    Comedian Jordan Shanks has apologised to John Barilaro and will pay $100,000 in costs as part of a settlement deal in the defamation case brought by the former deputy premier over a series of videos he claimed were “vile and racist”.
    In the federal court on Friday Shanks’ lawyer, Matthew Collins QC, read a statement to the court on behalf of his client, who uses the nom de plume Friendlyjordies in his popular CZcams videos, conceding the videos at the centre of the case were “offensive” and apologising.

    Well Jordies has railed against (among others) Bruz, Gladys, and Fuller. And now all three have quit. I'm not saying Jordies was responsible, but hell if he wasn't a part of it. Pretty much the three most powerful positions in NSW and they've all disappeared within a month or two.

    Barilaro said in parliament that his name was Pork Barilaro and when Jordies repeated what he said that triggered a lawsuit. What planet is he on he would not get much money for that even if he won using parlimentary privilege as he did say it.

    For a politician to be able to hide behind parliamentary privilege in cases like this can only lead to more corruption. I COMPLETELY disagree with this judges decision here because it sets a terrible precedent for cases in the future. No one in Australia should be above the law and no one in public office should be above scrutiny, the judge basically said that Barilaro is! 😡

    As you said, it's kind of a good law but the decision as to whether the privilege protections should be waivered should not be decided by the plaintiff or the defendant. It should be decided upon by an unbiased third party arbitrator. As this case has shown, giving Barilaro the option to call upon those protections while simultaneously suing someone for something its obvious he said demonstrates that this law/protection is ripe for abuse.

      Seems like it would just be easier to have a clause that waives the privilege if the politician themselves brings the action, third party arbitration would be likely be expensive and still controversial (think of the shit ICAC gets whenever it does anything, let alone how difficult it is to establish true independence in the first place)

      I think it would make more sense if it only applies when the politician is the defendant (and if it's not a criminal case). Applying it at any point when the politician is the one suing is absurd.

    someone tried to argue with me that it was a draw. I just said "no, a draw would be Jordan having to shut down his CZcams account, his gf dumps him, the general public turn on him to the point he has to move to dubbo"
    as you said Jordan lost 3 things. 1.5 of which don't matter. can't sell merch. ok but everyone that bought it already has it so it really isn't a big deal.
    I will say the edits are a .5 loss because it does suck that the videos have to be edited at all, but knowing how the internet works I'm sure the unedited video will end up on CZcams and I have a strong feeling that Jordan isn't going to be in too much of a rush to have them take it down :)
    finally you have the one real loss and that was the public apology, but even then as far as public apologies go it was it wasn't even him saying "im sorry about the things i said". it was him "in sorry the things I said made you upset" that's the cunts apology for getting around actually having to say he is actually sorry. I'm not sorry I said it, I'm just sorry that it made you feel bad lol. I would say this is johns biggest win because at least in public record it technically is an apology and the way the media spun it without showing said apology to the outsider person might see it as John being a "good guy" and letting it go after jordan learnt his lesson.
    now, while that person is out there and I do believe some people are that narrative up based on how the media tried to spin the 100k bill like he had to pay that to John in damages. the reality is those people don't matter because they clearly aren't politically engaged. they work their jobs and they have other shit going on. but anyone slightly engaged e.g. watching this video or actually read the apology statement/article you would know John has lost pretty much everything and Jordan is not only bigger then he has ever been. but he can legit take some credit for removing the 2 most powerful people in the state.
    the narrative is already set and as much as the MSM want to somehow spin it the reality is guys like you, butterfield, Phil Defranco, Neil are all telling these younger people what actually happened and the difference is you are all well liked/trusted so over time your voices are going to shape the narrivate way more then one tiny press release ever could.

    Easy way to fix the law. Parliamentary privilege still exists, but can't be used by a plaintiff/complainant as evidence to bring forth a civil suit. But does not extend to a defendant/respondent as evidence to bring forth a defence. Nor should it extend to evidence in any criminal proceeding.

    Parliamentary privilege is designed to prevent politicians being sued for the things they say. In this case J.B. is the plaintiff, so it could be argued that Parliamentary privilege shouldn't apply.

    It's absolutely insane that a politician can sue someone and that person cannot use what the politician has said in their own defence as it was said under parliamentary privilege.
    That really needs to change, i support politicians not being able to be sued as it could really cause some serious issues in how parliament functions, bit when it's them instigating the legal action then all the cards should be on the table.

    I feel like they could have argued that if what John said in Parliament isn't able to be used in court, then Jordan should have been able to argue that what he said on his channel couldn't be used against him. Because they could say that both of them said things while at work that was completely separate from their personal opinions.
