    It is absolutely *FUCKING CRIMINAL* that protective orders don’t prohibit both parties from contacting, harassing, smearing each other. Cause people get entrapped into reactive abuse all the time. Then they get PFA’s filed on them. Then the abuser/plaintiff INTENTIONALLY HARASSES AND ANTAGONIZES the defendant to antagonize them into breaking the order or protecting themselves.

    It should be on both people because to many people abuse the power of it and try everything they can to get the other person to slip up to benefit them. I myself have been going through something like this unfortunately.

    The victims in my case harass me until i am triggered and then use it against me. It works so it is apparently allowed. They live next door.

    But the defendant could appeal to the court and have the ruling vacated or terminated, correct?

    Hi Lance, I am the alleged victim in a DV case. There was a post judgement protective order 3 years no contact. I never wanted a protective order. Its been 7 months since the incident and the no contact order has been respected by both parties. I'm so frustrated. Is it possible I can request a modification so that peaceful contact is allowed?

      @Taylor: Thank you for the question. It would be best to reach out to the Defendant's defense attorney to find out what is common in the court in question. If there is an actual post-conviction no-contact order, as opposed to just a condition of sentence, it may be easier to get your request in front of a judge. If you happen to be in Washington State, feel free to call our office on Monday and mention CZcams to make sure our intake person gets you in our message queue. It is very frustrating indeed. Thanks for watching!

    QUESTION. Is a restraining order only valid in the state of issue? Could both parties cross state lines and have contact?

    • @TheLanceLawyers
      @TheLanceLawyers  Před rokem +1

      @billy bob: Most states, if not all, have provisions to enforce orders from other states. So, you can be arrested for violating a "foreign" protection order in WA state if the order is issued in another state. Each state may have different laws, but better to be safe. Thanks for watching!

    Could I Go Visit The defendant while in jail ? If the order of protection has expired ?

      @Arii DaDon: If there is no order, or condition of sentence, restricting the Defendant from contacting you, you may be able to. We cannot say for sure though. Make sure to check with the Defendant's attorney as they will know about the case. Thank you for watching.

    Certainly, the defendant has to decline answering any phone calls or responding to any texts. The distinction would be that the defendant in a DV case must typically surrender or transfer firearms. Obviously, a purported DV victim shouldnt be disarned against his/her wishes.
