This deputy should have been charged with felony tampering/destruction of evidence as well as aggravated assault and battery.
The county should have been sued for false imprisonment, unlawful arrest and Constitutional rights violations. Also for The injury to pepperoni and punitive damages.

July, the state's Republican governor, Doug Ducey, signed into law a measure making it illegal to record video within eight feet of where “law enforcement activity is occurring.” In other words, the law allows police to arrest you for taking video of them, even if you're videoing them as they break the law.Oct 6, 2022

Being a jerk isn't a crime tho. Still shows officers are acting emotionally and in violation of the law. I mean like it or not his methods showd how curropt this department is. Deleting evidence. Refusing treatment. Dude can be a ass. But these things are expected even for criminals. Even the guilty are supposed to have their evidence and get treatment. And he's completely innocent. It would be wrong even if he was commiting crimes. The idea that he's not shows alot. But honestly with the agitation. This is probably how the average 'criminal' interaction goes. Persons annoyed getting arrested. Cops are convinced they are right so won't accept any evidence otherwise. Dude gets a plea deal and takes 5years in years in jail. You can be polite and stuff. But really this shows how police are constantly abusing the people they charge, when even criminals have the right to a fair trail. It's easy to ignore the rude and call them the bad guys. But we are supposed to be following laws. Yet once your 'guilty' in their eyes the laws no longer apply. Thats messed up. No matter what. Even prisoners have rights.

Battery is likely a felony. Theres at least 3 or 4 felonies involved here for each person, and potentially one for the dude who shoved him. I've been yanked out of my car and handcuffed within the first 30 seconds of a pullover multiple times. Then had my car searched. Nearly every time I hadn't even been told why I was stopped yet. Granted I was a bit of a rowdy young guy and was no angel. But they'd see you had any kind of a record and treated you like a hardcore criminal, in my case it was all driving offenses and I've never had a drug charge. It's just the mentality of a power hungry person. It's all an ego thing. These people are not fit to be cops. Thank God for body cams and cell phones! It's not just difficult to get bodycam in SC, it's basically impossible. The only way to get it is if it's released as part of a civil or criminal investigation. You cannot FOIA bodycam in SC. @@bbigrocker1 I know what you mean, I had a run-in while passing through NC once. I was cited for speeding, and I told my lawyer I wanted discovery. I was told there is no discovery in NC because it's a "civil infraction" and not a criminal charge. If you can't get discovery, what chance do you have? Then it's your word against theirs, and the magistrate judge is always going to give more weight to their word over yours. My lawyer was able to work it down to an equipment violation (no points) and I bent over and paid the fine. Its a disgusting racket that's heavily tilted in their favor. Idc what they want to label it, you should have Constitutional due process rights, and a fair opportunity to defend yourself. I can't see any way you could defend yourself without discovery. Yet another reason why everyone should invest in a good dashcam so you have some avenue to defend yourself from policing for profit.

Hard to get in WV too. Usually it's not but if the cops look bad in the video, they try to find any excuse to deny the request. I was denied body cam footage last year, they claimed it was because there was an "investigation." There was nothing to investigate though. They pulled me over, boxed my car in on all sides as if I was trying to flee, all because one of my passengers yelled at some cops, calling them pigs. Then cited the guy with disorderly conduct after talking crap to him about how they'd like to kick his ass. End of story. What's there to investigate??? Still won't release it. But I'm gonna try to one more time. In the video I was polite & even admitted to the cops what the guy yelled at them. Why you might ask???? Because it's protected free speech & their response was total overkill & unconstitutional.
