Mahesh Jethmalani, Rajya Sabha MP & Senior Advocate, alleges 'China angle' in Hindenburg report on Adani group. He says, "In connection with the short sale of Adani shares, we have only heard of Hindenburg, they prepared the research report on the Adani group at the instance of a fund which was promoted by a couple Mark Kingdon and Anla Cheng. After research, we found that Kotak had been engaged to do the trading, so they set up an offshore account and took money from a master fund of approx 40 million belonging to this couple. This amount was used through Kotak through the Mauritius route to take large positions in Adani shares with the idea that once a negative report comes out then they will sell and move out. After research, it was found that this woman was being investigated by US Congress. It was testified against Anla Cheng that she was suspected to be a very accomplished Chinese spy...SEBI needs to inquire about this further. The motive was not only to target Adani but also to help the Chinese state...This establishes that all this was done to jeopardise India's strategic interests."
Meanwhile, a spokesperson for Kotak Mahindra Bank has said: “K-India Opportunities Fund Ltd. (KIOF) is a SEBI registered Foreign Portfolio Investor and is regulated by the Financial Services Commission of Mauritius. The Fund, was established in 2013 to enable foreign clients to invest in India. The Fund follows due KYC procedures while onboarding clients and all its investments are made in accordance with all applicable laws. We have cooperated with regulators in relation to our operations and continue to do so.
Kotak Mahindra International Limited (KMIL) and KIOF unequivocally state that Hindenburg has never been a client of the firm nor has it ever been an investor in the Fund. The Fund was never aware that Hindenburg was a partner of any of its investors. KMIL has also received a confirmation and declaration from the Fund’s investor that its investments were made as a principal and not on behalf of any other person.
