Not if it was a brake check/insurance scam. Brake checking is illegal in every state. It's considered reckless driving. There are a few situations where hitting someone from behind is not the fault of the person coming from behind.
On that note the people that he hit disconnected their brake lights on purpose it didn't matter if it was a patrol car or not whoever hit the back end they were trying to get money out of them
