You can recover your salary through various legal means but the best way is to file a claim application under The Shops and Establishment Act . Every state has its own shops and establishment acts and the authorities are appointed under the same. In most of the states the authorities are the labour authorities who are designated as authority under the shops and establishments act. The claim for recovery of the earned salary can be filed before the said authority.
You have to issue a demand notice specifying your amount due and send the same through registered post of email which you may be required to prove subsequently.
If the employer fails to make the payment of your salary, then file the claim before the Authority under the Shops and Establishments Act. The authority will issue notice to the management or the employer and ask them about the non payment of salary. If the owner fails to file any justified reason for payment of the salary to the claimant.
The other process is of filing LCA under Section 33 ( C) 2 of the Industrial Disputes Act. This process is little complicated and time taking as the claimant has to show himself as a Workman then only he is entitled to take the benefits of the ID Act.
The Third option is to file a civil suit for recovery of the money which is more complicated and takes lot of time. The claimant has to pay court fees for the same as well.
The best way to recover the due salary from the employer is to file clam under Shops and Establishments Act and claim your earned salary.
