      They don't all dress in suits. You watch to much TV. They are doing field work. Just like cops dont always wear Uniforms especially especially undercover top cops and a lot of times even detectives don't wear uniforms. I know because I used to have a lot of friends that were police officers somewhere undercover And I'd never seen them in a uniform.

      And an FBI agent serving you papers is not the same as an undercover police officer.
      There are reasons for police officers to wear uniforms, though. Just like there are reasons for detectives and federal agents to dress up more than casual (or grade school casual, in her case) with badges hanging from their necks or on their belts. And that's the point a lot of people are making here.

    There’s no way the FBI genuinely thought you were going to maliciously retaliate against EAFB. They simply wanted to intimidate and frighten you by showing “we know who you are, we know where you live, don’t cross us” which is sickening.

      How about it's not normal to go to an airforce base dressed like Chewbacca while taking pictures and intentionally causing problems when questioned. That's why they came to see him. It's a security issue and if they didn't and he went back and shot the place up the narrative would be you knew and did nothing. That's how things work today, you act nutty at military bases, airports or schools you get a visit.

You can't be naive enough to fail to consider that a person doing this might have nafarious motives leading law enforcement to question the intentions. Im down with not violating peoples rights. Im not down with intentionally doing shit to antagonize law enforcement for the sole purpose of making a video. If someone came and parked their car outside your house and started filming you, your kids, your wife, your vehicles im sure you would call the cops. Also if you were having a disagreement with your neighbor and another neighbor came over and started filming you two arguing you wouldn't be happy.

    My experience with federal agents: they travelled to 4 states to threaten friends of mine for incriminating information. It failed. And I won my lawsuit against them for robbing me.

      The reason they drove two hundred miles was because they were the closest field office for that area and they couldn't just call because that had to have visual confirmation as well as the correct name, that's why they asked for ID and wanted verbal confirmation.

    In case you didn't catch it, he is a US Marshal working for the Justice Department, she is the FBI agent. That is why she described herself the way she did. He didn't disclose he was a US Marshal, he claimed to be FBI out of Bakersfield. He did mention later that they work in a task force, so it is probably a joint jurisdiction task force. However, he probably shouldn't be telling people he's with the FBI when in fact he is with the Justice Department and is a US Marshal.

      The credentials he shows are FBI credentials that state he is a special deputy US marshal. Special deputy marshals are not the same regular deputy marshals. They are essentially task force officers for the USMS from local/state departments. So he's a task force officer of USMS acting as a task force officer for the FBI. Considering he's showing FBI credentials, on FBI business, and how complicated the situation is, I think he picked the right option.

      It's a part of the process. It's because he did and admitted because he was caught to trespassing on a base which is why they are doing this. They have to do this as a part of the process. I mean think about it like this, how would you feel if you heard a terrorist killed people on an air force base after he had been caught trespassing and no one had investigated pass that initial arrest or escort out.

I did not question the process. I made a simple comment that if they did not think he had nefarious intent, they would not go all that way. Unless it was for intimidation. In other words...."we are watching you"!

    If there was a citation issued on a federal facility (military poiice) and that citation generated a "review for terrorist intention" notice - the FBI, via Homeland Security, is the investigating authority per US Code. There is no local or state LEA notification required.
    This visit, in essence, was the Air Force, via the FBI, saying "... we watched you watch us..." . I would say his license plate is on a watch if on base list now due to the citation.
    Many may not agree with this particular tactic (the FBI visit) - but as a former military person, I can avow this happens quite often in relation to military security issues. Especially when people, even military, are sighted taking pictures on military bases, cruising on a look-see, etc.

    Hi Johnny from Santa Barbara, I am a big fan of that library audit you did here and in the Santa Barbara Independent they wrote that 99% of the calls to get you out of jail were from out of town, so that makes me the 1% because I called and I live a block away from the jail.
    I have been inappropriately banned from my channel of late because I uploaded a live stream that had 5 trolls torture me for about 8 hours . Somehow the trolls got the video taken down and the YT Studio phone number , along with the Google 24/7 Live operator is a fraudulent number, has been for 3 years, I made the calls every weekend. Got any journalistic advice about how I might go about this ? What is my legal recourse? It’s an obvious mistake they could fix if they answered the phone.

    When serving at George AFB, not far from Edward's AFB we had spy's who along with Aircraft admirers would sit on local roads at the end of our flight line and document tail numbers of F4 phantoms as they took off on training missions. Thier object was to try judging our mission readiness and abilities to turn jet's. Most of the civilians who did this were known but it is in our interest to know who's watching and why. I don't know why this gentleman and his wife are so aggravated? For me it raises an eyebrow about his motivation for filming however he also may just be a guy who thinks he should do whatever he likes unquestioned.

    Johnny 5-0 (JF0), I served in the military (20+years) ; If you were on a Military Installation, then they can the detain you, BUT if you did not know you were on the Military Installation then they can kick you off. If you refuse, they can Trespass you and transfer you to the local Police, to be removed. THAT is a big IF you committed a crime on the Military Base. If they say you're on Military property (have them show you the Line) If you are just outside of the line of demarcation, mostly painted Blue, Thats the line of the property. ** this is Important to understand** the laws on your side here: The law Posse Comitatus and Martial Law **read it** Bottom line up front (BLUF) the Security Force (Air Force SF) and the Military Police (Army MP's) (also includes the Navy, and Marines. CAN NOT enforce laws off base. Even if they enforce the same State and federal laws on post. If you're on base and commit a crime they can DETAIN you and transfer you the local Feds or COPS. But they can NOT do anything to you unless you committed a crime. Funny how the Works. The law was written a long time ago.
    The Posse Comitatus Act of 1878 prohibits the use of U.S. military forces to perform the tasks of civilian law enforcement such as arrest, apprehension, interrogation, and detention unless explicitly authorized by Congress. The Posse Comitatus Act, signed into law by President Rutherford B. Hayes on June 18, 1878, limits the power of the federal government in the use of federal military personnel to enforce U.S. laws and domestic policies within the borders of the United States.     It’s incredible that an American citizen gets cited for videoing outside a U.S. military base and yet…
    Having spent 24 years in the AF, I witnessed protesters yelling through megaphones just outside the base every year on the anniversary of the atomic bomb dropped on Nagasaki and Hiroshima. The protesters were always non-violent but they were loud and annoying. As military troops, we were commanded by our superiors to not confront the protesters nor in any way disrupt their protest; as it should be of course. They had every right to protest and I never saw any civilian or military police question them/ask for IDs/etc yet a man with a camera simply recording what he can see from a public sidewalk gets confronted, harassed, detained, cited by law enforcement and even questioned by the FBI.

    Honestly I feel like this was handled pretty well on both side. Short, quick and to the point. Was it a waste of time for the FBI to come out? Yes. Did the FBI have to get involved? No. But with all that being said, I like how direct they were.

      well, tbf, it was only a waste of time by the fbi because the guy they were visiting was a legitimate regular dude. if that quick follow up had yielded something different it would have been worthwhile, but you don't the outcome ahead of time, so you check. that's its really. seemed like no big deal.

      I have a feeling it was as important for them to see John as it was to ask the question. If he looked or behaved like Ted Kaczynski or something, I believe their opinion would have been different. Have you noticed anyone following you around lately? The military has had some strange encounters, as the FBI has also. While someone may believe this was about one question, there was more to it than that.

    If they wanted to use your answer in any legal proceeding had they gotten a positive response, they would need to have been specific and actually used a sentence that would be clear enough to survive a defense attorney's questioning. What he should have said was, "While you were at Edwards Air Force base did you have any intentions of doing harm to anybody?" He accepts a simple, "No" to a convoluted statement."We just want to make sure that while you were there filming, okay, you don't have any intentions of doing any harm to anybody at Edwards Air Force Base or anything like that." You could have meant "Not, while I was filming" or "I wasn't filming" or "I don't have any intentions to do harm any longer (he used don't instead of didn't), but I did then." What a waste of time and money to send them all that way for such a pointless almost question.

      No, he wasn't, the JAG would prefer the charge, and then hand that over to the US Attorneys Office for disposition and handling. That's how it works. It's not about who does the prosecution, it's about who STARTS the proceedings. Since the USAF is the aggrieved party, they are the ones that initiated proceedings. It is up to the US Attorney's office, US DOJ, to handle it from there. This isn't mysterious or secret in any way.

I'm all for people knowing the rights, but you better be careful on federal property. Getting prosecuted federally is a big deal and not something you want to be involved with if possible. They will break you financially. If they want to make an example of you the results won't be pretty. You cannot fight them very easily.
