Isn’t this an unnecessary issue created by the schools who had students attending the school with Hijab for several years.
They did not suddenly wear a hijab from December last year. Why did it become a suddenly problem with the school? I am not talking about Niqaab which is a covering of the face, but the scarf worn by most of these women.
I agree that Hijaab may not be considered an essential part of religious practice as not all Muslims women wear it. But it is a sensitive issue to women who have worn it for most of their lives. Isn’t it a normal practice among Hindu girls to cover their heads in their homes in front of in-laws (at least happens in the first few months after marriage).
Wearing of religious articles was a common practice in India have social approval. The Kripans and turbans are allowed to be worn as an extra conspicuous piece of fabric.
A judgment in South Africa allowed a Hindu girl to wear a nose-ring because the Court felt that preventing her from wearing the nose ring for several hours of each school day would undermine the practice and therefore constitute a significant infringement of her religious and cultural identity.
The hijab is just an extra piece of fabric that covers the hair. The State is not empowered to interfere with such rights under Article 14,19 and 25 of the Constitution.
The recent High Court judgment on Hijab was a poor quality judgment for the following reasons-
A) how is the court placed to decide Essential Religious Practices
B) the court made no effort to understand the sensitivity of the issues
C) Could not the court make some accommodation -considering that these are young girls coming from a minority community, whose members can be very orthodox and religious and see Hijab as a leeway to allow their girls to come to school. Should the court not have seen this angle?
The court should respect the views and feelings of minorities and allow dress codes that do not have any adverse effect in the school environment. The hijab does not interesting with the fundamental rights of others nor does it create an adverse effect in the environment.
It is the duty of the court to ensure that it does not curtail minority rights.
Under article 25 of the constitution, it is stated that all persons in India, subject to public order, morality, health, and other provisions:
Are equally entitled to freedom of conscience, and
Have the right to freely profess, practice and propagate religion.
Article 30 ensures that ensures the rights of minorities which should be preserved. Indian society is a mixture of various communities and its diversity is its strength. Our Constitution guarantees these rights to the minority community so that the diversity of the country is preserved and propagates their culture.
In September 2018, a judgement of the Supreme Court of India ruled that all Hindu pilgrims regardless of gender could enter the Sabrimala temple. The Constitution bench of the Supreme Court held that "any exception placed on women because of biological differences violates Article 14 and 25 of the Constitution."
We are a progressive country looking to uphold rights of LGBT community. We have even decriminalised adulterous and homosexuality.
Let the matter go to Supreme Court and let us see what happens.
