  • The US house speaker, Mike Johnson, has said the US should 'punish the ICC and put Karim Khan back in his place' after the ICC chief prosecutor put out a request for arrest warrants for Israel's leaders over the way its army has conducted its war in Gaza.

      The US didn't sign the treaty with the ICC after WWII because it was afraid of a genocide trial for Hiroshima and Nagasaki, it had nothing to do with sovereignty. The US didn't mind participating in the Nuremburg Trials though, they were all on board for that.

Hence the indictments for both Netanyahu as well as Hamas leaders. It's perfectly within their judicial mandate, and these charges were well prepared with a lot of evidence behind it. Altough I personally feel there is a lot more evidence for the charges leveled against Israel, then there is against Hamas.

      It looks like hypocrisy, but the situation actually is different. Since the US doesn't recognize Palestine as a state, the US can't possibly recognize Palestine's accession to the Rome Statue, which is the basis of the ICC's claim to jurisdiction in Gaza. This is not an issue with Ukraine which, as a sovereign state, can choose to give the ICC jurisdiction over alleged war crimes committed on their territory. What would actually be hypocrisy would be to deny that Palestine is a state, while still acknowledging Palestine's right to grant the ICC jurisdiction in territory it claims to possess.

Apart from the IDF troops there now, PA officials wouldn't be able to set foot there without being arrested as foreign agents by the real government of Gaza, which has been Hamas. Hamas, of course, has never signed the Rome Statute. So, the ICC's claim of jurisdiction is based on one delusion stacked on top of another.

      The US was never subject to ICC jurisdiction. Under US law, international treaties have to be ratified by a 2/3 vote of the Senate to have effect. In 2000, Bill Clinton signed the Rome Statute as a gesture of support in principle, but at the same time, he expressly said that he was not submitting it for ratification in order to keep the US out of its jurisdiction until US concerns with the Statute were resolved. They were never resolved, the US Senate never ratified the treaty, and in 2002 the US signature was formally withdrawn.

    In 2016, the Hague ruled that China's "nine-dash line" in the South China Sea had no legal basis. When China disrepsected this ruling and continued to assert the nine-dash line as their legitimate claim over the South China Sea, they were branded as "disrespecting international order."
    Funny how when a very similar thing happens to Israel, suddenly this is no longer and issue about "international order," but rather an issue about "national sovereignty."
    Also, it's very strange to admit that American leaders would be the next to be targeted by the ICC if we recognized the legitimacy of their arrest warrants against Israeli leaders.
