**Correction: It was item CA (property tag #7927) not item BY that was sent directly from Culhane to FBI.
Either way it’s an item found by Pevytoe and Sturdivant, inside the same tarp with BZ, that’s not given to Eisenberg and sent straight to FBI.

short brief, mostly direct and to the point. i guess it's not reasonable for zellner to have included the various alleged brady violations in there, but they certainly play a role as well; you can't have the velle cds being withheld, the improper turning over of bone evidence, etc, along with the absolute screwjob that mtso did by not documenting anything along the way, the lab contamination by sherry c, plus the swabs of steven's groin, the disappearance of this 'blunt and bloody object', the complete lack of bone fragements or other soft tissue on item fl, the apparent willingness of law enforcement and prosecution to withhold exculpatory evidence, plus the bs politics of having to ask, repeatedly, for years, on foia requests for phone calls, and think with all of that there isn't some impropriety going on behind the scenes. i expect the court to drag their ass, as they are want to do, because they know as well as we do that those mfers have screwed the pooch, and they continue to rule against steven because it's in their own interest to do so. maybe next year they'll issue a ruling, probably against steven, because that's the only thing they know how to do, rather than pursue actual justice, meaning zellner will have to appeal, again, to a higher court, extending things out even longer. it's all bullshit. the court has its predetermined outcome already plotted out long ago, and short of these judges getting voted out, i expect more of the same. wisconsin voters are at fault here as much as anyone else; this is what you get when you elect assholes.

Maybe this was said in the live and I missed it, but what Eisenberg testified to in court was not what she had in her notes. She either had to edit her notes or testify to what is in her notes.
Also its ridiculous WI continues to act obtuse, with Zellner having to explain the law to them. Unconscionable.
I love listening along while I work. I try to make it to the lives, but it doesn't always pan out.

What were the "instructions" for the 5-6 guys that were helping with the sifting? Were they ONLY looking for BONES to put in the box? And ANYTHING ELSE goes into the tarp, hence the muscle tissue and rivets and whatever else ended up in the tarp?
This is what Ertl stated in his trial testimony "The
other officers and Chuck Cates were there picking
through the materials. Quite often they would
ask me, does this look like a bone. I said, if
there's any question, put it in the box."
The big issue is, in Item BZ, there was a large bone fragment and muscle tissue that would not have gone through the sifter.
@drsilkman oh yeah I totally get that BZ that had muscle tissue on the bone should have definitely went into the box. The other piece of the muscle tissue wouldn't have been put in the box if they were instructed to put BONE in the box.
Hats off to Duke! Totally impressed with the work he put into the "burn pit"! I think BZ came from the quarry. The whole team has done AMAZING WORK! 🎉🎉🎉

I was late joining last night and got busy afterwards. I am just catching up today. Great podcast. I don’t have to much faith in the COA, although I came dream they will do the right thing! KZ has shown many flaws in this case. IMO, Fallon came back because of the possibility of an evidentiary hearing.
If Fallon is back, it's serious for State.
