  • Dustin has been absent in the child's life for almost one year. Dustin decides he wants to be in the child's life but says he cannot afford to pay child support so instead chooses to cover daycare for the child. Sarah is now seeking child support and for Dustin to continue paying daycare. Will the court grant her request?

It's Texas law that's messed. If the judge had lowered it, mom could have appealed. Dad messed up by offering paying that much. Even in other states, I've seen judges go with what the parents have already been doing even it it's more than what the calculations show. It's dumb; however, it that's what they've been paying without issue, that's what the judge goes with.

This is where her experience in the court comes into play
As I watched this i saw the same thing I’ve seen in court while waiting for my own case to come up
Many of the dads make choices to keep their income low and make claims of poverty but can find the money for fun things. Things like vacations, dates, the bar, gym memberships, new cars.
But then claim being broke and can’t pay for the kids.
He looks to be in his 40s. He can afford to go out but can’t afford his life or any kids?
Something doesn’t add up. It just feels off.
But besides that point. He set a status quo. Legally she can ask for that to be maintained and for him to pay for his portion of the kids.
Just because she had paid while he was uncooperative doesn’t mean it was comfortable for her either. They didn’t go into it but she may have been struggling as well and needs help so she can house and feed the kid they made.
She can’t be on the hook for most of it because he makes poor financial choices. All of that is extraneous to parenting responsibilities.

Texas law. That's what happened. Texas likes to screw fathers in court. Had he not agreed to that amount she would've only gotten the $355 because otherwise she has to prove that he can afford it. Which she can't given the cost of living. The court would've had no way to do that. But because he was bamboozled by this woman into paying that and has been for a bit that means the courts can say "You're making it work so continue to pay." What gets me is that she had the audacity to make him pay health insurance. She should've said that's too much hardship. Now because he has to pay that he will probably not be able to eat or pay rent. That will lead to him going homeless at which point he will take it to court and claim hardship. Whatever judge he gets will review Judge Vonda's judgment and tell her that she was being biased. You heard what she said. She said she had the DISCRETION to assign higher benefits. That means it's her choice. She didn't have to do that. She did that because he's the father. A lot of judges are in favor of mothers. Usually Judge Vonda is pretty good at being fair towards fathers but maybe she had a case that disturbed her right before. I think this one needs to be reviewed. If I were the father, I'd appeal the decision.

The problem is they made a deal, he covers day care, she forgoes CS from him. If it was them splitting expenses, CS being part of that, the judge could have adjusted that based on his pay. He is volunteering to pay the higher FIXED amount of day care to not be in child support, VARIABLE. Since he is self employed, this may have been wise, even if he is filing taxes and actually only making that much, having that fixed expense and her having agreed to it, she can't keep coming back month after month saying he makes more, make him pay more and him have all that hassle and a accountant proving he did only make that much. Sometimes its worth paying more to avoid hassle. I agree that 1/2 your pay is too much, but he volunteered that and a court can't order you to un-volunteer and force you to pay less.

I actually feel sorry for the dude. He paid more than he should have, and because of it he's gonna live in a shared appartement until his retirement and beyond. I know it's the law and all but.... If I was a father I would understand this as: give the bare minimum at all times or you might get screwed over later.

I disagree with that because if his income by the set standards say he is suppose to pay a lesser amount, then he should have to only pay that with the insurance expense added.

    • @trekgirl65
      @trekgirl65 Před 5 lety

Check with Texas law, that is the law the Judge is upholding. It is fair and just to both parties. He has limited income and is paying for the daycare, same amount as it would be for Child support for one child. You can't have everything.

      Startrek1965,
If you listened the, so called judge, she stated that his child support would be around $380.00 a month based on his income of $24,000.00 a year. But because he was already paying $855.00 for daycare that he should continue doing that! What the, so called, judge did wrong was adding the $113.00 for medical insurance. If you would read other comments, the so called, judge reply’s to some comments! Vonda B is not a real judge, she’s a lawyer who works with people who hire her to get the other parent to pay more money to her clients.

This mother is literally negotiating this man access to his child based on what he pays. Girl take him paying daycare and shut up. I’m so confused if he would only be paying $340 then why his he paying $855 and healthcare. If I was him I’d be like no legally I only have to pay child support and health insurance and I believe it’s only half of health insurance. I do not agree with this ruling at all

I got really weird vibes from this entire case. Laying out a year and then stepping up makes it seem like he waited to get a favorable tax return. If he does only make 24k, then the ruling was practically criminal. The lady seemed greedy in that case. He would need to bring a suit for joint custody and get the support removed. That might be better for the kid anyway. The nice thing is the daycare bills will go down as the child gets older.

Very unfair ruling by the judge, him paying $855 should be voluntary, the court has no right to force him to pay 50% of his income. The man can't even afford housing for himself.
I can't believe she even ADDED more expenses to his already too high payments. This judge got it awfully wrong.

This was the 2nd video I watched about this judge have no idea how even the 1st one got on my recomended but I know I will not watch any more since I find her ruling to be really bad or just how easy to abuse the laws in the US are and how BAD they are towards fathers or even in more particular the male portion of the population .
