बहुत सही निर्णय।क्योंकि आजकल ब्लैक मेल करने के छोटी मोटी राशि देकर ब्लैंक चेक लेकर बड़ी रकम भरकर धमकाया जाता है। कि अगर इतना नही दिया तो इतना लूंगा।और जो राशि दी गई उससे 5से 25 गुणी तक राशि भरकर चेक लगा देते हैं।उन लोगों को सबक है ये निर्णय।

मेरे हिसाब से ये पैसा ब्याज पर दिया गया होगा जो विश्वास पर दिया जाता है ब्याज का पैसा बैंक तक जाता ही नहीं ये सब नक़द लिया दिया जाता है चैक सामने वाली पार्टी ने गारण्टी के तौर पर दिया होगा।
लेकिन उसी चेक का misuse करते हैं सर ब्याज चलाने वाले 2,3 गुना अमाउंट भरके बाउंस करते है जो अन्याय है , ब्याज भी ले रहा है ,और 2,3 गुना अमाउंट भी लेना चाह रहा है।
इस समस्या का एक ही हल है कि आप किसी को भी पेमेंट दो तो चेक से दो उसकी एंट्री हमेशा आपके पास बुक में रहेगी वह आप कभी भी साबित कर सकते हैं कि हमने उसको पेमेंट दिया है

With due apology to the Honourable Supreme Court of India, I can say that it was miscarriage of justice. A peasant without paying the money to the accused, went up to the High Court and the accused issued the cheque without any liability are not understood. The peasant suffered a huge loss.
Main point is resion of giving money why he given money and such large amount there will be main 2 resion 1 ) he is trying to help or 2) he is willing to get interest. 1) in first if he trying to help means he knows that person infront of him had no money and he will return it after some time once he get from another source. In this case person is helping he knows the risk and not liable to get back he is money. Resion he just donate money. 2) in second condition if he willing to get back money with extra interest then he willing to earn money from person which is not capable to pay again And it is illegal. So in conclusions both cath person who given money without checking background of person who taken money. So in both case borrower no responsibility to payback money. So it very important to understand why he given money.

आपने बिल्कुल सही तर्क दिया है,ये दोनों मसले जुदा है ओर सबसे बड़ी बात तो यह है कि परक्राम्य लिखत अधिनियम में ऐसा कोई प्रावधान ही नही है और न ही संशोधन हुआ है,यह अधिनियम केवल शुद्ध रूप से चेक नाम के अधिकृत दस्तावेज के अनादर से जुड़ा है और एक समंस विचारण है जिसमें निराकरण के लिए 6 माह की समय सीमा तक दी गई है और जिसमे धारा 138 को सिद्ध होने के लिए केवल तीन सीमाए है जिनका पालन अनिवार्य है और उसमें भी यदि चेक प्राप्तकर्ता ने किसी अन्य विधान का उल्लंघन भी किया है तो उसके लिए उस विधान के तहत अलग से दंड या जुर्माना के प्रावधान है,किसी ने अपने लेनदेन को अधिकृत विभाग में घोषित नही किया तो आयकर अधिनियम के तहत अलग से कार्यवाही की जा सकती है,परन्तु केवल लेनदेन को घोषित न करने से चेक अनादरण के अपराध से आरोपी को मुक्त करना तो हास्यास्पद ही कह सकते है। "क्या मजाक है"
इस फैसले को रद्द करने की जरूरत है। पैसे के लेन-देन का हिसाब रखना आपका अधिकार है जिम्मेदारी नहीं, प्रत्येक लेन-देन का हिसाब देना न तो आयकर रिटर्न में जरुरी है और न ही किसी और आर्थिक कानून में। इस फैसले से चैक पेमेंट ही भरोसेमंद नहीं रह जाएगा और NI Act ही रद्द करने योग्य हो जाएगा

I am filing my ITR from last 20+ years. Which section of ITR requires to declare if i have lended any money to anyone? If someone knows please enlighten me. I guess the whole argument to that it was not past of ITR itself is wrong. Many times you lend it without any documentation in good faith. However, surprised to see, SC even didn't looked at the fact that the cheque was issued and never examined that why this cheque was issued? Was it for charity?😅
Under s 138 of NI Act an offence can be made out only if its prooved that the cheque was drawn to discharge a debt. No debt means no offence under 138 of NI Act. Allthough remedy under some other law could still be obtained but not under 138 of NI
In income tax return we file our income statement only not the debts given. The person filing the case is farmer not a business firm. In business firm or the person whose accounts are audited then this prove comes in audit report only, then also it doesn't come in income tax return.
Yes any amount paid to anybody does not concern to Income Tax return. No where it reflect in Income Tax return. Taking Income Tax in consideration is wrong

Few judges & lawyers consider themselves above Parliament & they keep giving judgments anti goverment and in favor if antisocial, anti national interest , and thats might be to become famous, or to make money by corruption,or just to please opposition leaders with whom they are mentally attached . Its very important that upgrading court procedures, labour & land laws immediately. Many foreign manufactures are not coming to India is the real reason of problems of acquiring land and laws in favor of workers. Priority is to improve fast judgments by reducing court holidays .

I won 138 case in Delhi Tees Hazari court in 4 years by myself without any lawyer. I had a business partner who asked me to give him a cheque for Rs 15000 so he can just show to a creditor. I gave him on condition he would not get the cheque encashed...but he presented it to my bank twice, got it bounced and filed a 138 case against me after a year. I attended all hearings myself without lawyer. The complainant or his lawyer NEVER appeared. The judges would sympathise with me, tell me if the complainant or his lawyer would be be absent a second time before him, he would dismiss the case. But the judge would change and I would be again told the same story by a new judge! My attendance record was 100%. I had all the documents, but except that bounced cheque, my partner had no documents. The court even sent summon to the complainant, but he never appeared! Finally, I told the new judge:" I am not going to come again...win or loose!" The judge dismissed the case...but it cost me 4 years of unnecessary harassment! Indian law is a total mess and an a**!!! I have won 5 such stupid cases in Delhiwhen I fought my own cases. I also helped others win...and I am not a lawyer! The key is documents and simple drafting. Judges always love it and helps you.

पहली बात यह कि आपके बताए अनुसार यह केस किसान सम्बंधित है, आप ने बताया उसके बचत में से उधार दिए गए हैं। दुसरी बात कृषि आय आय टी से बाहर होने से उसे आई टी आर दाखिल नहीं है तों वह इस के इन्टरी का विवरण कैसे दिखाएं। दुसरी एक गंभीर बात आप और माननीय न्यायालय यह बताना चाहते हैं, बैंक चेक अमान्य माना जाएं या डस्ट बिन में डाल दिया जाए इसकी कोई वेल्यु किमत नहीं है,जब तक अलग से कोई प्रुफ सबुत नहीं दिया जाए। तो इस हिसाब से बॅको ने अपने ग्राहकों को यह चेक बूक देना बंद कर दिया जाना चाहिए। उपरोक्त मामले में इस बात पर तो किसी प्रकार से गौर नहीं किया गया।

ट्रक वाले बड़ी मेहनत से रात-दिन एक करके जो माल इधर से उधर करते हैं उसका पेमेंट नहीं दिया जाता ऑनलाइन के नाम से महीनों तक चक्कर लगाने पड़ते हैं और चेक भी नहीं देते कहते हैं ऑनलाइन पेमेंट करेंगे फिर गाड़ी वाले वहां से निकल जाते हैं और महीनों तक चक्कर खाने पड़ते हैं फोन करने पर फोन भी नहीं उठाते है बहुत परेशानी हो रही है कृपया इस ओर ध्यान दिया जाए
दिया गया चैक पुर्ण रूप से उसके ही hand writing में लिखा है यहाँ तक कि date भी ।वह भी समय माँगते हुये तीन महीने के बाद फिर से चैक फिर तीन महीने बाद चैक यानि तीन बार चैक दिये साथ ही स्टाम्प पेपर पर अग्रीमेंट सब कुछ उसके ही hand writing में लिखा है ।

With due apology to the Honourable Supreme Court of India, I can say that it was miscarriage of justice. A peasant without paying the money to the accused, went up to the High Court and the accused issued the cheque without any liability are not understood. The peasant suffered a huge loss.

आपने बिल्कुल सही तर्क दिया है,ये दोनों मसले जुदा है ओर सबसे बड़ी बात तो यह है कि परक्राम्य लिखत अधिनियम में ऐसा कोई प्रावधान ही नही है और न ही संशोधन हुआ है,यह अधिनियम केवल शुद्ध रूप से चेक नाम के अधिकृत दस्तावेज के अनादर से जुड़ा है और एक समंस विचारण है जिसमें निराकरण के लिए 6 माह की समय सीमा तक दी गई है और जिसमे धारा 138 को सिद्ध होने के लिए केवल तीन सीमाए है जिनका पालन अनिवार्य है और उसमें भी यदि चेक प्राप्तकर्ता ने किसी अन्य विधान का उल्लंघन भी किया है तो उसके लिए उस विधान के तहत अलग से दंड या जुर्माना के प्रावधान है,किसी ने अपने लेनदेन को अधिकृत विभाग में घोषित नही किया तो आयकर अधिनियम के तहत अलग से कार्यवाही की जा सकती है,परन्तु केवल लेनदेन को घोषित न करने से चेक अनादरण के अपराध से आरोपी को मुक्त करना तो हास्यास्पद ही कह सकते है।

I am filing my ITR from last 20+ years. Which section of ITR requires to declare if i have lended any money to anyone? If someone knows please enlighten me. I guess the whole argument to that it was not past of ITR itself is wrong. Many times you lend it without any documentation in good faith. However, surprised to see, SC even didn't looked at the fact that the cheque was issued and never examined that why this cheque was issued? Was it for charity?😅
Under s 138 of NI Act an offence can be made out only if its prooved that the cheque was drawn to discharge a debt.
No debt means no offence under 138 of NI Act.
Allthough remedy under some other law could still be obtained but not under 138 of NI
In income tax return we file our income statement only not the debts given. The person filing the case is farmer not a business firm. In business firm or the person whose accounts are audited then this prove comes in audit report only, then also it doesn't come in income tax return.

I won 138 case in Delhi Tees Hazari court in 4 years by myself without any lawyer.
I had a business partner who asked me to give him a cheque for Rs 15000 so he can just show to a creditor. I gave him on condition he would not get the cheque encashed...but he presented it to my bank twice, got it bounced and filed a 138 case against me after a year.
I attended all hearings myself without lawyer. The complainant or his lawyer NEVER appeared. The judges would sympathise with me, tell me if the complainant or his lawyer would be be absent a second time before him, he would dismiss the case. But the judge would change and I would be again told the same story by a new judge! My attendance record was 100%.
I had all the documents, but except that bounced cheque, my partner had no documents.
The court even sent summon to the complainant, but he never appeared!
Finally, I told the new judge:" I am not going to come again...win or loose!"
The judge dismissed the case...but it cost me 4 years of unnecessary harassment!
Indian law is a total mess and an a**!!!
