They are treated differently from adults and are dealt with by youth courts, given different sentences, sent to special secure centres for young people. Kyle if given a custodial sentence is likely to have a few years in juvie, then let out as aposed to Cain possibly spending the rest of his life behind bars there is a chance Kyle's actions could be viewed as self-defence, Al was strangling and near killing Cain. Kyle was in the barn and couldn't know how Al would respond to his presence

She doesn't give a toss about him being locked up or sent down for 30 odd years, just as long as he keeps his mouth shut.
