'Super Drunk' Sheriff Tries to Avoid Arrest; "I'm a F**** Constitutional Officer!"

    At approximately 4:00 pm on November 16, 2018 Kalkaska Sheriff's Deputy Ashley VanSloten was dispatched to a location on M-66 just south of Lund Road in Garfield Township, Michigan, after multiple calls were received reporting a vehicle stopped on the side of the road with an unresponsive male slumped over the steering wheel.
    VanSloten handled the call and ultimately arrested Midland County Sheriff Scott Stephenson, who blew a .233 on a preliminary breathalyzer test. Despite his easily having met the requirements of Michigan's "super drunk" statute - a real thing, coming into play at .17 - Stephenson tried every trick in the book to avoid jail: begging and pleading, cursing, speaking gibberish, suggesting the destruction and falsification of records, and imploring friends in high places to intervene on his behalf.
    Ultimately, however, the sheriff's pleas fell on [mostly] deaf ears, and Stephenson was arrested and booked into jail for operating a vehicle while impaired.
    As former Kalkaska County Sheriff Jerry Cannon says in this video, "It's not like the old days." That is, of course, incredibly true given what is happening right now in your life. You have the opportunity to literally replay this incident as you draw your own conclusions about it. Your court is now in session, and it's not like the old days. Which is a good thing.

    Shout out to Chris Little for bringing this story to my attention.
    When Chris emailed me and let me know about Stephenson's arrest the story had already been covered by a number of news media outlets, all of whom had published two to seven minutes of body worn camera footage. I generally don't cover stories that have already been published elsewhere, and with that backdrop this video almost didn't happen.
    When I watched the available body cam footage, however, I noticed a lot of gaps in the time stamps. Working under the assumption that additional non-exempt footage existed, I started tangling with the Kalkaska County Sheriff's Office over the records. After two months of - frankly - obstruction, I recently received hours of exclusive additional material. The highlights from that content are in the video above.

      Except he's probably given DUI's to people 3x less intoxicated than he was. Probably has assumed someone was "high" if they didn't blow over and still arrested them even if they weren't. Trying to get out of driving with a .233 makes it all the worse.

      Yupp. It used to make me feel good to watch these videos, as if we were finally getting to a point of true equality of law enforcement and civilians. That’s until I realized that they still get more leeway and grace than any of us ever will, and that all the excuses they use are the same ones the criminals they claim to be above use when in trouble.

      He's an elected official as Sheriff. It's up to the constituents in his county if they want to remove him. Some had a recall petition, but it's up to a vote from the community.

These cops even gave you a bunch of time to vent, to grasp the situation, and took care of your car so you didn't have to pay for a tow.       For what he does, and who he has to deal with.....he should deserve a little latitude. Where that stops is subject to debate. But he was too drunk....... He should know when to have a sip or two. But he's way past that. If it's his first issue ever....give him a break. If this is common for him. Move him out with some penance to pay.       And basically every one holding a high up position is guilty of this at some point.

    We had a sheriff in our town who almost everyday drove to work drunk unfortunately he was also a school liaison officer as well. After he got criminally charged everybody was so grateful because he had such a bad attitude because he was drunk all the time. This guy trying to get out of a DWI with a .233 sleeping on the side of the road the officer couldn't wake him up, disgusting and a disgrace to the uniform

    What an awkward position he put that officer in. No one is above the law and despite all her apologies, I appreciate he was still arrested.     This jackass had already been given too much leniency, but when I heard that, I immediately saw red.
    More proof that they cover shit up for each other, but us regular citizens would have already been cuffed and at the station being booked.

      It’s not like the old days refers to cops giving people that are drunk a ride home. They would do it for everyone not just cops. As long as they didn’t wreck, cause damage etc. they would just take them home. I’m not disagreeing with what you said just that the meaning of “like the old days” is a bit different.

      @@bullriderchick22 everything is different now. I remember having my parents call the store and telling them to sell me smokes booze and lotto tickets. They would cash them in for you no big deal. I know this is different but our society wasn't as controlled like it is now. Cops are used to make money by writing tickets and finding violations and dwi is a huge moneymaker for the law and the police and the beautiful thing is that the person who drove drunk can't say 💩 cause he shouldn't have been drunk driving in the first place. I feel cops who drink and drive and get caught should play the game like everyone else.

It's like, we all KNEW this happened (and probably still happens even with body cams) but to hear it outright is literally the most maddening thing I've heard when it comes to drunk driving. I know they've gotten away with even worse things too in the past than drunk driving but oh boy I am livid.

But in this case I 100% feel like it's due to the recent body cam laws that were passed so there's absolutely no way out of it. Also, giving a ride to a *slightly* buzzed person is much different than offering a ride to someone who blows a .233. It's literally amazing that he didn't kill anyone on that little one-way highway. He's a sheriff to boot, so absolutely knows better than to get that inebriated and drive. He is blackout drunk. Not buzzed, not tipsy, not drunk. Pure inebriation and I'm sure the friend who got cut off at the end was about to say, "At least you didn't kill anybody." The sheriff who arrested him saved someone's life that day, even though his career may be ruined it's better than ruining an entire family's life by killing one of their loved ones. Then you'd really lose your job and you'd never be able to sleep again on top of it.

    My husband is a Stockton,CA police officer. One night while on patrol he pulled over one of his best friends who was also a police officer.
    It broke his heart
    But this guy was driving off duty and blew a .024
    I We know his wife and his 3 children
    Heartbreaking

      Now if only she could stop incessantly apologizing to the drunk driver for inconveniencing him. For every thing this officer does "by the book", she sure does offer the drunk driver a lot of compassion and apologies.
      Something tells me her holding the BAC reading in view of the camera doesn't mean jack. If the camera weren't required by law this guy would have been helped home by these officers as though he were a little old lady.

      That’s also called building rapport. During interrogations with people who’ve killed other people, sometimes the interrogator will use techniques like complimenting them or saying they “don’t think they are a bad person”. It disarms them into being comfortable with divulging more information. I’m this case, it keeps the situation from being hostile or “defensive” in any way.

    I work for EMS as a dispatcher and driver. And I know we’re all human and make mistakes, but this is NOT okay! I’m so glad that everything called on the phone lines and radio is all recorded and stored. Hope he learns his lesson. He’s literally begging. I watch a lot of these dui body-cam videos and it seems like most of them just end up getting dismissed or lowered to something much lesser. I’m starting to wonder why cops even arrest people anymore when the courts end up just dismissing it all. Some of them are 2nd or more DUI offenses with resisting, battery on LEO, fleeing & alluding, all sorts of things and they end up with maybe a reckless driving misdemeanor charge?! The whole court system is infuriating! If I was having to arrest the same people over and over again and none of the charges were actually prosecuted I would lose my sh*t. The cops know a lot of these civilian offenders by first name because they’ve arrested them so many times!
      This guy deserves to be locked up and the key lost though. “I don’t wanna put you in a bad place honey” and then proceeds to keep putting her in a bad place and disrespecting her by calling her honey. If he just owned up to it I might be able to think he made a mistake and should be able to try to redeem himself and not completely ruin his life but he should know better and then he tried to tank everyone else’s careers to save his own?!     As a professional truck driver I am held to a higher standard than a normal citizen. The legal limit for me is half that of everyone else and having a bad day would not get me out of this situation. And having a DUI would end my career but that would not get me any leniency. As a law officer he should know better and should absolutely be held accountable to the highest extent permissible by law!

      Id have called the county Coroner. The one person in the county in a lot of places that has the legal authority to arrest the actual elected Sheriff for non-federal crimes. In other places, the state Attorney General or agents thereof can arrest the actual elected Sheriff for breaking state laws ie: State Police/State Investigative Agency, ie: SBI(State Bureau of Investigation)a state's version of the FBI, Texas Rangers, Georgia Bureau of Investigation and the like

    (In response to many replies) If you choose to enforce the law as a profession you should be held to a higher standard than the general public. And to beg for a break knowing everything was recorded, putting his fellow officers careers in jeopardy was absolutely pathetic. I do not feel sorry for this man, nor should you. He's lucky he didn't kill someone.

    As a a retail worker, 39 year old guy, Ive got got way more lectured when I forgot to turn on my headlights and got pulled over a few weeks ago. I was leaving work in a very lit area. I apologized to the officer but almost got a ticket, first time offender… so to speak, never had a ticket before! This mofo is being treated like royalty!

    They need to implement a new corruption/blackmail/bribery law for any politicians, law enforcement or related parties who threaten or ask for special treatment in these situations. Body cams are one thing but deterrents are another.

      Tbf the stigma that officers dont arrest drunk officers back in the day before body cameras is sorta skewed. the real truth is back in the day officers didn't take drunk driving seriously all around at least according to my grandfather, it was common for an officer to escort you home drunk.

      Wasn't even equal. He still got the preferential treatment. They gave him the dignity of not cuffing him. Started advising him of who to talk to about minimizing his charges I think before they shut off their body cam and he went to a hospital instead of jail. They didnt even tow his car.

      If you watch enough of these videos you'll see it actually happens a lot where a police officer responds to something absurd or heinous with "I understand your side" or "I can respect that", even with plain civilians. It's just part of de-escalation and/or building a common ground. This can make the person more cooperative and potentially get them to say things that could be helpful or incriminating.
      I very strongly doubt the woman actually had any respect or sympathy for the officer who was passed out drunk on the road groveling like a child. You could hear frustration in her voice when she replied "I have bad days all the time", implying that's no excuse for what he did.
      She's (most likely) just being professional and doing her job well. Being blunt about things and speaking your thoughts is almost always counterproductive and unprofessional in a criminal investigation.
