New York's highest court overturns Harvey Weinstein verdict

  • The New York State Court of Appeals ruled Thursday that disgraced former media mogul Harvey Weinstein did not receive a fair trial in a 2020 case in which he was found guilty of sexually assaulting two women. In a 4-3 decision, the appeals court determined that the judge in the case "erroneously" admitted testimony from women whose claims were not part of the charges.     Jericka is awesome. She is a true journalist who know neutrality. This is a great overturning, just like Cosby. In this country, you can't cheat to win when it comes to a man's freedom being on the line. Thank you, Arthur.

    Hold strong girls!!! I know how hard rape cases are to prosecute, and have been victimized myself, so I know how important this is! The holding was that he did not get a fair trial. And if you believe in gender neutral laws I hope that you can see this ruling as that. New York has a rape shield law, where prior acts of the victim (i.e. being "easy") are not admissible on the grounds that consenting to sex before does not have any bearing on consenting to sex in the alleged rape. New York is merely applying this shield law in a gender neutral fashion, and equally to defendants as well as victims. In other words, just because he raped before does not necessarily mean he raped THIS time. I know that the me too movement was not just about one rape - it was about his career full of bad behavior. It was a topic of conversation in the industry long before the story breaking. But the way the law works, rapes are prosecuted one at a time.
    As for the court's ruling based upon legal strategy, in this way it was novel as that strategy was an accepted and viable strategy at the time the case was tried, so I don't think we should really see it as an error of strategy. The court is merely announcing, today, that said strategy is an error. The challenge for the prosecution in the retrial will be to figure out what strategy is viable. Despite what is written above, it is a well known and statistically supported fact that the majority of rapes are committed by repeat offenders that get away with it because of this crime has the highest dark figure of all crimes in the US by miles. So, in reality, the fact that a perpetrator has previously raped DOES make it more likely that the present instance was in fact a rape, in a general sense, that may or may not apply to this particular offender. So.... how to deal with that? One strategy is to call Weinstein to the stand and ask HIM to comment on all the other accusers (in a way that doesn't violate rape shield laws).
