    Darian, I got the RFI after my spouse contacted uscis , I signed a waiver and sent the pending divorce documents , it shows received and transferred to a different office , is it safe to travel out the USA ? ( fyi I have the 48 month letter extension of my green card ) please advise

    What about filing I-751 with abuse waiver? I also need to be fully divorced to obtain my 10-year Green Card?

    This is my particular case, I have to send the form filled in 40 days but I am just starting my divorce I have gathered proof that the marriage was entered in good faith but I know that getting the certificate of divorce will take a while, what is the proper way to act ?

    Got married to Us citizen 2019, both attended interview,, 2021 we both got separated after few months of that we got intent to deny letter, replied with joint bills, statements and joint taxes.. will they deny it and deport me ? Should i get divorce? Should i inform uscis or just withdraw my i485? Now i living with another girl.. thinking to get married with her

    I have a pending i751, i got my final divorce decree one week ago, what shoud i do un this situation?
    We filed joint i751 together and she didn't call the immigration .

      You should call my office so that I can assist you with this. If you don't want to use a lawyer then you need to submit a new I-751 to USCIS with your divorce certificate and evidence of good faith marriage.

    And if you applied for asylum because of religious persecution and police harassment, does it have a statute of limitations?

      Statute of limitations refers to criminal conduct. Are you asking whether asylee status expires after you are granted asylum?

      @@DarianLaw I asked whether it matters how much time has passed since the incident of the investigation, and don't you get a green card in a year or does the asylum status really play a role then
      But I understand that the most likely thing is to try to get a work visa, it's a pity I have no relatives in USA, so some programs are not possible

      @@misterfox3016 It depends on the situation. The amount of time that passes can matter because it can be used to show that you were able to safely live in your country for years after the persecution began. But sometimes you're living for years in hiding/fear, and you eventually decide to leave. Other times it takes you years of saving money and hiding before you can finally esape the persecution - I've seen people leave years later who are granted asylum. It all depends on the exact situation.

    What if the immigrant spouse has green card error meaning she got permanent. Instead of conditional and she doesn’t want to remove conditions on conditional green card what happens?

      That's a really bad idea. She should still apply to remove conditions, because she can be placed into deportation proceedings in the future (especially when she applies for naturalization).

      @@DarianLaw but doesn’t the Conditions expire in 2 years if she doesn’t apply for that, which also means she starts unlawful presence right

    If I am completely divorced and get an extension to work and travel I-751 notice, How safe is it to travel outside the country with it ?

      If you properly amended your I-751 and submitted your divorce certificate and everything was done properly then you are still a permanent resident and can travel while the I-751 is pending. The only other things that can affect re-entry are crimes.

    If the orginal extension expires before everything is resolved, is another extension automatic?

      No, you have to schedule an infopass appointment with USCIS to get a 1-year extension stamp.
