    To be fair to the poor lady: she's up against an absolute mountain of evidence that all says "Your client is a liar." No lawyer, no matter how eloquent, cunning, or talented can find a way around that much evidence. It'd be like trying to defend a bankrobber when there's 20 witnesses, 4 of which are police officers with bodycams, the robber's own mother testifying against him, and the robber stopping on his way out to hold up a copy of their birth certificate, SS Card, and Driver's License to the CCTV camera. What are you supposed to do? Say "Ummm, it wasn't him!" With no hard evidence to support her claims, Amber's entire defense can be summed up as "Literally everyone else - including the cops - are all lying. All the photos, audio, and video have all been edited to make me look bad."
    The kicker is that she has absolutely no proof to show that the tapes have been altered, that the cops are lying, etc. You have to have SOMETHING for your lawyers to work with. A great lawyer can take a small piece of evidence and make it seem like the most important thing in the world. The issue here is that Amber's lawyer(s) don't have anything to work with other than Amber's word, i.e. hearsay. Johnny's team, on the other hand, has a ridiculous amount of evidence. For literally every statement Amber has made, there is something Johnny's lawyers can point to that says she's full of shit.
    As a side note: I love how Camille is just constantly leaned towards the mic, ready to pounce with an objection at a moment's notice.

Let's remember a lawyer ALWAYS has to defend it's client the best they posible can, because they can't EVER know for sure their client is guilty. Check a video on CZcams "my first case a lawyer" about a lawyer that his first case he thought from the beginning his client was guilty but defended him anyways but because he was bias he didn't do a good job. He of course lost the case for the client. After a few cases he realized his client was indeed innocent. Regretting approach on his first case.

    AH’s lawyer was saying “I’m trying I’m trying” because she was trying to craft a question that wasn’t leading the witness, that was establishing a foundation for further questions she needed to ask, that didn’t call for speculation or an expert opinion, and that didn’t call for hearsay all at once. She had questions like that already prepared and AH’s answers nuked all those questions. Once you say something objectionable to a question the lawyer can’t just ask you the same question again and hope you answer it better this time because then the other side will object as “asked and answered.” She had to craft new questions on the fly that got her where she needed to go and she did a good job! The problem is, AH responded to her simple question “Can you tell us about that (your hurt nose)” with an answer that called for an expert opinion the moment she mentioned the degree of scar tissue in her nose. (Which is why the judge said “We’ll see where it goes” as opposed to outright sustaining JD’s lawyer’s objection.) All AH needed to say was “my nose was hurt and I thought it was broken.” (That’s not an expert opinion because whether her nose was broken or not isn’t the point of the testimony- just that at the time she thought it was broken.) Well. She couldn’t even just say that. And once she eliminated those questions because her lawyer had already asked them, her lawyer didn’t have anything else she could ask to lay the foundation for the next line of questioning. AH’s lawyers aren’t bad lawyers and I think they are very unfairly being pegged as such. Their job is to advocate for their client and if she’s in the wrong and it can be demonstrated beyond the legal threshold then she’ll lose no matter how good her lawyers are. (And trust me, you want it to be that way because otherwise way more people would be in jail for stuff they didn’t do than already happens!!) AH’s lawyers aren’t bad lawyers, AH is a TERRIBLE witness/client! 🤣

    • @coolyeh1017
      @coolyeh1017 Před 2 lety +82

      Realistically she cannot. Scar tissue is a medical term of art, thus you need an expert (i.e. a doctor, dermatologist, physician, corner, anatomist, etc.). Lay witnesses cannot give factual conclusions, but they can give out their perceptions (i.e. I was in pain, it hurt, it looked red and purple, it was fast, the person seemed drunk), experts can if it is based on the evidence the expert has reviewed. Though sometimes if you have an opposing lawyer who isn't paying attention you could get some statements like this in, which could influence the jury.
