    "SEC. 7. Priorities. - The DAR, in coordination with the Presidential Agrarian Reform Council (PARC) shall plan and program the final acquisition and distribution of all remaining unacquired and undistributed agricultural lands from the effectivity of this Act until June 30, 2014.”
    “Section 21. Section 63 of Republic Act No. 6657, as amended, is hereby further amended to read as follows:
    "SEC. 63. Funding Source. -
    Provided, finally, That after the completion of the land acquisition and distribution component of the CARP, the yearly appropriation shall be allocated fully to support services, agrarian justice delivery and operational requirements of the DAR and the other CARP implementing agencies."
    Section 30. Resolution of Case. - Any case and/or proceeding involving the implementation of the provisions of Republic Act No. 6657, as amended, which may remain pending on June 30, 2014 shall be allowed to proceed to its finality and be executed even beyond such date.

    “The acquisition and distribution of agricultural lands under CARP shall be completed by June 30, 2014. However, the process of acquisition and distribution for landholdings which were issued with Notices of Coverage (NOCs) on or before June 30, 2014 shall continue even after June 30,2014 until the said lands have been awarded to qualified beneficiaries.”
    IRR
    1. Within thirty (30) calendar days from receipt of NOC or from its date of publication, the LO has:
    1.1 The right to choose a retention area not exceeding five (5) hectares pursuant to Section 6 of R.A. No. 6657, as amended; and
    1.2 The privilege to nominate child/ren who may qualify as preferred beneficiary/ies.
    The landowner is likewise given the same thirty (30)-day prescribed period from receipt or date of publication of NOC, whichever is applicable, within which to protest coverage. Upon receipt of the protest of coverage by DAR, the LO is given another thirty (30) days to substantiate his/her protest and/or application for exemption or exclusion from CARP coverage. Failure to comply within the aforementioned 30-day reglementary periods shall be construed as a waiver or abandonment of the right to protest and/or to file for an application for exemption or exclusion from CARP coverage.

    6. For landholdings under compulsory acquisition (CA), the landowner shall choose his retained area within thirty (30) days from receipt of Notice of Coverage (NOC) or date of publication of NOC.
    Failure to exercise the right to choose within the prescribed period shall constitute a waiver thereof. In which case the DAR, through the MARO, shall automatically choose for the landowner his/her retention area.
    For landholdings under voluntary offer to sell (VOS), the landowner shall exercise his right of retention simultaneously at the time of the offer for sale of the subject landholding.

    Section 4. The State shall, by law, undertake an agrarian reform program founded on the right of farmers and regular farmworkers who are landless, to own directly or collectively the lands they till or, in the case of other farmworkers, to receive a just share of the fruits thereof. To this end, the State shall encourage and undertake the just distribution of all agricultural lands, subject to such priorities and reasonable retention limits as the Congress may prescribe, taking into account ecological, developmental, or equity considerations, and subject to the payment of just compensation. In determining retention limits, the State shall respect the right of small landowners. The State shall further provide incentives for voluntary land-sharing.“

    Atty. Gud eve po. Ask kulang po bakit may mga lupa na lagpas 5 hectares dito sa amin sa Negros. Mga hacienda peru hindi na cover ng CARP peru yung sa amin is na 12 hectares lng ay na e cover nang DAR. Ang sabi nila atty. Is exempted raw yung mga hacienda and lands belonging to corporations. Tama po ba ito atty.

Good day po ang nanay namin po ay tenant yong kanyang lupa VOS po ini award po sa kanya 3hecs. 2002 pa po ngayon nagbabayad po kmi sa land bank ang kaso ang 1hec. lng po ang my record doon nagtaka po kmi ksi ang 2 hecs.wla pong record sa land bnk may ibinigay sa nanay ko na title 2hec pero sa anak ng may ari hindi namin alam na hindi pala senurender sa DAR ng may ari ang titulo original ngayon ang sabi sa amin ng DAR hindi na daw napasok sa data base ksi tapos n po ang program ng CARP.     Hello, Atty. Yuung lupa po ng lolo and lola ko is naka VOS. After ning mamatay, yung Certificate of Land Owership Award is nasa tito ko po (anak ni lolo at lola). Pero nung namatay na yung tito ko, kinuha ng kanyang asawa yung CLOA. Ngayon po ay pinapaalis nila kami sa lupa at may ibedensya din ako na benenta nya ung CLOA. Ano po pwedi kong gawin?

    Gandang umaga po mag sasaka po ako sa isang sasakahan sence 1972.ibenenta na 2006. Ang ng benta po ay kapatid ng tunay na may ari.na may power of atty. Po mula sa may ari.binigyan po alo ng kapirason lupa bilang kapaalit ng pag voluntary surrender. Kaoatid ko. Ang nakabili.gusto bawiin ang bigay sa akin may kasunduan kmi galin sa agrarian.puede po ba yon. Salamat po.

    Good day! Sana po ay mapansin. My father and I are farming in a land for more than decades as tenant till he died just this year 2022. Until today, hindi pa din pa naaward ang lupa sa amin. And currently d na po namin alam kung sino ang registered land owner. And with some rumors naibenta na daw po to other person. Question ko po is possible po kaya na ito ay under na ng carp at hindi lang naaasikaso ng DAR? How could we know kung under na sya ng CARP since it seems some of the authorities are in silence? And, saan po namin pwedeng makita mga list ng mga land owners na nabigyan na ng Notice of acquisition thru CARP?

      Many ways. The usual is leasing. They just lease from many owners. Another is having dummy corporations to have 5 has each. And another is land conversion to something that's not agricultural, which is the usual for subdivisions. More often than not, like in some haciendas, DAR is just not doing their job.

    Hello po attorney.magtanong ako tungkol sa new agrarian emancipation act.ano po ito?kasali po ba wala ng bayaran na amortization ang bagong o member pa lang ng agrarian reform beneficiary na nakalist ang pangalan kahit dindi pa nakatanggap ng CLOA kasi for validation pa nitong April 27 2023.

    Atty. Good day! Is RA 6657 applicable to privately owned agricultural land less than 1 hectare? After more than 10 years of failing to give the 'saka' and allowing illegal settlers in my agricultural lot, is the tenant eligible for any compensation once I sold my land?

    Thanks for very informative videos Matt anong Lang po ako about sa land transfer na matagal ng na award sa tatay ko since 1980 pa pero di nila na tapos I process Until now nasa min pa ang land transfer and until kami parin ang tenant, may point is under land transfer my parent shall pay 30 % of the produce for 15 years now is over 40 years na po may maadvise ba kayo what todo to legalised the land transfer !?

    Hello po Atty., tanong lang po. Kung lumampas ng 5 hectares ang agri land mo at hindi ka pa nabigyan ng NOC up to present, may chance pa bang ma-cover yan ng CARP in the future and pwede ko bang mabenta ang excess sa 5 hectares? Thanks po

      Yung bibili ang mamomroblema jan pag itratransfer na sa kanya yung lupa kasi need ng DAR clearance.

      @@aKenheartPero di ba po DAR clearance is needed sa Registry of Deeds sa pag process ng sale ng agricultural property? Hindi lang yan problema ng buyer kundi ng seller kasi hihingi ng aggregate lang holdings ng seller at makikitang sobra sa 5 hectares at sasabihin na hindi ka pwede magbenta ng excess kasi dapat ipasok yan sa CARP?

      @@vstations Yup problema nga ng seller at buyer yan pag excess 5 hectars . kaya ang ginagawa ng iba ay idinodonate sa mismo nilang kamaganak and the rest 5 hectars and below will be sold to other na hindi pa naawardan ng lupa under carp or wala pa talagang agri land. Or kung di naman apurahan yang pagbenta di hintayin nalang natin na maisabatas yung house bill 9955 ni Cong Salceda na nagtataas ng retention limit to 24 hectars.

      @@aKenheart Wow, hindi po ako aware na meron pala ng House Bill 9955... Pero di ba po meron pa nung House Bill 5507 na para atang phase 2 ng CARP and keeping that 5 hectare limit? So parang labanan na yan ng opposing house bills na ito kung alin ang magiging batas?

      @@vstations Yup ganyan nga po ang mangyayari kung maisabatas yang HB9955. Base kase sa isang pagaaral, although natutugunan ng CARP ang pagnanais ng gobyerno na mapagkalooban ng lupang sakahan ang mg Pilipinong walang sariling lupa, nagsasanhi naman ito ng pagbaba ng produksiyon sa ating agrikultura.

    Hello Attorney, halimbawa po sa mother title dalawa ang beneficiaries pero kinalaunan sinubdivide ang title. Ang bilang po ba ng 10 years sa CLOA ay magsisimula kung kelan naaward ang mother title?
