  • Are you downsizing and need to get out of your home lease agreement with your landlord? If so, I give you a 3-step approach to breaking your house lease agreement. During an economic crisis, the tenant landlord relationship can be tense, especially when you can’t pay rent and don’t know what to do. Have you ever thought “What if I can't pay rent? I have no money for rent and can’t pay my bills.” Maybe you were laid off, got fired, or otherwise lost your job. “I got fired - now what?” Now is the time to negotiate with your landlord and get out of your home lease.       @@iancorzine Please help me, I signed a 1 yr. lease on Jan. 15th 2021 and had to move out Feb. 6th ( not even 30 days later!) due to constant harassment by the next door neighbors, they would get drunk and bang on my walls to scare and harass me at 4am and even rammed his car into my bedroom wall with my head against that same wall his car could have crashed through and killed me and threatened me verbally and other neighbors as well and I ended up in the hospital due to the stress and I called and left voicemails etc for the landlord and he did nothing to help me and he is refusing to return any of my $3500 cash I gave him! it was $1675 rent plus $1500 security deposit and $400 dog deposit for my 2 dogs so almost $3500 and he will not refund me anything. Cant I use breach of peace or covenant of quite enjoyment? What form do I need to get? Please help me this is the 1st time I have even signed a rental lease in my life and I had to because my husband of 28 yrs. left me last year in March for a 34 yr old and filed for divorce so I am so lost and now homeless

      @@iancorzine i newly move-in in a paying guest and my problem is that I want to move out eary but the agreement I signed states 'if i move out before completion of 1year, I will lose my security deposit.

      2 days ago my landlord tricked me into signing a year long lease when he had agreed on a month to month lease. I really only saw MOMTH TO MONTH at the top & went by his word. After signing, he said we don’t do month to month here. He LIED to me & trapped me.

    Here’s what worked in my past. Ask a friend who’s out of state to send you a letter on their letter head saying you got a new job out of state and have to leave. Most leases will let you get out. Check your state. On this one. These landlords are greedy as hell.

    As a landlord, I want to thank you for the video. This is a proper way to address the issue that leaves all parties in a good position. As a landlord, I would be open to find a new tenant to sign a new lease so that you didn't have to pay the $300.00 gap.
    As long as we can find an acceptable tenant at the same rent rate.

    Good advice! I’m stuck in a similar situation. Only problem I have is I’m in a tenancy agreement and the two room mates I’m in the tenancy agreement with won’t accept any of the people I find to replace me just to be difficult 😤 I wouldn’t wish this on anyone!

      really wish that leases had a 30 day grace period to get out without repercussions aside from moving fees and stress for roommate reasons/stuff that there's no way you would've known about on a tour. I've been forced to move from some nicer places (and I was the one with all the furniture and shared stuff) because of psychotic roommates...and had to really just suffer the whole year.

    Don't have any rent for over 20 years now. Here in Quebec, it's well known that you can 'break' your lease this way... But awesome info Ian!

    Does this apply to Arizona law as well, when dealing directly with landlords with a 6month lease? I was unaware of the $200 untilities that was not included in the contract. I feel like I’m being played because between me and another Roomate we’re paying the whole mortgage.

    In my situation right now we had a rental agreement with the owner that we paid on the end of each month and then she sold the property to new owners and me and my friend are planning on moving out before the end of this month but the new owner says that technically we have to pay on the 1st but she said she wanted to have rent on the 20th but we never signed a rental agreement with her about that so me and my friend are goin off of the last owners agreement so if we were moved out before the end of this month would we have to pay

    Please I need answers! Does the landlord agree to break the lease if my place is molded and overall it’s not a capable “living environment “ ? I have sent emails and pictures and these people don’t fix anything. So I will go confront the landlord to break my lease early but do I have more of an edge ?

    So do you have to stay in the property until a new tenant signs the lease. That’s per the original lease agreement. And after that are you responsible for the new tenant’s actions, meaning if they don’t pay the rent is that going to come and Vite you in the future even though you had nothing to do with finding new tenant?

    Hi! May somebody help me? I need to break my lease because there is a cockroach infestation in my apartment since I moved! It's really disgusting! The cockroach are everywhere and next month my grandchildren will born, I can't have a baby here! I just talked a lot of times with the office about and they did nothing! At the complex site people comments say about the infestation and they do nothing! Please what can I do? They say I need to pay to move but I don't think this is right!

    Hello Sir, some of it is a good idea not all, like finding a new tenant which is not your responsibility, who is a friend will be will be unusual to say the least. And where you will pay his $300.00 rent that is due, isn't that putting the same burden on you for moving to a cheaper place in the first place. you are back where you started, will you be leaving your security deposit for the the new tenant, or will the new tenant put down his own deposit, if he has to put a deposit don't you think he should pay his own $300.00 rent? Only if you"re renting an efficiency that now a days cost $1200.00 plus your $300.00 to pay his rent then where's your savings? People read the contract first, then sign it. Make sure people before signing a lease take it home, or to a lawyer and don't sign the lease that day, unless both of you make sure you can get out of the lease with one month's notice.

    HEY I HAVE A QUESTION I JUST SING MY LEASE LAST DICIEMBRE NOW BC THE AC GET BROKEN AND NEED TO REPLACED FOR A NEW ONE HE DECIDE TO ENDING MY LEASE BC REPLACE FOR A NEW AC UNIT HE GIVE ME 30 DAYS TO MOVE OUT PAY ME $2000'00 I DONT THINK THIS IS RIGHT IM NOT READY YO MOVE OUT WHAT TO DO @ THIS CASE I DONT WANNA MOVE OUT (I FEEL HE WANT ME OUT BC THE AC IS BOKEN HE FEELS DONT MAKE MONEY WITH ME IN BC THE AC BROKEN HE CANT BRAKE THE LEASE LIKE THIS WITH NOT REASON I'M ALWAYS PAY MY RENT ON TIME DO I NEED A LAWYER??

    What if your lease says absolutely no sub-leasing. What is a good way to break your lease not just for the covid, but a lot of other reasons. Please advise I really want out.

      Hey Anna. I hear you and what you’re going through is hard. Anything is negotiable. You have to figure out your leverage first. Does the landlord want an unhappy tenant? Is your term nearly up and, in these uncertain times, with the landlord like a longer-term lease? Once you have that, you need to come up with a plan that could put your landlord in as good a position as possible which is in alignment with your desire to get out of the lease. So, like in the video, you could substitute someone else for yourself. Or you could offer to leave the the lease early so that the landlord can lock down another tenant for a longer-term. You could ask if the landlord has any less expensive properties to lease that you could take over. Never give up. Words on a page can be changed by mutual agreement.

    What if you find subletters, but your landlord doesn't process their application for three weeks (but then approves them) but they sign somewhere else because the application was taking too long?

    Question for you- I’m considering moving into a place now even though I’m without a job at the moment. The leasing company is requesting double deposit ($1800). I have a high credit score & they’ve seen a copy of my bank statements knowing I have sufficient funds. It feels weird, almost racist but I don’t want to jump to conclusions. Is this legit? Paying a double deposit? They knew I was in between jobs before I even saw the property. Should I just cut my loses & look at another property?

    Hi, I share a lease with my roommate and we've lived in the apartment together 4 years although I had lived at same apartment since Jan of 2012. I had accepted to share my apartment with my friend (the current roommate) in July of 2017. Now I want to search for an apartment for myself and not have any roommates. I feel Im done with roommates. I've learned that having a roommate is a mistake. I had asked my landlord if our apartment is month to month rent since we have not signed a new lease over a year now and he said, that it is month to month rent. I did some searching for a new apartment for myself and found the apartment that I like. problem is, its ready for move in date of April 1st 2022, but we're at the end of the first week of March 2022. would this be too soon of a notice for both my landlord and roommate? Because really it's supposed to be 30 day notice for both my landlord and roommate to find another tenant or if my roommate wishes to stay on his own. what would be the best thing i should do or how xan I not miss this opportunity of getting the apartment I like by april 1st 2022?

    Can I break my lease if I have huge roaches in my house?! I’ve had them crawl on me at night! Not only roaches I’ve have scorpions thankfully I’ve seen them & killed them before they could get away or sting anyone. I’ve also had wolf spiders enter my home. There’s a gap in my front door where they enter. Roaches crawling up the bathroom drain have to close every night. I am a very clean person clean everyday & night before bed. I have a 2 year old & a newborn on the way. My husband has been affected as well. Any advice ? I live in Arizona.

    Ian, I own investment property as well and I agree. This is how the California Residential Lease agreement is written and you covered it all perfectly, even down to getting a credit report for new tenant.

    Why would anyone want to pay any amount of any rent/lease payment each month but no longer live in the home/apartment?

      Hey Brian -- to reduce costs -- for some of us, we can move back home, and only owe a couple of hundred a month to get out of the obligation.

      So people will still pay whatever amount for something that's not even theirs anymore.
      I'd much rather sublet and continue living in a place if I'm still going to pay any amount for it.
      It simply makes the most sense.
      It's one thing to buy someone a tank of gas or up to a full charge for an electric vehicle. Even to buy someone a house. But to make continuous payments on an apartment or similar and not even live in the unit - it's a waste of money on something that can continue being used by the 'helper.'
