SHOCKER: Judge Boyce discovers major error on Chad Daybell indictment

Minutes after the state of Idaho rested their case against Chad Daybell, District Judge Steven Boyce noticed a major error on the indictment regarding one of the murder charges in relation to JJ Vallow. He gave prosecutors two hours to come up with an argument as to what should happen.

What kind of justice is our system that would actually allow a murderer to possibly get off because of a “clerical error” that is not justice!!!

Katelyn Armstrong was released from jail because her birth date was wrong. Same day of her arrest. Then she left to Costa Rica. Dates matter, but for Chad not much.
This is what I believe:
From around the world, we all hurt and prayed hard yesterday.
To see/hear Larry's pain and confusion tore us apart.
Thank God for hearing our prayers, helping Kay & Larry and giving Judge Boyce wisdom to sort this out and come to his decision.
It's wonderful to share the love & compassion with you all. 💝

Wrong Rick, he just opened up an appeal that could set Chad & Lori free. That stupid fool should have dismissed the incorrect indictment, to save the rest of the charges,,BUT no that idiot just gave Chad an automatic appeal, that "will" be upheld by the supreme court. Shows that the judge is corrupt as the prosecutors.
No acquittal for you Chad. Denied.👨⚖

My heart sank at first. The Prosecution did very well quickly finding legal solutions. Not just one but several legal solutions. This means in the future if Daybell tries to appeal based on the issue they have multiple other options to shut him down!
It won't be reason for appeal. He will do it only because it is automatically for death penalty cases. What a relief.

Judge Boyce is a very wise man. I appreciate very much the time he took to examine and consider the prosecution's arguments, as well doing his own research. It would have been a travesty of justice to let that charge be dropped.

No kidding, we were all going out of our minds for two hours Thursday. But for some reason I knew Judge Boyce was going to do right. Very smart man. Good that you weren't aware of this on Thursday. But everything worked out.

@@kieraaaaaaaaaaI don’t think Prior did himself or Chad any favors by doing that. He clearly knew about the mistake and didn’t bring it up. If I was a juror, the date of the murders make no difference to me. The only thing that matters is that 3 innocent people lost their lives by cold blooded, cold hearted murder, all instructed by Chad Guy Daybell.
@@gsmith6026 Prior didn't know. He was playing it off like he was suave and knew but didn't say anything till the judge brought it up. Fact of the matter is that that count for JJ could have been stricken from his charges if the judge had in fact decided that way, so it could have been taken off the table completely, and the jurors wouldn't have been able to even render a verdict on that matter. Thank God Boyce didn't rule that way.

People are too quick to react. Of course there wouldn’t be an acquittal due to clerical error.
What should happen is Chad should be found guilty, death, life whatever, because some dumb ass typed something wrong that freak could get away with something??? My God he is guilty no matter what the damn typeo is, cmon, this is insane.
Defense attorneys live for technicalities. Search warrant said a yellow car when it was actually gold colored, case gets dropped after finding 100 keys of snow powder in the trunk.
Q. If someone does get off on an infuriating unjustified “technicality” can their case be re-tried or does the double jeopardy rule apply?
It would be reason for an appeal, but not too concerned us at all.

Because the jurors had complained/mentioned that the sun is blinding them, and so they draw the blinds down, and it affects the area where the defense table is.

I hope that the prosecution asks each Daybell child if they have listened to the testimonies in this case, because they are allowed to. I think they should also ask if they watched the Lori Vallow Daybell case. If they have the truth of all the evidence, I don't think they would testify for the defense. They would know what an insane monster their father is, and that he is the mastermind.
I can see Pryor using this on appeal saying that judge boys did not allow him to have a death penalty attorney next to him and he had one that would have been picked up by two minds instead of just him😊
Don't be scared to speak up and say when things are wrong. A lot of these witnesses should've reported Chad and Lori way before it ever got to this point. At least Tylee and JJ could've gone into foster care. Don't be scared to speak up. You can save lives. It's scary, you'll get bullied, but it is the right thing to do.
My question, if the court knew the dates of JJ and Tylee were transposed, why didn’t he mention it in a side bar or before the prosecution closed? It was a ‘typo’ but could it cause a mistrial. In any case glad the error was caught.
I wonder if someone is going to lose their job over this clerical error...what a mess. Just hope we don’t hear Chad's supporters claiming the entire trial was unfair and Chad is innocent. I'm LIVING for the jury to find him and his "mighty storm" guilty on all charges.

The story is so shocking to me personally. Because even as Chad dabell sets on trial for murder. Facing the death penalty, he's wearing his good church clothes as they all are I mean, Melanie.

Does anyone know know if Chads kids are attending the trial?
They can’t because they are on Prior’s witness list. They can attend after they testify. They have claimed their father didn’t commit the crime so they can’t be considered “victims”, Who are sometimes allowed to attend.

The fact that Pryor is trying to say that he based his defense on filing his motion when he never brought up the clerical error prior to any of this it took judge boys to bring up the clerical I don't think Pryor has a leg to stand on I believe if Prior would have notices and brought it up as soon as the state rested and said this instead of judge Boyce he would have a better chance of getting this acquittal on the charge. Empire can't say that because he is preparing to defend this case without bringing this clerical error up so he did not base his defense on this clerical error. And the fact that the state had not only botched the death penalty up on Lori but is now doing the same thing and Chad's case is an absolute disgusting fact that they were not having somebody proofread over proofread and making sure to double-check dates when it was the date that got Lori vios death penalty drop

Yes, we know this was from yesterday as court is not in session on the weekends (today being Saturday). People have asked in the comments at what portion of yesterday's seven-hour-plus trial this took place, and so it has been uploaded separately... just like all of the other separate uploads of witnesses in this case have been, in additional to the actual court day's proceedings.
Judge Boyce keeps impressing all of us throughout these trials. This might be his most brilliant ruling so far. Well done, Judge!👏🏻❤️👏🏻
The prosecution is doing some sterling legal work. John Prior is working hard, but his belligerent approach is no match for the state's brains trust which is schooling Prior in what it means to be a top attorney...

I'm curious if Pryor is going to let the storm Chaser CEO to move out of his bunke cell and into a room on his new property? Then they can over a game of pinochle argue where the portal is and about the stairs and also the amount of acreage? I mean let's see Chad's wife is incarcerated for life victim that he murdered is in a grave and yeah Pryor I don't think he's married either because he's got his own victims that he raped however I was able to flee down to a assault in order to not smudge this case. So they can talk about how they victimized women over a game of space that Chad can teach prior how to play since he I'm sure well in solitary has been brushing up on by himself to try to fit in when it comes to if you ever gets the population, and then hopefully when he gets the population and thinks he's playing spades somebody will come in and put a bag over his head
I must have had technical difficulties with this video. I could not hear anything and I checked multiple times for possible causes and could not find the reason.
Plays ok here. When I was in tech support our mantra was "when in doubt, reboot" YT video player volume control could be muted or turned down low, your main speakers could be muted, speaker drivers could need updating, I would always get crackling noises after my computer was up for longer than 3 or 4 days. Had to go into speaker properties and readjust output to a lower bitrate. After that no more crackling. Go figure !!
