    Children should be heard. While they may be manipulated, the evaluation is not based on isolation. Just because there is a particular system in USA doesn't mean that it works everywhere. Societies are different and so is upbringing. People from the USA have this wrong notion that they know best.

    I am female in the UK and I have been trapped in the family court system for years minimum £25,000 legal fees. My ex partner took the child in the UK and the system is so corrupted, the child never has come back to his mum. I have cancer now so it to late.

    But with this comes many safeguarding loopholes. Would you assume 50/50 custody if there was domestic or child abuse? Would you take 50/50 if one parent was in organised crime or illegal activity? Sometimes, the child’s voice does need to be taken into account. Sometimes, 50/50 is not the best solution for the child.

      Agreed! It also shouldnt just be 9/10 mom gets custody through. There needs to be a proper system

      It should be the starting point though. If a parent wants 50% custody then they onus should be on the other parent to demonstrate why this would not be appropriate.

      Man u ppl make no sense. You really think if there is child abuse going on that they wouldn't tell their other parent who would voice it to the court to investigate? If 1 parent is a criminal then obviously she's not referring to ppl like that when talking about 50/50. That also will get brought up by the other parent and the child likely won't know a damn thing about it unless they're older. This lady isn't talking about special circumstances where 1 parent is a criminal. She's talking about normal situations where both parents are at least decent ppl that want to see their kids.

    It always amazes me that Americans go abroad and just assume they have the same rights as they do at home. To get married and have a baby overseas without consulting a lawyer is completely irresponsible. Now that poor baby has to grow up without its mother.

      Man you ppl need to learn to comprehend words better. She's talking about the UK nowhere else and she thought it would be more progressive than it is. That's all, she didn't expect the UK to really still be in the stone age when it comes to custody cases. I mean kids easily can become brainwashed yet they still put alot of stock into what the child says. Alot of mothers brainwash kids into thinking fathers are bad just so that they don't have to share custody. Some mothers even use the children just to get back at the fathers for leaving them.

      Even if there is abuse? Even if the father is trying to kill the mother? Even if there is non stop cheating and trauma?
