Otiende is articulate,coherent and has a mastery of matters law..My hero made my day.Iam Somali but today become a naturalised Luo with the new name Mohamed Omollo aka Sibuor in honour of Otiende.This Unsung Luo are unique in that they can elect anyone from any corner of Kenya as MP without any prejudice ,propaganda, malice and stereotyping aside.Res Ipsa Loquitor(The act or fact speaks for itself).When the opportunity arises,it is one community that would without reservation elect a presidential candidate from the coast or Northern Kenya regardless of the faith of the candidate. Are you cooking together with them? Let the case run its course. If the submissions are overwhelming then the court will be hard pressed to play along. Such important judgements stick for along time and can make or destroy the career of judicial officers. There is a threshold below which they can't go. Such judgements are researched on quoted and referred to by Commonwealth courts for a very long time.

The provisions of the law allow the president, like any other politicians to 'campaign and support' a course not initiate or promote an initiative leading to amendment of the cosititution.....stop camouflaging in the term 'suport' to mean Promote or initiate.....stop missleading the court.

It is the reserve of the court to guide the constitution in determining at what point a popular initiative is termed so. in my interpretation and in the spirit of respect to sovereignty of wanjiku, initiative begins with an idea from wanjiku not an idea coined by the executive and co-opt a people in guise of the people to front the whole just to confirm with the requirements of the constitution. You are of little understanding. IEBC is not Otiende's client in this case. That is role for Githu Muigai. What Otiende did was to mention an item in IEBC's report to JLAC which also found its way into High Court as a part of the evidence. However, it was clumsy for Justice Kiage to require Otiende to explain the details of operationalizing what he quoted from an IEBC report. Also bear in mind that the submissions are timed - Otiende had 30 mins! Why should he have wasted his premium time explaining a report from IEBC, yet he had no instructions from IEBC?? Law is not for dimwits!

What are you trying to say? Otiende Amollo has categorically stated that there is no mention of an initiator under the constitution in the process of its amendment. It is infact his submission that the judges erred in coming up with the term "initiator" and assigning it to some people in writing their judgement. There are only promoters and supporters under the constitution.

Courts are not guided by such vague terms as public domain. You have to go to court and argue your case there, backed by evidence.

When you have a lawyer convincingly, but respectfully taking a Judge (Justice Kiage) through the paces on how to interpret article 257, then you you can be assured that you have come across a lawyer who knows his stuff. When asked they pass the back..... You wait for the next one , he is asked the same question , he says the next learned friend will answer ....... The next so learned friend comes, the judges have not forgotten so they ask Nyaoga ...... He still passed it on...... The presentation was over and the learned Friends had not answered the same basic question that took them to the appeal
