What is a Default Judgment?

  • Default judgment is what happens when a defendant fails to answer a complaint or fails to appear in the case. We typically see this when a party who was properly served failed to respond to a complaint. It's important to note that there's a difference between "default" and "default judgment". Default is the first stage of this and occurs when somebody fails to answer the complaint after they've been properly served. That is tantamount to admitting all of the allegations in the complaint.
    After default has been entered, the court can then enter default judgment, which is judgment on the liability. In other words, entering damages on the claims that you have made in the complaint that the defendant didn't answer. Default and default judgment are not a good place to be. It's important that if you're served with a complaint, you answer it. We certainly recommend hiring an attorney to do that.

    I am going through a worker comp case and it looks like my case is going to a hearing. So my employer not the owner is not with the company anymore and he return to his native country so he will not testify against me. my question is because he is the main witness and he will not be there can my attorney claim a default judgment.

    If the defendant was hand delivered his notice to be in small claims court by the sheriff's department and didn't respond and the judge ruled default judgement in the amount of $7500 does the plaintiff still have to go to court to prove the amount the defendant owes? Or what is the process?

    Court ordered State and State made Part payment to Plaintiff and 30 years later Plaintiff in Court to claim outstanding amount. Is Default Judgement Application ex-parte appropriate to pursue in this case? amount. Can
