If you have some concrete facts for us that prove your point, why don't you share them with us? I, for one, will never take the word of a reporter/media without substantiated facts ever again. Intead of jumpint conclussions, letswait and see what the whole story ends up being. Something obviouly pushed the Goodson Strawberry Farmers to go to these extremes.

      Wrong. An easement conveys to the new owners of each property with each sale of the property. The property owners essentially OWN the easement, and Goodson will likely lose this battle. This is why you should never grant an easement across your property - and if you have to do it along property lines.

      @Fuch CZcams Oh really, you have no clue about what you just wrote. If the easement are in property descriptions & filed in the property county of records, guess what; "it's part of the property". So if I sell property XYZ to buyer Joe Doe, he's buy that property and attached easement. Even if the easement is prescriptive easement, the owner has the right to use it.
      As a buyer of land, you should search for any easements that where granted . This goes both way.
      The Goodson is just being sleazy piece of sh!t and for no real reason.

      @@AlisonCasilli This isn't something I'm "blase" about. In fact as a Floridian, with all of the transplants moving down this is something I'm very concerned about. I spent a lot of time replying to comments on this video. From beginning to end this was designed to manipulate your emotions. Maybe this guy is wrong and he's doing this because damn any of the civil and criminal consequences he could face for unlawfully depriving someone use of their property, all of the sudden after 2 years decide "I'm gonna be a jerk and I don't care about any of the consequences because I'm a really bad guy and just feel like being a jerk"! There are multiple reasons this guy could actually be the one who's getting skrewed, if you're actually interested in them I'd be glad to go over them with you but honestly I've done it so many times I feel like I'm talking to a wall. The one that's most likely is that an easement isn't the same as a right of way. Maybe this guy is tired of having his property used as a road. That isn't what an easement is. Maybe this guy is actually super cool and gave these people 2 years to make arrangements to get access to the road that actually exists . Maybe the people that bought those properties didn't understand that an easement wasn't a right of way and that's why they got those properties so cheap. There are many other possibilities but my real argument in any of my comments is why not wait for the court case to be done before trying to ruin someone's life. And why when Civil actions had already been started run to a liberal media outlet with a one sided sob story knowing that with legal proceedings being underway the other party would be stupid for commenting? I'll tell you why I think they did. To spin the story and cause a moral panic. Which it did. Honestly how many times have the media lied to you? They say they reached out to hear his side of the story. They know that with a court case coming up this guy cannot comment without risk of screwing it up. They have lawyers in house that could have told them the multiple reasons that this guy may be in the right yet they didn't tell you any of them. Sound suspicious? If you're really interested I have no problem going over some of the other is the other reasons.

    Easements when clearly part of a deed are not up for post sale termination defined by law -- they are what they are in the closing contracts and stipulated in the owners deeds to all involved. Sad the Code Enforcement didn't want to act with vigor when seemingly all had the proper documents signed by all parties with 1 owner now denying access to those legally allowed to access their property. Apparently the aggressor has a strawberry farm --- welp you have to sell your product to stay in business -- just say'n.

      Wow you are an uninformed and vile person. Maybe a jailhouse lawyer? An easement only grants people access to the property for specific situations for a limited purpose. And even then it has to be for a purpose not inconsistent with the general owner of the property. An easement is not a right of way.A right of way is a type of easement that establishes the freedom to use a pathway or road on another's property without conferring ownership. So even if the person that sold the property with the easement was legally able to, the easement would only probably apply to the guy with the cattle but only probably because If hes not growing anything and it's only cattle its a ranch not a farm that would be something else the courts would have to decide .But your 1st question should have been did the person in 2017 even have the right to transfer that ownership. That's the 1st thing that needs to be established by a court. Not by a zoning board. But if you're just having a moral outrage why not have a moral outrage at the people with the private road that aren't granting access, they already have an established road. Why not allow the other people access to it. You're okay forcing one person to give up right to his property. Why him and not the people that already have a road? Or better yet instead of trying to ruin this guy's business, wait till he has his day in court.

      You are going to feel really stupid if it turns out that one or both of the other residents have been abusing the private property that the easement runs through.... like maybe the cattle were allowed to graze Goodsen's strawberry fields or someone's kids are trashing his property with ATVs... no one is saying. Everyone is quick to judge without knowing all the facts. That's why society has courts (that we hate so much) because people in general fly-off half-cocked and do things that are unreasonable. That could be Ricky Goodsen but you don't know that - yet. I don't trust a reporter to tell the truth and that is the only person telling this story.

They’re just saying he is a basic Karen and the courts will prove it out. And yes people do some dumb things instead of taking Good measures to do them decently like blocking off a legal easement with dark equipment instead of going through a civil process. You just got completely controlled by your emotions, they didn't tell us anything other than some people were upset about something that they believed and somebody was upset about something they believed and now it's up to the court. They didn't prove the person that sold the property even had a right to sell the easement with it. And Let alone that the farmer was the one that was wrong. An easement isn't what you think it is. So go ahead with your fake outrage But why not be outraged at the people that already have a road that aren't letting them use it instead of cutting through his field? There's a road there.       Who says these landowners are in the right - this reporter? A reporter is the last source I would believe. You don't know that the property was sold legitimately. You also don't know that Goodsen isn't getting screwed by one or both of the other two. I'm not defending this guy but everyone is against him and I haven't a word about his side of the story.     Ricky Goodson reminds me of a neighbor of my grandpa's. He was the grandson of the neighbors, spoiled, and when they died, he got their farm. When he got to harassing my 90 year old grandpa, I wanted to make him disappear, but family insisted on doing it the legal way. Sadly, he harassed my grandpa until the day he died. Real shame as the grandson could have been lost in that wilderness forever. Instead, his bad behaviour was rewarded.
    Too bad that farmer didn't have pigs instead of cattle.

      That could be Goodson's play here, trying to play hardball with the other property owners to force them to buy the easement. He has to know that in the end, the courts are going to rule against him, as someone noted, the establishment of such permanent easements goes back into the old English Common Law from which our legal system is derived in most places in the US save Napoleonic law in Louisiana and a few other states. Such law transferred over to our modern Statuatory Law system. I am not a lawyer, I've just taken Real Estate Licensing Courses here in Florida. They teach the pertinent aspects of this part of Real Estate Law in those courses.

    The joint investigation already has produced convictions and sentences for a second farm, Goodson Farms, and its owner, Janet Goodson. According to court documents, Goodson Farms is a farm incorporated in Florida, with its registered office located in Balm, Florida. Goodson Farms owns and leases land and employs numerous persons to grow, harvest, pack, and sell peppers. From March 2001 through September 2004, Goodson Farms, through its officers and employees, obtained federal crop insurance to cover pepper crops, and, during that time period, Goodson Farms fraudulently claimed crop losses under its federal crop insurance program policies, when in fact Goodson Farms had harvested and sold the crops. As a result, Goodson Farms falsely and fraudulently obtained more than $1 million in federal crop insurance payments. On March 18, 2009, Goodson Farms was sentenced to 5 years of probation and was ordered to pay $1,098,441 in restitution to USDA-RMA and $1,098,441 in forfeiture.

    I bought a property with an easement through it for driveway to two neighbors, it was clear in the docs before buying, I looked things over and determined it didn't adversely effect my property, bought the place and have had no issues with neighbors in 4 years

      Which is _exactly_ what I posted under the previous BCB video a couple of days ago .... take it to court to get an emergency injunction to clear the obstruction, then settle it in court. There isn't going to much of anything to decide though if, as stated in this video, that the plaintiffs have deeded rights to the access easement.

    These types of disputes will not stop until all landlocking is banned at the federal level. In this case, Goodsen must be brought up on criminal as well as civil charges. The local government should just use eminent domain seizure to take the easement and convert it into a shared road or driveway between the properties.

      @@deusvult6920 I think other properties could use the road as access? I would need to rewatch. In our area 3 properties minimum would need to be serviced for the state to accept it as a public road. Of course it'll have to ge built to current standards.

    Easement by necessity is one of the oldest concepts in English common law. If the only way to access their property is through your property, you are obligated to allow that access.
    and that tight shot is terrible... either move her to someplace on the wall that doesn't look like the beige wall of a living room with a bad shadow behind her, or keep it wide so people can tell it ISN'T A LIVING ROOM WALL! You're supposed to employ a professional Production Manager to oversee this kind of thing. Maybe you should get a better one.

      I recall a few cases where the concept of you have to allow others access to their property through yours if it is the only way was found incorrect. However, in this case the guy blocking the road is in the wrong. The easement was part of his deed, and when he bought the property he did so with all the strings attached to it.

    Please do a follow up when new info is available! Do the ownes have title insurance? The title or settlement company maybe can compensate or provide representation. Contacting a local land surveyor and title company may be a good first step.

    the cows were fine the field had plenty of good grass, the cows may have needed access to water but hay was not for the moment all that crucial. That being said he still deserves access to his property and the easement road was part of the agreement, what happened to the Good Neighbor that used to live around here.

    Not sure where this is but every where I've lived the fact that it has been used for years as their access put him in the wrong. A private road has to have a locked gate for a certain amount of time each year in some places I've lived.

    Get a get welder out there and cut that piece of farm equipment into manageable sized pieces and move them out of the way. Mr Goodson is a bad guy that need to be taught a lesson about being decent to your neighbors.

    He's lucky it isn't me. I'd would have cleared the road of the obstruction. It looks pretty big so I'm sure I'd would have to cut it into a few pieces to move it.

      John Deere tractor would move that with easy. Maybe even a 3500 truck. Goodson had to use something to place it in that path.
      I would not cut it up , so Goodson would have a legal claim on destroying his equipment.

    If you have land that's land locked, nobody can't prevent you access if you have a easemet filed in the court.
    The guy is going to loose and the other will have claims if anything happens to his cattle.

    The county just needs to abate the easement. That bad neighbor will just do more creepy things. The only way to resolve the matter is by the county getting control of the situation.

    could it be that Goodson has a deed that does not reflect a easement? I had a neighbor sell property and tell the people there was an easement and it was reflected on their deed they received. But I had never granted easement. I worked it out by selling them the easement land. It was 25ft wide and 1700 feet or so long. Almost an acre. I wasnt about to DONATE an acre land I paid for because a guy bought from a neighbor and the neighbor was wrong about and easement

      It is possible however, unlikely that the Goodson deed does not reflect the easement for several reasons.
      * In this video or one that the reporter did previously she contacted the city to verify the validity of the deed and the right to the easement. The city reported back that the deeds and right to easement were valid.
      * This is not a verbal agreement between the people who need the easement and their realtor who sold them the land, it is listed in the deed. If the deed was maliciously modified between owners to include the easement it would probably invalidate the purchase and there would be severe penalties to the person who did it.
      * Even if the easement was not included in the property I would think due to because the other two owners were able to use it for so long before the owner acted it shows that at least there was an understanding of an easement between all three parties.
      As to your situation, I have heard of other cases like that. Where someone splits their property into multiple parts, not all have road access. In that case, yea you are well within your rights to do what you did. It sounds like this property and easement existed before any of the current owners decided to buy it.
      To be clear, I see no issue with what you did, however, it is a different situation than what this guy is in, and I hope he does not fair well in court, as when you purchase property you have to abide with all the strings attached to the property.
