar to a video they now had on their channel.
It was also the weekend so they didn't see it right away. Once they did they actually handled it pretty well. That being said they are a horrible, low quality, meaningless company and don't actually care about competition or skill or integrity at all.
Unfortunate that they essentially have a monopoly on a section of culture that they hardly seem to care about
wow
Karljobst made a video about that
1:28 did you get a refund on that $50? Do they clearly state they no longer do video game entries on their website? That seems like the bigger scam to me; how many $10, $20, or $50 application fees have they taken just to tell people "nah we don't do that"?
Oh I'm sure they have plenty in their terms and conditions that says "no refunds and we have no fucking obligation to do anything."
@@gregothy9190Sure, but those terms & conditions aren’t necessarily enforceable either depending on the situation. Same with those waivers you sign when doing certain activities stating that a place is “not liable” if you injure yourself, etc. It’s always case by case but don’t assume those documents are infallible.. places will just have people sign documents like that to act as a chilling effect to convince people that litigation would be futile and to cover their asses partially… those sorts of documents (signed or not) do not protect them from negligence, fraudulent sales practices, etc.
@@gregothy9190You pay 50$ for a premium, for them to look at your record and get a answer faster then if you send the free one
why would he? He paid 50$ for a premium, he could have done it for free but paid 50$ for the premium
@Malbert. he didn't. He had to wait the normal six months like everyone else
It's weird to think about how Guinness World Records started as a barbook made by Guinness (the beer company) to settle drunk arguments. One would think that one of the world's biggest beercompanies could afford to payroll a sub-company like Guinness World Record, but I don't even know if they're owned by Guinness anymore
I agree when it comes to the small online submit a video type records. But when we're talking an adjudicator i don't see why GWR should flip that bill because you want an official there instead of just doing it the other way like everybody else.
I mean we're talking plane tickets, hotel room, food, salaries, renting a car, etc. etc. eveytime someone wants an official judge there.
Its kinda like Michelin Stars in a way, yk what i mean with that right
The thing that happened to Kosmic is actually an interesting story and there's a lot more to it. After Kosmic got the first 18 minute time in Super Mario Bros. Warpless, Guiness reached out to him to do a video for their channel. They basically did a bare-bones interview and then just uploaded his run unedited. A while later they decided to do content ID takedowns with that video, which claimed Kosmic's original video as well as a bunch of other SMB1 speedrun related videos. I personally got hit with 27 claims, all I had to dispute. It was a really fucked up situation. I know Karl Jobst made a great video about that story, but I think he took it down because of the Guiness stuff happenening recently. Anyway after that situation and watching that Karl Jobst video I personally believe Guiness World Records to be a scam and pay-to-win.
Also when I broke the Warpless world record shortly after Kosmic they didn't reach out to me at all so I too have personal beef with them :P
They dont even fact check their records half the time! Billy Michel's records should NOT have been posted in the book bc there was NO confirmation of them and thats not the only time theyve done that, they are a scam company where you have to pay them to get into their shitty little book, which isnt that good its cool but i want detailed articles about the records and stuff not short blurbs

they need to just end the 3 strike system entirely. if a channel is getting multiple strikes then a real ass human being can come and verify whats going on.
At 2 strikes in a row, at least, someone should review it manually for false strikes
@TaiAngel01 yeah, the more I hear the more I realise they are FAR too loose about strikes. They're supposed to be an extreme last resort, but because big companies have lots of money and no morals they can and do just strike people willy-nilly without so much as a warning.
i've had beef with guinness since they uploaded the video of giving the person who could do the most turns. they turned it into a match between a man and woman, both professional ballet dancers. but then the guy didn't do the correct turns (one of the hardest technical turns) and won because he did an easier type while the woman did it correctly

I don’t think Guinness is quite obsolete yet, but their track records and the continual innovations of the internet are starting to drag them down to a point where it seems they only have bad decisions to make, which is sad because I also have fond memories of buying one of their books at a scholastic fair.
Fred never disappoints to keep me updated with the current news
JINKIES!
I also took down my world record videos. I thought okay lets make it official then with guinessbook records so I don’t have to take it down. First I needed to pay a fee and then it got declined for “not having a category” this company is a joke🤡
How is this barely liked
^ bots (except first comment, that ones normal)
I think there is a really lucrative opportunity for a sort of rival to Guinness World Record, like another company that tracks and posts world records. Not only because they're a shitty corporation but because there are just an unenumerable amount of categories they don't really deal with that a rival could really get into. Just my two cents.
Yeah, that would actually a good timing to start a business regarding archiving world records with a website along with it.
“Scholastic Bookfair”?
“The guy with the really long nails”?
Holy shit you just took me back to a simpler time 😩
peoples world records are like "I stood the longest outside in Antarctica while holding 7 oranges and an Iphone in my hands facing east, 5 seconds because nobody ever thought to do that specific thing"
Guinness is no longer a record keeping agency, they're a PR firm.
tbh getting copyright strikes because you don't own the logo of something is like basically the most common form of copyright and trademarks lol. A lot of companies usually don't act on it but you have to be really careful when including logos in things because yeah they're in their full right to act against it.
I remember ALL the kids in my elementary school would legit fist fight over these books when we went to the library. If you managed to get the newest edition you usually had a crowd of kids who wanted to be your friend.

They arent a world record holding company they are a novelty book store where you pay to get you "record" on there
Basically if you want Guiness WR just pay a glorified bribe.
A standard fee for a service is not a "bribe"
You must be so confused when it's time to pay the exterminator 🙄🤦♂️
@stephenmason9527 nah, you can pay them to find a record for you to break as company and then you can do that and advertise with it for 2 years. So yeah half their business is now marketing
@@stephenmason9527 no its a bribe if they don't take normal world records but only those from the people that pay them.
@@stephenmason9527 well seeing how you can basically go "well I paid more so they'll pay more attention to my submission" that doesn't seem like a service fee, otherwise the fee would be the same for everyone and not get priority because you paid 2 thousand dollars instead of 100.
Thats just a corporative bribe to me
@@alexanderxyz9572 absolutely none of this could be described as a "bribe" 🙄🤦♂️
You love to see Glugwig use his journalism degree. Lovely entertainment.
As Ludwig touches on, the records really went into territory that was just dumb and gimmicky, rather than interesting feats - A Guinness World Record should be based on something like the field having a prior following or interest, rather than "I watched Ludwig's latest mogul mail the fastest" and because I bought my way in I can claim it as a world record.
Side note - I thought Neil was someone playing SF6 lmao
It's trying to set its own record: Most copyright strikes in one day .
It makes sense when you think about it. That logo is essentially their only asset as a company. It's reasonable that they would want to protect its usage.
It only makes sense if you don't think about it...
Their claim against the logo would be under trademark/fraud, not copywrite. The strikes don't make sense.
@@uniquename6925 First of all, you don't know how to spell "copyright" so I take it you aren't an expert. Secondly, they have both the trademark and copyright to the logo so are free to make a claim. Thirdly, your point here is that they should be suing for trademark infringement which is much worse than a copyright strike. Do you really think these creators deserve a harsher punishment than they already received?
Funnily enough, that exact png is on Wikipedia, meaning it's Creative Commons licensed or they truly are just picking on CZcamsrs.
@@talkssometimes They are choosing to act against people who are misusing their property in a way that threatens the integrity of their products, which is entirely reasonable. That said, Wikipedia claims the image is ineligible for copyright but likely hasn't been challenged on it so that neither proves or disproves their ownership.

It’s not good enough anymore to have a stable business that makes a profit with a quality service or product(s). You must always be growing, expanding, merging, buying the competition, cutting costs, adding subscriptions, monetizing everything, and raising the stock price.

Hey Lud, does performing right click along the top of chrome -> undo closed tab happen to work? If so it might be another program (or extension) intercepting the Ctrl-Shift-T input but idk what your setup is 🤷
I remember going to a convention when I was a kid, where we could all try and break various records. I remember i set a record on how far from my back i could extend my shoulder blades, kinda like a cat when they walk, i know its freaky. That’s pretty unfortunate. My family has given me for Christmas the Guinness book every year since 1999. It’s a tradition at this point. Such a bummer hearing how this actually works now.
I'm glad Fred Jones gives his two cents on this situation.
RE: ctrl-shift-T, not completely sure how to fix it, but you can right click next to the minimize button on chrome and select "restore closed tab". (Also check if you have a "Fn" or function key that likes to get toggled on and off, that might've been toggled on by mistake and is kinda common on smaller keyboards o:
Darcy's acting of the mic guard was phenomenal 👏🏼
They should have at least made a public announcement ahead of time and say "het, we will be copyrighting anyone using our logo, u have a week to get it sorted, past that time u will receive a copyright"
I never really liked Guiness World Records and glad to see they are still giving me reasons to dislike them by going straight for strikes without reaching out about it.
He’s gone full Fred, I fear
what's funny is the record he chose to be like "you could hold a world record tomorrow if you wanted" (the standing on one leg blindfolded one) is actually an incredibly difficult thing to do. if you've never tried it, stand on one leg and close your eyes. it's amazing how quickly you lose balance when you can focus your eyes on an object/horizon

i'm in the guiness world record book, i forget what year. i was in girl guides (canadian girl scouts) and while i was at summer camp we all broke a guiness world record for worlds longest friendship bracelet
Neat
Oh boy, Mogul is back to deliver us the mail
3:11 incorrect, the claim is because the super Mario bros world record became a Guinness world record at that time and Guinness uploaded it on their channel which ended up copyrighting hundreds of Mario runs because of how similar they look to the content Id system.
Someone buy Mogul Mail an orange ascot, let him complete his Fred Jones cosplay
Glad to see that company getting more and more criticism and their practices exposed. First I learned of this from hbomberguys excellent video on the roblox oof. Then a german tv show reported on how they work with regimes, including deleting inconvenient negative records about a former dictator when his son wanted to get elected too. They even posed as north korean officials/government PR to try to get records like "most corrupt country" deleted, and were not outright rejected
The ctrl-shift-T could be a problem from a chrome extension that interferes with the command or just a skill issue
Just know about this pisses me off even more about my interaction with Guinness World Records. I am a photographer and a few years ago I photographed quite an interesting wildlife interaction. I also had a video that accompanied it that went slightly viral and eventually someone at Guinness World Records contacted me and they have an interest in using my photo in one of their upcoming books. They wanted to use it for free basically. They would not give me a cent for the use of my photo in a book that was going to have several thousand copies produced. I’m a no-name photographer, but as photographers have to really put our foot down when situations like these occur and say no because we don’t want to set a precedent that our work can be used for free. Just hearing that they make millions of dollars off of other things and they can’t pay photographers what they’re rightly owed for the use of their photos in their books just makes me so mad now.
When I was a kid Guiness World Records was a paper back book with no pictures... it was thick like a bible lol...

noooo Ludwig is no longer a ventriloquist
Honestly, you should just make your own "world Record" style of content.
It feels like its just way to risky to ever use a companies logo in a thumbnail under the current state of CZcams.
also it's not legal if the logo and branding is infact copyrighted. Doing a fortnite video saying you broke a record and then putting their logo on the thumbnail without the permission of the rights holder isn't covered by fair use because it's not "Research and study", "review and criticism", or "parody or satire".
The reason is obvious. Companies don't want their branding used in videos that might hurt said branding. Imagine if in inglorious bastards the nazis were drinking starbucks without the permission of starbucks, that could hurt their brand.
guinness origin story was already sus being an alcohol company
Some men are to ashamed to be a "minuteman" but Lud wants his recognition as even faster

Change it to Jiness to avoid your comment being deleted. Quick.
Honestly think anything thats been onsite for atleast 2+ years with no issue should be exempt from copyright claims ot atleast strikes
You can't really blame a company for not wanting people to use their logo. Most companies will have their logos copyrighted and have strict rules about people not being able to use their logo without their permission. The problem is that if people see a brands logo being used then they may think that the video is affiliated with that brand and could cause harm to the company in question.
Someone should let Tommy Tallarico know about this. His records could not be legitimate, which would not make his mother very proud.
I think its absurd but what can you do, just wait until they start requiring subscriptions to maintain a world record. It kinda throws the validity of their records out the window since its no longer a this is the best someone can do in the world but instead the best someone can do that can afford to pay us to watch them do it, if it was cheap it wouldn't be that big of a deal but 12k-500k is nuts, you could afford to get a much more valuable piece of paper then a world record like a degree from a respected college for 500k.
