Now, the defendant though he had a right to barricade his private property made the situation a whole lot worse for a person stuck in an accident. Who in their right mind is going to create further issues for a person that has a vehicle stuck on ice/snow etc. This cruel and destructive behaviour to cause distress and extra burden on the plaintiff should have been enough to award the plaintiff at least 500 bucks.

Usually when you win in small claims court costs are automatically part of the judgement. Don't win, you pay your own fees. Get a judgement against you and you pay both parties fees. It is different to criminal court because fees are minimal. In criminal cases you have to motion to be awarded costs. This is because in criminal cases there is usually very large lawyers fees involved.

Don't they know that people often get lost while driving, or take the wrong turn, or need help with direction? The driver might've missed the signs and was trying to turn back. So what? Help! Why is it so hard to help?????

    I ❤ Judge Judy…….$15 for the Plaintiff.
And the truth be told is that they are both wrong. One for taking the shortcut and the other for blocking the road without putting the right signs ahead of warning people that the road was closed since it was open without being legally open.
This reminds me of when I was a kid & we sometime during the middle of the day, we had a heavy rain storm. Hail started to fall from the skies and being in those farm field with my cows, I only had about 40 minutes tops to get back in town or in some high ground that had a overhead cover to protect me and the cows from the hail that was falling down and from the flood that was to fallow!
As soon as the storm started I took my cows and started to head home. There were others kids and grown adults with their livestock in the fields that picked up and were trying to leave as fast as they could for the same reasons as I did.
Across the main highway, which at the time was a two way driving lane, was a field that was privately owned by a family who had a two children and one of them was 1 year older then I was. He let everyone go through but when my livestock got to cross the highway and went to his field, him and one of his friends cut the road off in person and were trying to direct my cows to go back to the highway and with that storm coming, whatever cars that were traveling were going to hit them and also the flooding was coming soon and that would have been no good!
I went up to them and started to argue and at the same time direct my cows to keep going forward since everyone else did before me, which were at least about ten people and over 60 livestocks that they had. At a certain point, the kids friend hit one of my cows, I think her name was Yllka/Star or maybe it was her mother and that’s where I lost it and with my Shepards stick swung twice at him. Both time aiming for the head, first one he blocked with his arm and got it broken and second time he got hit right on his dome and fell to the ground shaking.
The kid, who was his friend and whose family owned the field, started crying and started begging to not hit him or his friend no more.
AND I DID STOP, BUT TILL THIS DAY I WISH I HIT THE OTHER ONE AS WELL BECAUSE HE WAS THE CAUSE OF ALL THAT MESS AND HE DID IT ONLY TO MAKE MY LIFE MISERABLE AND CAUSE ME PAIN!
I did what I had to do because my life and the life of my livestock was in jeopardy, and to tell the truth… it wasn’t my life that I was much worried about but rather for the life of the cows. And if anything happened to them, even if I was fine, I couldn’t look at my Grandfather in the eyes and tell him that two bullies who were probably advised by grownups “wonder who could that have been?” to do so, injured or drowned/killed my cows because I could not cross the same field that everyone else did and had been doing all summer long.
Just the thought of looking my grandfather in his eyes was too hard and too much for me to bear.
SO, I DID WHAT I HAD TO DO TO KEEP IT MOVING FORWARD.
And what I did, got a kid one year older than me to go to the hospital where it should have been two, including the kid whose family owned the farm.
Now, in my example, the roles seem to be reversed in terms of injuries and damages!
If I had a case for injuries caused to me it would have not been against those two but rather against the “adults” who advised them to do so only to me but not to everyone else!
And if those two kids had a case against me, I would have hoped the judges decision was something in the lines off …..”I find you guilty for $15 dollars for damaging a field that everyone else had been crossing all summer long and did cross that day only because you gave it to one of them real good but the other one you let go only with begging where it should have been him who got it real good and not his bully friend but since they both tried to bully you for doing the same thing that everyone else was doing, you should have gave it to both of them equally!
So, for that you have to pay $15 dollars!
LOOK, I don’t see how blocking a road in middle of a harsh weather and in such were the conditions for this case only gives the defendant a $15 dollar fine. Blocking a road that everyone had been using for years probably in this case, without placing proper signs before getting to that point makes the defendant accountable only for $15 of damages?
Those signs should have been placed way in front of the entrance of property and along the way until to the illegal entrance of the store that was Jerry-Rigged/Barricaded with wood and tape so that way, whoever was using that road all this time illegally would have been informed way ahead of the closed illegal entrance which was widely used by others as well.
The defendant used the conditions of the weather to punish a certain party in particular only because “he all the sudden felt that it was his property and it was an illegal entrance that was no longer available to the public for use”
THIS MOVE BY THE DEFENDANT CAUSED MORE HARM THAN $15 & EVEN THOUGHT IT WAS HIS PROPERTY AND HE WAS IN RIGHT TO BLOCKING THAT ROAD AS ENTRANCE BUT NOT PLACING THE PROPER SIGN/DIRECTIONS CAUSED THE PLAINTIFF TO WASTE TIME AND MONEY WHICH EQUALS MORE THAN $15!
This evil ass hole got away with a slap on the rist kinda the same way the ass hole I had to deal with who got away only with a broken arm and a slap on his head which only caused him to shake.
So in conclusion, judge Judy and I were both wrong in rendering our decisions to the defendants. In both of our cases, they deserved a much harsher punishment!
