Alito should read the Constitution. Separation of religion from government is mentioned twice. The "return" Alito imagines is a fantasy that never existed. The problem with righteous people is they think they're always right.

I'm a retired corporate lawyer. To me, this recording is devastating. Alito really just laid out his cards here, in terms of his general thinking, but also his jurisprudence. This is profoundly disturbing stuff.
Alito does not engage in any recognized form of jurisprudence, unless you consider consequentialism a respectable ideology.

There are zero enforceable ethics for the scotus. Impeachment is the only way to get them off the bench besides retirement or passing away. As Gerald Ford pointed out, at the end of the day an impeachable offense is whatever Congress decides it is. The question isn't whether Alito has done something that justifies removing him from office, but whether there are enough votes in Congress to do that.
Because hanging a flag in distress just like burning a flag by Democrats is not against the law and therefore not an impeachable offense.

I dont believe that it says anywhere in the Constitution what the number of justices should be. Historically the highest number might have been 13, I haven't checked, but that is a tradition, not in the constitution.
You know, both can be done. The United States currently has 13 Federal judicial districts and the number of justices should reflect that.

I had one of those professors and, trust, he definitely suggested new careers to at least 3 different people in 1L who claimed religion "had a place" in government. *Separation of Church and State* is needed to stop *The Handmaid's Tale* from becoming reality.

Separation of Church and State merely means that you cannot enforce any particular religion as a religion of the state. Nowhere does it state Religion has no place in the public domain. Prayer is not against the Constitution, but denying Religious Liberty is and to deny following the Ten Commandments of God, and Freedom to worship, is a violation of the Constitution.

B) The First Amendment protects Freedom OF Religion, which de facto requires Freedom FROM Religion, because various religious doctrines contradict those of other religions (EDIT: or outright order criminal acts by the standards of secular law),
C) The First Commandment is directly in conflict with the First Amendment,
D) The Treaty of Tripoli very clearly states that America was not founded as a Christian nation.

Unfortunately, people forget all people, including wives of justices are allowed to have their own opinions, be religious or not, lean this way or that way. When people pressure justices at cocktail parties with their strong opinions, it's likely the judges generally nod and agree for social and placation reasons, but ignore the chats and hold up their duties on the courts.
@@valkimura1053The point is that judges - at all levels of the judiciary, not just the Supreme Court - must appear to be objective. Flying insurrectionist flags interferes with that. My guess is that you are not familiar with the military - active duty service members are not allowed to put campaign signs on their lawns or openly campaign for candidates. This Alito woman has had all the best of everything, all her life, and yet she is so tiny-minded that she chafes at the sight of an LGBTQ+ flag. She’s hurt by the sight of that flag.

He did not fly the flags, according to him, though legally he may hold those beliefs. One thing, though: the word "insurrection" implies a government take over with the planning and help of at least part of the military, and a plan in place to fill key government positions in the aftermath. The country of Turkey had an attempted insurrection a couple of years ago, but we have never had one in the U.S. - unless you buy the media's implication that the 7 people in the crowd on Jan 6th that were found with weapons on them intended to fight off the entire military and run the government themselves in the aftermath. The media propaganda machine was counting on people not knowing the meaning of "insurrection" and "coup", and they were successful. But, yes, flying upside down flags is silly.

@@B_Bodziak We're the same in NZ. Basically the thinking is that you can take notes during a conversation (say, on a phone call) and that a recording is just a perfect way of taking notes. (I checked with a High Court lawyer when I had some dodgy clients to deal with.)

Nah, the Supreme Court isn't meant to have term limits for a reason. That way it can't be revolutionized suddenly or taken over by new agents on a constant basis. It would be really dumb to have a court where a new 35 year old activist gets on every 4 years and starts making weird interpretations of the constitution. It makes sense for presidents to have term limits so they don't become dictators.
