  • In 2010 Donal Kinsella, a businessman, was awarded €10 m in the High Court in a defamation action against his employer. Kenmare Resources.
    We all have a constitutional right to our good name, and protection against defamatory statements being published about us.
    The principal piece of legislation in Ireland dealing with defamation is the Defamation Act, 2009.
    This act defines a defamatory statement as follows:
    “defamatory statement” means a statement that tends to injure a person’s reputation in the eyes of reasonable members of society, and “defamatory” shall be construed accordingly;

    Hi Terry when you said defamation could be committed orally how is defamation differentiated from slander?

    I'm being accused of defamation (Getting solicitor letters) but there are six witnesses to what I am saying. The organisation who is accusing me refused to talk to the six witnesses. The relevant things I am writing on social media are in relation to my Dad's treatment in a Hospice the day he died.

    Hi terry, a friend of mine thinks he may have committed defamation, what happened was he sent an insult to someone in a private message on Instagram but he only sent it to the person in question but he didn’t send it to anyone else. He really worried because he thinks he’ll get in a lot of trouble, I’m trying to reassure him I just wanted to know has he committed defamation and could he get charged.

      No, he must publish it to defame

    So for example if someone tries to choke a person, and that person reacted in striking the attacker with a punch and causes damage.
    But then the instigator and attacker then says it was the opposite party that hit him. Would the instigator be prosecuted for that, or would that be self defense?

      Not sure what this has to do with defamation. But if a person is assaulted they are entitled to use reasonable force to defend themselves. The question of defamation would not arise unless there was the publishing of defamatory material, and then there are certain defences.
