Not supposed to take it because itâs illegal to be in possession of A. Someone elseâs real ID and B. Of any fake ID, even if it was âconfiscatedâ Taking it opens you up to a third degree felony charge. I used to oversee a lot of convenience stores that sold alcohol, one of the employees in my district confiscated an ID after believing it was fake, he ended up in jail for a year, with a $5k fine and a felony record over it.
