    Dormant commerce clause was on the Feb 2024 CA bar exam, and thank God I had watched this video because it was the only explanation of the DCC that made sense to me, so thank you!

    The trouble with this explanation is that it is only applicable where "commerce" is interpreted as an economic function. There are multiple definitions under "commerce", which were more widely used and more commonly understood in the 18th century when the Constitution was written. "Commerce" also applies towards social and sexual interactions between persons. Article I Section 8 makes no attempt to distinguish which of those definitions were or were not intended to be interpreted, only that Congress shall have jurisdiction to regulate it. The court's power of judicial review does not permit the court to dictate what Congress may or may not do. It only permits the court to identify and invalidate laws that conflict with a specific provision of the US Constitution.

    Why do people think they don't need a drivers license to drive nor do they think that driving over the speed limit is a violation because they feel they are driving safely even though the speed limit is posted? This person says he or she is protected by the first amendment and that state law does not pertain to them?

    You did not point to the 21st amendment giving states rights to discriminate when alcohol provided the state system's predominant affect is health and safety.
