      Competency evaluation.

    Not holding him in contempt was a huge mistake. He should have been held until his hearing on July 1st. Not holding a narcissistic sovereign citizen in custody for contempt of court enables all of them.😖

    The burden of proof regarding jurisdiction is not on the court to prove it It is on the defendant to DISPROVE it.

      I just wish more judges would say: "This is a criminal case. The crime is alleged to have occurred in . The Constitution of confers on this court jurisdiction over crimes committed in . Should you be found guilty, you are welcome to appeal the court's decision of jurisdiction and present evidence that this court does not have jurisdiction." I have seen Judge Gauthier do this. Shuts them up and makes no doubt that the burden of proof is on them.

It's like they think there's some secret code being spoken that they've managed to crack open, and now they just have to say the magic incantations in the right order. Like "understand" isn't just an everyday word that literally means comprehend, with "understand" simply being derived from English's older germanic based vocabulary, and "comprehend" being the Latin based vocabulary synonym. Nope, there has to be secret meaning! I do not stand-under your authority! lol

      It actually starts with the prosecutor needing to prove jurisdiction first, but yes, when alleged, the defendant then needs to disprove it

      @@LeXXeL_50 While it is true that the prosecutor does technically have the initial burden, that's almost always met by way of the charging document. It alleges the crime (subject matter) and the location (territorial) against the person (personal). Since that creates a prima facia assumption of jurisdiction, any defect in that is for the defendant to provide and prove.
      For the record, I'm aware that you probably already know this and this wasn't intended to rebut you or anything, just provide more information to others reading this.

      Eh, while I think he deserved contempt remand for his conduct in here, as far as him potentially missing the court date, you can't jump to that conclusion just based on his idiotic bravado. He *might* (not likely) still come in for two reasons. First, even most sovcits realize that they *will* get arrested for a FTA and don't actually have the ability to dismiss the case on their own. Second, it'll give him another opportunity to vomit his script and make himself feel superior and more intelligent than everyone in the room, especially if he has friends who join him so he has an audience. In any case, being arrested for a failure to appear requires you to fail to appear first. Can't be arresting people for pre-crime.

    I can't decide if he'll skip his next date because he doesn't think the court has jurisdiction, or if he'll show up specifically to argue it pointlessly yet again. This man definitely needs some jail time to recalibrate his attitude.

    First of all addressing a judge by their name should have been his first warning his second warning should have been a contempt the third time he had to be told he should have just been thrown up in the jail. I don't know and understand why the sov-cits think this crap works I really do not the only jurisdiction they need to know is it's never worked before and jail.

    This judge is way too lenient with this defendant...when I practiced law in texas our judges were in control of courtroom proceedings and people.

      I think she did well by ignoring most of it. She should have warned him about calling her by her first name, though. My favorite was him threatening to "charge" the bailiff with assault and battery. So, the court system only works when he wants it to.
