    Clay, I never told ya but I had hlr that was amazing. The lady after hearing everything called me back 10 min after hlr to tell me of new regulations for previous claims (looked through records) since I am at 94. She also listened to claim argument to see if it made sense or had chance to see if I should file supplemental or let it go, it was hlr of hlr she went above and beyond.

    I hope my suggestion will get to the secretary Mr. McDonough. It would be nice if veterans could go to patience first, urgent care, community care or a doctor that he/ she chooses.It seems like the deck is stacked against the veteran walking through the door. Optum/LHI get a cut off the money than they subcontract to a Nnurse Practitioner, I think this way would save time and money. The DBQ could run though a database and tell the rater within minutes whether a veteran claims is denied or granted, and it would be coming from a neutral party. I have one more thing to add, how much is a C&P exam? I’m curious as to how much money is being spent weekly,monthly and yearly, because someone is getting rich off C&P exams wether its Optum/LHI or Nurse Practitioner or both.
    Sincerely yours
    Veteran

    I filed last year 17 May for Camp Lejeune Toxic water situation. I have one of the presumptive diseases listed. I did a C&P exam 4 months ago and the VA got the DBQ 10 days later. Now as of the 25th of April 2024 I see a TERA memo added and another C&P requested. Is a TERA memo good or bad? I'm wondering if I should go ahead and contact one of these law firms pushing representation through the PACT Act. and go that route. I only have until August 2024 to file with them.

    I recently got bumped to 70 percent for mental health. I also submitted an intent to file as a backup that expires in November. I already paid for a vocational expert for tdiu which was my initial strategy. I won't be able to submit it for another 6 months as I'm waiting for my c file. By the time I get my tdiu submitted and hopefully approved I will have almost 20k in back pay if I'm approved. With the upcoming changes coming up for mental health ratings (I would most likely get bumped to 100 percent but lose the back pay). Which path do you recommend...tdiu or
    A rating by scheduler? I'm 66 yoa

    I Clay, I was denied a CUE claim for SMC-s. The decision letter stated that a veteran cannot appeal a HLR with a HLR. Can I appeal the CUE claim with a supplemental claim with additional evidence?

    hey clay, it’s rick, i’m currently receiving 100% p%t. i have a 10% rating for migraines, retired in ‘13 but been receiving botix treatments since 2008, should i risk my 100 PnT by trying to increase my migraine rating or just leave it alone?

    • @TheCivDiv
      @TheCivDiv  Před měsícem

      No reason unless you see that migraine rating granting SMC which from my point of view, that's a no. Meaning...don't sweat it.

    Hi Clay. I’m filing for the first time and all my doctor visits are from a private hospitals. My service medical record is also with me. Does VA need my records even from outside or can I just file for compensation now? Thanks!

      If there is evidence supporting your claim from the private side of the house, then YOU are going to want to submit those.

    Hey Clay, right now I'm dealing with colon cancer with ZERO family history. I was aboard CV-42 (1977) for her last cruise. She had a lot of Jet fuel in the freshwater drink/shower. I also have Barrets can you connect the two? C-File find a VSO that can access VA files and find out what's in there. I waited almost a year and it was whole pages.

      Brother you need to aggressively pursue that. Jet fuel in the water is horrible.

    Hey,
    I have been out the Air Force for over 20 years. I know I went to medical for my back and I was discharged with depression. I haven’t had a MH C&P. I did have my C&P exam for my lower back pain and the provider saw all my records I brought in for my back condition and they asked me if I was okay with doing the physical aspect of my C&P. I stated I was ready to do it, and was combated with it will not hurt my claim in anyway if I said I’d rather not, for fear to aggravate my back conditions. Was that a good move, is that okay? Because I took their advice and opted not to do the range of motion. In my defense I brought records from pain management, PCP, MRIs, etc. just not be part of the “No Evidence” group. What do you think my chances are? I did my first claim for tinnitus, migraines, back pain, neck pain, radiculopathy on all four extremities, and depression.
    Thank you

    • @TheCivDiv
      @TheCivDiv  Před měsícem +1

      I can’t comment on your chances or really anything else but to be honest, I wouldn’t sweat it. It seems like your examiner was a good one. You have evidence from service, I assume you have a current diagnosis. That’s more than most.
