There is still time to indict Graham later on. Depending on how the RICO case goes and perhaps when a few of those indicted decide to make deals with the prosecutor and offer evidence of Graham's involvement. But the strongest testimony would be from Raffensburger and how Graham called him up. Too bad he did not make a recording of that phone conversation also.

As an Information Scientist who studies psycho-sociology, my view is that probably the prosecutor thought that charging Lindsay Graham would be “too abusive” of the state RICO statute, whereas charging the others was “not too abusive of the state RICO statute.” What this means is that the grand jury perhaps was thinking that “abusive” meant “within the purview of”. After all, if all 19 are charged under RICO, why shouldn’t everyone with an opinion be charged? The prosecution’s drawing a line says that the prosecutor agrees there is a line. So, why did they draw a line there and not elsewhere? Or not at all?
