I've been in this dude's shoes. repeatedly. and while I agree that it's a disease and jail is not the right place for active addicts...what is? it's not the street, imo. I resorted to stealing, lying, cheating, to get my fix. Other addicts commit burglaries, B&E's, or bank/pharmacy/etc. robberies. They're a danger to themselves and others. Also, while one may not choose to be an addict, they choose to use. There are tools out there to help - I know because I took advantage of them. 12 step programs have a phrase "your disease is not your responsibility, but your recovery is." I support legalizing drugs across the board. Then people wouldn't have to break laws to get high (most addicts don't get high anyway, they do their drugs to avoid withdrawal). But legalization won't happen (at least anytime soon). So while I agree with you in principle, what do we do instead? I'm sure lots of people who are smarter than I am have thought about that, with no good answer. sucks.

You can't petition for someone to be released from jail. the only one who can exonerate a guilty criminal is the president (I pretty sure) secondly in this case Dave did break his parole. therefor he is guilty and I respect him for turning himself in.

He's probably not going to prison for a probation violation, he'll probably just get a sanction in the county jail. Not that I know anything about his situation that everyone else doesn't. Just saying from my personal experience.
That's not a sanction though, that happens when they terminate your probation and make you do the rest of your sentence. No PO would do that on the first violation.
It's impossible to know because different counties/POs make things much different. The important thing is that he'll probably just be in jail, very unlikely he'd go to prison for his first violation.
