  • MSNBC’S Lawrence O’Donnell explains how today’s cross-examination of Michael Cohen showed the only actual evidence before this jury on how 34 business records got created, which were falsified as part of a conspiracy to illegally affect an election, is that Donald Trump said, “just do it.”

except when you look into his case history, it's very strange. He received an unusually small maximum penalty of 3 years for 8 counts of crimes(many of which were federal). He then received an extremely rare judgement to reduce his sentence based upon information given... and then even stranger still, had the remainder of his sentence reduced to being monitored at home. What did he lose? nothing but a small amount of time and a portion of an unusual income amount. His sentence was to pay back the money that he had not reported and defrauded from a bank, but he had already received that money, just leaving him at a net zero income. The man got convicted of multiple federal crimes including lying to Congress (and banks, and the IRS...) but then received strange convictions for "election interference" for signing Non-disclosure agreements. The guy's a mess.

Paying a lawyer to get a non disclosure agreement on an issue that started in 2011//2006(legal).Three men sit down, two businessmen, and a lawyer, they hash out a structured payment to the lawyer. Why? Probably because a. the businessmen wanted to keep the lawyer on retainer. b. the lawyer did not want a lump payment because he wanted continuous work(legal). The payments were made thru Trump's private accounts on separate private accounting sheets that were also handled by his private business accountants... that is also legal. It’s not a crime to take your attorney’s advice on how to do it. It’s not a crime to pay your attorney back for having done this. It’s not a crime for a bookkeeper, who isn’t you, to label those payments as “legal expenses”.

He didn't adjust his testimony at all! His original testimony answered the ONLY aspect of the call relevant to the case. The answer to the question, asked on initial direct, was that on the specified call the phone was (at some point) handed to Trump and the message about the funding was relayed. There was never any detail given about the initial conversation with the owner of the phone in original testimony but we can assume there was at least some. The case-unrelated aspects of the call never came up because they are as irrelevant to the jury as what the weather may have been like at the time.
