The issue is that Band 3 base salary (£22,816) no longer meets the criteria for sponsorship which states that to get a health and care visa, you need to earn a salary of at least £23,200.
However, if your job is in or around London, you can get an allowance (HCAS) that can be added to the salary. Also, if you have worked previously as a support worker/activities assistant, you can request your employer to consider you joining on the second pay step that is £24,300.

@@AloysiusOshiotse You need to speak to the employing NHS trust about the reason why they are not willing to sponsor your application. It might be due to funding shortages in the ward/trust as COS funding requires directors approval in some cases.
If they communicate that it’s due to the salary thresholds, then the solution you mentioned might work.
I say this as I have seen several adverts clearly stating that the ward/trust is not willing to sponsor applications because of funding shortages.

What I'll advise you is to take the job and apply for PSW. Convince your line manager/director to sponsor you for a band 3 role while working there which is easier as you are already within the NHS and known to the ward/hospital.
An other alternative is to secure sponsorship in private home care/nursing homes which is tougher given the changes for salary thresholds.

Most NHS Trust, if not all, have the license to sponsor foreign workers but not all NHS Trust would want to sponsor a job role at a particular time.
It depends on many factors eg whether they have the fund or find someone who doesn’t need sponsorship for the role.
Just go for the interview and pass it. When you have passed it then ask them for sponsorship and if they are sponsoring the role, they would let you know.
An employer might like you so much that they want to sponsor you.
Never take your foot off the job market until you get sponsorship.

This just happened to me today. The job advert stated sponsorship, got the job. I even asked them during the interview, they said there’s sponsorship. Only for them to say the Band 3 NHS role doesn’t meet the required salary threshold for starters and they asked if I wanted to continue without COS. Iv told them to change the occupational code if that would work.

      Oh dear!
That is the situation right now.
NHS HCA Band 3 step 1 doesn’t meet the salary threshold of £23,200. The problem is that HCA has one of the lowest salary threshold of all the occupational codes.
If one has more experience, I believe that they can be employed in NHS HCA Band 3 but top steps as those steps meet the salary threshold.

Thank you for your video. Just thought to share my experience around the same topic. I got interviewed and was successful for a clinical support worker and admin support band 3 role with a certain nhs trust on Thursday and i was sent a conditional offer, shortly after accepting the offer, the HR sent an email to say the role is not eligible for sponsorship since new entrances into the trust start at the bottom of the band, which is £22816 per annum and its below the £23200 required for visa sponsorship. I had applied for the position in January before these changes came into place and am already in the UK. Im getting confused when the info on the website says that those already on the route are exempt from the new salary thresholds, what does it mean exactly? The hiring managers are saying they have escalated the matter internally to see how best this can be resolved. At this moment all i can do is hope for the best.

    • @cynthiaacademy
      @cynthiaacademy  Před 2 měsíci +1

Thank you so much for sharing this.
It is well-detailed and gives more insight to this dilemma.
When they said those already on the route are exempted, I guess what they mean is that those who already have a Health and Care visa with a care worker role but want to switch employers.
When the government talks about those who are already on the route they are referring to those who submitted their visa application before March 11th 2024.
The period you applied for a job, attend an interview or get a CoS doesn’t matter to the government when it relates to this matter.
Even when the government stated that those on route are exempted, they have also started that the old salary requirement has to be adjusted due to inflation.
There are so many people going through what you stated, I pray that the NHS Trusts makes some adjustments to the salary for HCA band 3 STEP 1 so that many can get visa sponsorship.
All the best! Please let me know how it goes. Never let your foot off the job market.

I am not an immigration advisor.
I will only state my opinion here.
If the interview you had is from an NHS Trust and you want to bring or stay with dependents, I would suggest that you go with the NHS Trust because it is likely to have the code 6131 which will allow you to bring and stay with dependents.
The nursing home is likely to be 6135 or 6136 and this occupation codes will not allow you to bring or stay with dependents.
If I were you, I would accept the offer and follow it up with an email that clearly states that I am happy to work with them and would take up the sponsorship after 2 months. Any response to this email will “lock in” the promise of sponsorship after 2 months as evidence.
Remember that I don’t know you entire immigration situation and this suggestion should be based on when your visa is expiring, whether you have dependents, your career plans and other factors.
      All the best.

I forgot to add that you should confirm that the job code for the HCA is 6131 though I am yet to see a CoS for HCA band 3 in NHS that is 6135 and 6136.
I don’t know the codes for all NHS Trusts. I am guessing that all of them will be 6131 because all the ones I saw and asked about are 6131.
By the way, congratulations on excelling in your interview.
      Cheers!
