The Narcotic Drugs and Psychotropic Substances Act (NDPS) is an Indian law that was enacted in 1985 to regulate the use, possession, manufacture, and distribution of narcotic drugs and psychotropic substances. The act aims to prevent the abuse of drugs, to provide rehabilitation to addicts, and to combat drug trafficking and related crimes.
Under the NDPS Act, possession, manufacture, and sale of narcotic drugs and psychotropic substances are strictly regulated, and severe penalties are imposed for non-compliance. The NDPS Act provides for stringent punishment for offences related to the violation of its provisions. Punishment can range from imprisonment for a term of six months to 20 years or even life imprisonment in some cases, along with a fine. The severity of the punishment depends on the quantity of the drug involved, the nature of the offence, and the criminal record of the offender.
The NDPS Act also provides for the forfeiture of any property used in the commission of an offence under the act. Additionally, the act provides for the establishment of special courts to deal with NDPS cases and the appointment of special public prosecutors to handle these cases.
