Liar and tyrant found: follow up, charges dismissed

  • After being arrested for trespassing and fighting the charges in court the prosecuting attorney finally agreed that I was gathering news content and had the legal right to be on the property.
    Ultimately the charges were dismissed for this reason.
    The officers overstepped their authority and misinterpreted the trespassing laws in addition to soliciting a trespass charge from the Petco manager which a violation of my 14th amendment rights.

    I disagree with the judge that said "this is the correct outcome...". I think the correct outcome would see DA facing malicious prosecution charges, and a recall election. The police that violated your civil rights would be fired, barred from public service for life, and facing a federal lawsuit (with no police union paid atty) for their violation of federal law. Any officer on scene that did not directly violate your rights would be fired, and barred from public service for life because they didn't step in and prevent the other officers from violating federal law and their oaths. These would be "the correct outcome" for what these "police" did.

      Kevin Raber Since the courts are agents of the state I am amazed the court actually dismissed the charges since they usually try their best to find some way to support the actions of the police knowing a higher court will likely overturn their decision. This allows them to appear to support the police and have the higher court play the bad guy.

      Wow, it is almost like you have high standards! Saying cops should have higher standards is viewed as anti cop. It is clear that cops get hired as mindless soldiers, sent out to return with work for attorneys. Even if the cop was wrong, that just gives the attorneys something to do.

    Question: Has anyone that you know ever asked the judge, "Is there any way I can recoup my financial losses incurred fighting these bogus charges?"
    Otherwise, to me, it seems like they can just charge people with "bogus" charges, then drop the charges at some later date. Meanwhile, the defendant ends up spending time, gas money, parking fees, attorney fees (if any), etc.
    Is there any mechanism for recovering lost monies?

    I worked in the system as an officer for almost 30 years and you are right, the system is broken, it is also rigged in many cases. You were fortunate to have a fair muni court judge. Great explanation of multi tenant property rights. It's not straight forward like simple property rights.

    Back in 1995 I was arrested for what the police department called a domestic incident. Was held in jail for 44 days. Was never Arraigned until my 45th the day. The judge asked me three separate times when was I arrested I told her each and every time she says that was 44 days ago yes your honor I know that why didn’t you say something I’ve been asking to see an attorney and or judge for the last 43 days she immediately released me. Six months later I received a check in the mail for $28,500

      The only reference I have is 41 CFR 420 which allows journalist to take pictures in lobbies and such. My lawyer explained how trespassing works and the right to trespass from the store front and from the property. My lawyer also talked to me about my 14th amendment which grants the right of due process of law. I hope this helps you, and if you have any questions I will try to answer them. What area of Washington are you thinking of auditing?`

    It is sad, but especially with a traffic violation, sometimes it is best to just pay a fine, and avoid the hassle, the lost days work, and the embarrassed state that the court system puts one through. In this type of case you have no choice but having to go through the court process. A citizen must consider himself lucky if the judge has ruled in your favor. As things stand only 10 percent of citizens receive proper justice. Our courts and police in this country enforce laws that benefit themselves. The constructional rights and freedoms is only a secondary thought to them and most times are totally disregarded.

    Fully agree with Kevin Raber comments. What is left out is the responsibility of elected city officials to ensure that they provide oversight for the staff they appoint. When incompetent staff are allowed to supervise incompetent officers, they should be held accountable. In this case the only person that suffered the consequences of this false charge and arrest was the victim of this charge as well as the taxpayers who paid the police salaries and the court costs. A lawsuit would serve to shine a light on this system of incompetence and abuse and serve to protect other citizens from being subjected to the same treatment in the future.

    I’ve had 3 out of 4 major cases in my life dismissed because I knew my rights. They threatened me with 13 years of I took it to trial or 12 months if I plead. I walked out laughing at them. I’d love to share my story if you’re ever interested.

    With prejudice is huge. My understanding is that it means that not only were you innocent of any charge, but that the arrest was deemed unlawful, as in the cops did something wrong.

    You should file a Title 18, Section 242 action against the officer and the city (prosecutor). Basically, it says that anyone acting under color of law who acts to deprive you of your civil rights (1st & 4th Amendments) is guilty of a crime. Sue the bastards.

    NNS thanks for posting this. It shines a light on just how broken our injustice system is. First and foremost the police are almost never held accountable, as they were not in your case. They advance their career with arrests and revenue generation, as we all know there is no money in serving and protecting. This works very much the same with the DA. The only reason the judge fussed a bit was because on BS cases like this they are supposed to drop charges. That is a very hollow victory for the accused, because just like the case of the homeless man you now have an arrest on your record. This is why the first thing police do is try to get your ID. They get activity points for that. In your case they will see an arrest so the next time in court that will most definitely count AGAINST YOU. Not the DA, NOT THE POLICE, YOU. Stacking bogus charges on top of bogus charges helps the police and the DA much more than it will ever help you. You are in the "system" now. And what a system it is. For the judge, everything is free, right down to the paper clips in your file. On the other hand We the people have to pay for EVERYTHING, legal counsel, research, expert witnesses, paper clips, EVERYTHING. Same for the DA, same for the police. It is truly a system that is rigged, the homeless man that you mentioned will soon find himself in jail. The people that run the jails are the same they get paid for prisoners, and business is good. The real point of that arrest was to put a number on you, the police knew it and wanted to teach you a lesson. The lesson is we can break the law and violate your rights so don't cross us. The police know this the judge knows this, but the dummy DA had to be told. You did not win, you lost, and the judge just thought the DA was being greedy. Trust me, the judge did not care about your rights or a fake arrest, it is a tool for keeping the masses in check. He admonished the DA for being too ambitious, that sort of thing is frowned upon, in government circles.

    Way more than $10,000. 4 court appearances adds up huge court costs, all of which the Prosecutor's Office absorbed. But the prosecuting of homeless people is disgusting. The system is not just broken, it's evil. It cannot be "fixed" only burned to the ground.

      You are correct, this is how it should be. However, after talking to several attorneys it has been made clear to me that the prosecutors generally do as much as they can to back the play of "their" officers in order to assure to cooperation of the officer at trial and future trials. it is all just a big quid pro quo.

    The court system have to be taking back from the people . Make the barre member illegal and reinstall none member judge and lawyer with no duty to the court. A real lawyer have to be able to represent his client and his client alone not the court so if a judge want to eat from the hand that pay him instated of serving justice the lawyer duty will have to expose him due to the fact that he is there only for the benefice of is client, that will be justice not corruption.

      @@troylee5273 yep got to love petco the only pet store to get sued for blocking a military vet and his service dog from the store i will never buy a dog disquiet from them again lol they say pet friendly but i guess it is not vet friendly
