  • The Phillippines and the US are in the midst of joint military exercises near the South China Sea and Taiwan, sparking anger from Beijing. This year’s war games are taking place at a time of increasingly strained relations between China and the Philippines. Maritime encounters between the countries have become more frequent, with China’s recurring use of water cannons damaging Philippine boats. Why are tensions escalating almost two years into Ferdinand Marcos Jr.’s presidency? And what are the implications for the US and the rest of the world?

As a supposedly prestigious publication, you should know that no international court awarded anything to the Philippines over the South Chiina Sea.
It was an arbitration panel, attended only by the Philippines, that made the award. And an arbitration panel has no jurisdiction to rule on anything unless the parties agree to submit to its jurisdiction, and China had not.

The Arbitral Award is not a PCA ruling. It is an UNCLOS ruling. China has a right not to participate in the proceedings. Even without China’s participation, the Tribunal considered China’s position and claims, and made sure that the Philippines’ claimsare well founded in fact and law. On the other hand, China has an obligation to accept the final and binding ruling. Under UNCLOS, China’s non-participation is allowed, but non-acceptance is not.

The Permanent Court of Arbitration (PCA) is a non-UN intergovernmental organization headquartered at the Peace Palace, in The Hague, Netherlands. The South China Sea is a misnomer because it was named so by a British adventurer in Borneo many centuries ago. The prehistoric peoples who crisscrossed the South China the most were the natives of the Sri Vijayan Empire, which stretch from Indonesia and Malaya, through Borneo, the south of Vietnam and the central islands of the Philippines. The South China Sea should more aptly be named the Southeast Asia Sea.

I think Taiwan's claim to the SCS is related to the One-China policy - if Taiwan rescinds its claims, China will probably interpret it as a pro-independence move, going against the One China policy. This is also the reason why even today Taiwan claims not only Mainland China, but the whole of Mongolia as well as parts of countries which border modern-day China. Hence why no one really mentions it. Although it's interesting to note that Taiwan also has an outpost on the Spratlys, which I find interesting too.
Arguably, this whole problem exists because of the KMT, which used to rule mainland China and are now based in Taiwan. The KMT Government were the first to publish the 11-dash line (note the map in the video which you're referring to) before the Communists reduced it to remove claims from the Gulf of Tonkin.

Article 55 of the United Nations Convention on the Law of the Sea signed on Dec. 10, 1982. We are not talking about the entire South China Sea here. There are many reefs and shoals in the South China Sea that many countries want to own, but Ayungin or Second Thomas Shoal should be beyond dispute. Do you know who was one of the first countries to sign the United Nations Convention on the Law of the Sea (UNCLOS) in 1982? China was one of the first to sign! It's a little bit trickier than Ukraine, as the US does have mutual defense agreement with the Philippines and it's a long standing one at that. Unlike with Ukraine, the US does have actual ratified responsibility to commit to the defense of the Philippines if it gets attacked. Having said that, the US is not a signatory to UNCLOS and they can simply back out of the issue or put pressure on the Philippines to drop its claims in case they reach a more favorable relationship with China. The Philippines could've played a bit harder to get and played both sides instead of instantly committing to give rimjobs to the US once their new president took over. China could've also done a better job when they had a chance with the more China friendly Duterte, now they are encircled. If they played the long game, they could've been the ones with bases in the Philippines instead of the US. Amateur hour from China tbh.

The territory of the Philippines was defined by the Treaty of Paris and the Treaty of the Philippine Territory and Cutoff, signed in Paris in 1898 and 1900 between the United States and Spain. Philippine territory was further defined when the United States signed the final treaty with Britain in 1930 known as the Boundaries/Washington Declaration. The 1898 Treaty of Paris signed by the Americans and Spanish made it clear that the western boundary of the Philippine Islands did not include the Spratly Islands. The United States gave Philippine independence to the Filipinos in 1946. Lagging? That's funny Chinese bot. Vietnam has likely reached its peak whilst the Philippines is still peaking. And there is one primary statistic you have to look at: population growth. It has a healthy (not too much, not too little) population growth and its GDP growth is higher than Vietnam. The only advantage Vietnam has is sharing a landmass with China making it easier to access the gargantuan Chinese supply-chain. But that is unraveling now. In the next 10 years, made in China is no longer the norm. And skillfully you said? Vietnam was blowing up Chinese ships. The Philippines does not. Instead, it uses its soft-power to bring the world against China. It's hilarious to see a much weaker country put China in its place diplomatically. People think that The Philippines is like Ukraine. No, we are in a much better position. China will implode before it can even fire its first shot.

That was under the auspice of the Allies, i.e., the U.S., after winning WW2 against the Japanese, who occupied all those islands. In fact some of the warships used to put the markers on the islands were U.S. The People's Republic of China, or PRC, inherited these claims after winning the civil war, and the ROC retreated to Taiwan.
